फा. सं. 01 / 94/ 180 /सार्वजनिक सूचना/ए एम 04/पी सी-4.-निर्यात आयात नीति 2002-2007 के पैराग्राफ 2.4 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए विदेश व्यापार महानिदेशक एत‌द्वारा प्रक्रिया पुस्तक (खण्ड 1 ) में निम्नलिखित संशोधन करते हैं :

1. किसी आयात लाइसेंस/ प्रमाण पत्र/ अनुमति की वैधता से संबंधित पैराग्राफ 2.12 ( iii ) को इस प्रकार संशोधित किया जाता है : -

स्पेयर्स , रिप्रेक्टरीज, कैटलिस्ट और कज्यूमेवल के लिए ई पी सी जी लाइसेंस

2. "प्रोटोटाइप्स" से संबंधित पैरा 2.47 को निम्नानुसार संशोधित किया जाता है: -

नए/पुराने प्रोटोटाइप/पुराने सैम्पलों का आयात लाइसेंस /प्रमाणपत्र/ अनुमति के बिना शुल्क के भुगतान पर अनुमत होगा । यह आयात उत्पाद विकास या अनुसंधान हेतु माँगे गए प्रोटोटाइप जिसके हेतु नद में अनुसंधान हेतु औद्योगिक लाइसेंस/ आशय पत्र होने अथवा उत्पादन में संलग्न वास्तविक प्रयोक्त्ता (औद्योगिक ) को इस बारे में सीमाशुल्क प्राधिकारियों के संतोष के अनुसार दिया जाएगा ।

3. पैरा 2.52.1 को निम्नानुसार संशोधित किया जाता है :

स्तरधारक निर्यात संवर्धन हेतु निःशुल्क आधार पर मुक्त रुप से निर्यात की जाने वाली निर्यात योग्य मदों को निर्यात करने हेतु हकदार होगा, यह निर्यात विगत तीन लाइसेंसिंग वर्षों में औसत वार्षिक निर्यात प्राप्ति के दो प्रतिशत अथवा दस लाख रुपये की वार्षिक सीमा, जो भी ज्यादा हो , किया जाएगा। 301 GI/ 2004

1. आवेदन पत्र और उसके साथ लगाए गए अनुलग्नकों में दिए गए ब्यौरे तथा विवरण मेरी / हमारी अधिकतम जानकारी के अनुसार सत्य है और उसमें कुछ भी छुपाया नहीं गया है या रोका गया है । 2. यदि आवेदन पत्र में दी गई कोई सूचना गलत या असत्य या भ्रामक पाई जाती है तो इस आवेदन- पत्र के आधार पर मंजूर किए गए लाइसेंस को निरस्त कर दिया जाए या किसी ऐसी कार्रवाई के प्रति बिना पक्षपात के उसे अप्रभावी कर दिया जाए तो इसके लिए विदेश व्यापार विकास और विनियमन अधिनियम, 1992, या इसके अन्तर्गत बने नियमों तथा आदेशों और सीमाशुल्क अधिनियम 1962 के अन्तर्गत की जा सकती है ।

3. उपर्युक्त विवरण में दी गई कोई सूचना यदि असत्य या झूठी सिद्ध हो तो मैं/ हम किसी दाण्डिक कार्रवाई या अन्य परिणामों के लिए उत्तरदायी होऊंगा/होगें जो कानून में या अन्यथा निर्धारित हो । 4. मैं/ हम आगे घोषित करते हैं कि भारतीय रिजर्व बैंक द्वारा निर्धारित समय सीमा के भीतर या ऐसी रियायती समयावधि जिसके लिए रिजर्व बैंक ऑफ इंडिया ने अनुमति दी है की समयावधि में निर्यात वसुलियां नहीं हुई हैं ।

7 6. मैं/ हम डिलीवरी के 30 दिनों के भीतर डी जी एफ टी (पी सी -3 ) को गंतव्य राज्य पक्ष की आगम बिल की एक प्रति प्रस्तुत करूंगा जिसके न होने पर मेरे विरूद्ध विदेश व्यापार विकास और विनियमन अधिनियम 1992 , या इसके अन्तर्गत बने नियमों तथा आदेशों और सीमाशुल्क अधिनियम 1962 के अन्तर्गत की जा सकती है ।

7. मैं/ हम एतद्वारा घोषणा करते हौ कि हमने सकोमेट मदों के निर्यात हेतु हमें जारी सभी पिछले लाइसेंसों की शर्तों को पूरा किया है, आवेदनों बारे में अंतिमद वप्रयोक्ता द्वारा निर्यात की मदों के बारे में निर्धारित समय में दस्तावेजी प्रमाण सहित उन्हें डीजीएफटी को दिया था।

1. Paragraph 2.12 ( iii ) pertaining to the validity of an import licence / certificate/ permission is amended as under: -

2. Paragraph 2.47 pertaining to " Prototypes " is amended as under :

Import of new/second hand prototypes/ second hand samples may be allowed on payment of duty without a licence/ certificate/ permission to an Actual User (industrial) engaged in the production of or having industrial licence/letter of intent for research in the item for which prototype is sought for product development or research, as the case may be , upon a self- declaration to that effect , to the satisfaction of the customs authorities .

3. Paragraph 2.52.1 is amended as under :

Status holders shall be entitled to export freely exportable items on free of cost basis for export promotion subject to an annual limit of Rs.10 lakhs or 2 % of the average annual export realization during the preceding three licensing years whichever is higher.

4. Appendix 16A pertaining to application form for grant of export licence for export of SCOMET items mentioned as restricted for export in appendix 3 schedule 2 of ITC(HS) classifications of export and import items is appended to this Public Notice .
