फा. सं. 01 /94/180/सार्वजनिक सूचना/ए एम 04 /पी सी-4.-निर्यात आयात नीति 2002-2007 के पैराग्राफ 2.4 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए विदेश व्यापार महानिदेशक एतद्वारा प्रक्रिया पुस्तक (खण्ड 1 ) में निम्नलिखित संशोधन करती है :
1 . "ईओ यू ई एच टी पी और एस टी पी योजना " से संबंधित परिशिष्ट 14 - झ के पैराग्राफ 4.2, 4.6 और 27 (क) को निम्नानुसार संशोधित किया गया हैः-
4.2 सेवा क्षेत्रों में यूनिट स्थापित करने के लिए प्रस्तावों के अलावा (आर एण्ड डी, साफ्टवेयर और आई टी सेवाएँ या अनुमोदन बोर्ड द्वारा प्रत्यायोजित अन्य कोई सेवा कार्यकलाप के अलावा ) ई ओ यू योजना के तहत यूनिट स्थापित करने के लिए ओवदनों को प्रक्रिया पुस्तक (खण्ड-1 ) के परिशिष्ट 14- झ ख में निर्दिष्ट मानदण्डों और परिशिष्ट -14 झग में दिए गए अनुमोदन से संबंधित क्षेत्र विशेष की शर्तों के अनुसार यूनिट अनुमोदन समिति द्वारा 15 दिन के भीतर स्वीकृत या अस्वीकृत करना होगा । अन्य मामलों में, मंजूरी बोर्ड द्वारा सहमति देने के पश्चात् विकास आयुक्त द्वारा दी जाएगी ।
4.6 अनुमोदन मिलने पर, विकास आयुक्त द्वारा ई ओ यू ई एच टी पी/ एस टी पी यूनिट को अनुमति पत्र/आशय-पत्र जारी किया जाएगा । उत्पादन शुरु करने के लिए अनुमति पत्र की प्रारम्भिक वैधता अवधि तीन वर्ष होगी । इसकी वैधत अवधि सक्षम प्राधिकारी द्वारा तीन और 305 GI/2004

[PART I-SEC . 1 ] वर्षों के लिए बढ़ाई जा सकती है । तथापि 1.4.2002 से पूर्व अनुमोदित प्रस्तावों पर 6 वर्ष के बाद वैधता अवधि बढ़ाने हेतु अनुमोदन बोर्ड द्वारा मामला दर मामला आधार पर विचार किया जाएगा । अनुमति पत्र के विस्तार के लिए एक मानक प्रपत्र परिशिष्ट 14 - झ ध में दिया गया है ।
27(क): सेवा क्षेत्र (आर एण्ड डी, साफ्टवेयर और आई टी सेवाओं या अनुमोदन बोर्ड द्वारा यथा प्रत्यायोजित किसी अन्य सेवा कार्यकलाप के अलावा) में यूनिट स्थापित करने के प्रस्तावों के अलावा ई ओ यू स्थापित करने के लिए आवेदनों, जिन विनिर्माण मदों के लिए उद्योग ( विकास तथाविनियमन) अधिनियम , ' 951 के तहत औद्योगिक लाइसेंस आवश्यक है, पर अनुमोदन बोर्ड द्वारा विचार किया जाएगा ।
2. " निर्यातोन्मुख यूनिटों के लिए अनुमति- पत्र के विस्तार के लिए प्रपत्र" से संबंधित एक नया परिशिष्ट -14 झडड इस सार्वजनिक सूचना के साथ जोड़ा गया है ।
3. परिशिष्ट- 14-2 के पैराग्राफ 7.3 और पैराग्राफ 3.1 (क) में कोष्टक में " अलावा " शब्द के पश्चात्, " आर एण्ड डी" शब्द को शामिल किया जाएगा ।
इसे लोकहित में जारी किया जाता है ।

निर्यातोन्मुख यूनिटों के लिए अनुमति पत्र के विस्तार हेतु प्रपत्र
1. यूनिट का नाम व पताः
2. अनुमति पत्र की मंजूरी की तिथि और अनुमत मूल अवधि
3. उत्पादन के लिए अनुमत मदें

(ड.) भवन निर्माणः
(च) विधिक वचनबद्धता के निष्पादन की तारीखः
(छ) ग्रीन कार्ड संख्या और इसकी वैधता अवधि
(ज) सीमाशुल्क अधिनियम, 1962 की धारा 58 और 65 के तहत सी.ई. क्षेत्राधिकार से प्राप्त लाइसेंस बाण्डिंग की तारीख
(झ) ख -17 बाण्ड के निष्पादन की तारीख

(ट) क्या स्थानीय सीमाशुल्क/ केन्द्रीय उत्पाद शुल्क द्वारा कोई एस सी एन जारी किया गया है:

(ढ) कुल अद्यतन निवेश और उसकी मदें

F. No. 01 / 94 /180/ Public Notice/ AM 04/PC - IV. In exercise of powers conferred under Paragraph 2.4 of the Export and Import Policy 2002-2007, the Director General of Foreign Trade hereby makes the following amendments in Handbook of Procedures (Vol . I) :

1. Paragraphs 4.2, 4.6 and 27 ( a) of Appendix 14 -1 pertaining to "EOUS , EHTPs and STPs Scheme " is amended as under:
4.2 : Applications for setting up of units under EOU scheme other than proposals for setting up of unit in the services sector (except R& D, software and IT enabled services , or any other service activity as may be delegated by the BOA) , shall be approved or rejected by the Units Approval Committee within 15 days as per the criteria indicated in Appendix- 14 - IB and Sector specific conditions relating to the approval given in Appenxid - 14 - IC . In other cases , approval may be granted by the Development Commissioner after clearance by the Board of Approval .
4.6: On approval , a Letter of Permission ( LOP) / Letter of Intent (LOI ) shall be issued by the Development Commissioner to EOU /EHTP/ STP unit . The LOP shall have an initial validity of 3 years for commencement of production . Its validity may be extended by another 3 years , beyond initial validity, by the competent authority . However , proposals approved prior to 1.4.2002 shall be considered on a case to case basis by BOA beyond six years . Standard Format for LOP extension is given at Appendix 14- IS .
27(a ) : To consider applications for setting up EOUs other than proposals for setting up of unit in the services sector (except R&D, software and IT enabled services , or any other service activity as may be delegated by the BOA ) , Item of manufacturer requiring industrial licence under the Industrial (Development & Regulation ) , Act, 1951 shall be considered by the BOA .
2. A new Appendix 14 IMM pertaining to " Proforma for extension of LOP for Export Oriented Units " is appended to this Public Notice .
3. In paragraph 7.3 and paragraph 31 (a) of Appendix 14 II , after the word " except " , in bracket, the word " R & D , " shall be inserted .
