रा ० वि ० एकक सा.का.नि. 78 (अ). - राष्ट्रपति संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय उत्पाद शुल्क और सीमा शुल्क विभाग अवर श्रेणी लिपिक भर्ती नियम, 2002 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय उत्पाद शुल्क और सीमा शुल्क विभाग अवर श्रेणी लिपिक भर्ती (संशोधन ) नियम, 2004 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय उत्पाद शुल्क और सीमा शुल्क विभाग अवर श्रेणी लिपिक भर्ती नियम, 2002 की अनुसूची के स्तम्भ 12 में मद ( i ) और ( ii ) तथा उससे संबंधित प्रविष्टियों के स्थान पर क्रमशः निम्नलिखित रखा जाएगा , अर्थात्:-
" ( i ) 50 प्रतिशतं रिक्तियां ऐसे हवलदारों और अभिलेखपालों में से 30 : 1 के अनुपात में ज्येष्ठता सह उपयुक्तता के आधार पर प्रोन्नति द्वारा भरी जाएंगी जिनके पास मान्यताप्राप्त बोर्ड या विश्वविद्यालय से मैट्रिकुलेशन या समतुल्य अर्हता है और जिन्होंने किसी आयु सीमा के बिना उस श्रेणी में5 वर्ष नियमित सेवा की है ।
( ii ) 50 प्रतिशत रिक्तियां ऐसे सिपाहियों, हवलदारों, अभिलेखपालों और गैस्टेटनर आपरेटरों में से 60: 36 : 1 : 1 के अनुपात में प्रोन्नति द्वारा भरी जाएगी जिनके पास मान्यता प्राप्त बोर्ड या विश्वविद्यालय से मैट्रिकुलेशन या समतुल्य अर्हता है और जिन्होंने सिपाही, हवलदार, अभिलेखपाल, गैस्टेटनर आपरेटर की श्रेणी में 5 वर्ष नियमित सेवा की है तथा किसी विभागीय अर्हता परीक्षा के आधार पर अंग्रेजी टंकण में 30 शब्द प्रति मिनट की न्यूनतम गति से तथा हिन्दी टंकण में 25 शब्द प्रति मिनट की गति से परीक्षा उत्तीर्ण की है ।

NOTIFICATION
New Delhi , the 27th January, 2004
G.S.R. 78 ( E ). In exercise of the powers conferred by the proviso to article 309 ofthe Constitution, the President hereby makes the following rules to amend the Central Excise and Customs Department Lower Division Clerk Recruitment Rules, 2002 , namely :--
1.Short title and commencement . ( 1 ) These rules may be called the Central Excise and Customs Department LowerDivision Clerk Recruitment (Amendment) Rules, 2004.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Inthe Schedule of Central Excise and Customs Department- Lower Division Clerk Recruitment Rules, 2002, in column 12, for items ( i) and ( ii) and the entries relating thereto, the following shall respectively by substituted, namely:-
"(i) 50 per cent of the vacancies shall be filled by promotion from amongst Havaldars and Record Keepers in the ratio of30 : 1 on the basis of seniority -cum- fitness who possess Matriculation or equivalent qualification as per recognized Board or University and have rendered five years ' regular service in the grade , without any age limit;
( ii) 50 per cent of the vacancies shall be filled by promotion from amongst Sepoy, Havaldar, Record Keeper and Gestetner Operator in the ratio of60 : 36 : 1 : 1 who possess Matriculation or equivalent qualification as per recognizedBoard or University and have rendered five years ' regular service in the grade Sepoy, Havaldar, Record Keeper, Gestetner Operator and feeder cadres thereto on the basis ofDepartmental qualifying examination with typing test with minimum speed of 30 words per minute in English typewriting or 25 words per minute in Hindu typewriting."
