सं.यू-23013/03/04-एल.डब्ल्यू.-ठेका श्रम (विनियमन एवं उत्सादन ) अधिनियम, 1970 की धारा -5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय ठेका श्रम सलाहकार बोर्ड एतद्वारा इंडियन ऑयल कार्पोरेशन लिमिटेड, साबरमती टर्मिनल, साबरमती, अहमदाबाद के प्रतिष्ठान में ठेका श्रम उन्मूलन के प्रश्न पर विचार करने हेतु एक समिति का गठन करता है । समिति का संघटन और उसके विचारार्थ विषय निम्नलिखित होंगे :-

2. समितिके विचारार्थ विषय निम्नलिखित होंगे :-
" इंडियन ऑयल कार्पोरेशन लिमिटेड, साबरमती टर्मिनल, साबरमती , अहमदाबाद के प्रतिष्ठान में कैन्टीन, सामान लादने/उतारने ( कारटेज क्लीयरिंग ) , सफई तथा पिट के रख - रखाव के जॉब/कार्यों, में ठेका श्रम पद्धति का अध्ययन करना तथा ठेका श्रम (विनियमन एवं उत्सादन ) अधिनियम, 1970 की धारा -10 के उपबंधों को ध्यान में रखते हुए उपयुक्त सिफारिशें करना कि उक्त प्रतिष्ठानों में उपर्युक्त जॉब /कार्यों में ठेका श्रम के नियोजन को प्रतिषिद्ध किया जाए अथवा नहीं ।"
3. समिति का मुख्यालय अहमदाबाद में होगा । समिति शीघ्रातिशीघ्र अपनी रिपोर्ट प्रस्तुत करेगी ।

New Delhi , the 8th March, 2004
No. U -23013/ 03/ 04- LW.- In exercise of the powers conferred by Section 5 of the Contract Labour (Regulation and Abolition) Act , 1970, the Central Advisory Contract Labour Board hereby constitutes a Committee to go into the question of abolition of contract labour in the establishment of Indian Oil Corporation Limited, Sabarmati Terminal , Sabarmati , Ahmedabad. The composition of the committee and its terms of reference will be as under: -

The terms of reference of the committee would be as follows: -

"To study the working of contract labour system in the jobs/works of Canteen, Loading/unloading(Cartage clearing) , cleaning and pit maintenance in the establishment of Indian Oil Corporation Limited, Sabarmati Terminal , Sabarmati , Ahmedabad and to make suitable recommendations whether or not the employment of contract labour in the said jobs/works in the said establishment be prohibited keeping in view the provisions of Section 10 of the Contract Labour (Regulation and Abolition ) Act , 1970. "
3. TheHeadquarters of the Committee will be at Ahmedabad . The Committee should submit its report at the earliest .

समिति के विचारार्थ विषय निम्नलिखित होंगे : -

" अनुसूची-1 के अन्तर्गत विनिर्दिष्ट जॉब/ कार्यों में तथा अनुसूची- ।। के अन्तर्गत उल्लिखित मैसर्स तेल एवं प्राकृतिक गैस निगम लिमिटेड , महाराष्ट्र के विभिन्न प्रतिष्ठानों में ठेका श्रम पद्धति का अध्ययन और ठेका श्रम विनियमन एवं उत्सादन) अधिनियम , 1970 की धारा -10 के उपबंधों को ध्यान में रखते हुए उपयुक्त सिफारिशें करना कि अनुसूची- के अन्तर्गत उक्त जॉब/कार्यों एवं अनुसूची-।। के अन्तर्गत उक्त प्रतिष्ठानों में ठेका श्रम के नियोजन को प्रतिषिद्ध किया जाए अथवा नहीं । "

अनुसूची I
1. ट्रक/जहाज से पाइपों , स्टील की वस्तुओं , सीमेन्ट इत्यादि या पैक डिब्बों जैसे सामान को चढ़ाना/ उतारना तथा गोदामों में पहुंचना व गोदामों से लेजाकर ट्रक/जहाज पर चढ़ाना/उतारना ।
2. समुद्री सेवा , निकासी और अग्रेषण ।
3. हाउसकीपिंग अर्थात झाडू लगाना , साफ- सफाई करना ।
4. केटरिंग सेवा/कैन्टीन ।
5. चौकीदार/ सुरक्षा गार्डों का कार्य ।
6. विद्युत इन्सटालेशन/उपकरणों (डी जी सैट , पम्पस , ए/ सी इत्यादि का रख - रखाव । 7. जल आपूर्ति लाइनों और सलेज ट्रीटमेन्ट प्लांट का रख - रखाव ।
8. नलसाज का कार्य ।
9. बढ़ई का कार्य ।
10. लिफ्ट चलाना ।
11. डाउन होल और सर्फेस उपकरणों की सर्विसिंग , मरम्मत , सैग्रीगेशन , पैलेटाइजिंग । 12. सामग्री की आयलिंग और ग्रीसिंग तथा उसे परिवहन अनुभाग को भेजना ।
3. बगीचों का रख-रखाव और घास कटाई ।

"To study the working of contract labour system in the jobs/works mentioned in schedule I at the various establishments of M/S Oil and Natural Gas Corporation Limited in the State of Maharashtra mentioned in schedule II and to make suitable recommendations whether or not the employment of contract labour in the said jobs/works in schedule I in the said establishments in schedule II be prohibited keeping in view the provisions of Section 10 of the Contract Labour (Regulation and Abolition) Act, 1970. "
3. TheHeadquarters of the Committee will be at Mumbai . The Committee should submit its report at the earliest .
