भारतीय लघु उद्योग विकास बैंक ( कर्मचारी भविष्य निधि) ( संशोधन ) विनियमावली , 2004
एच.ओ. नं. 6684/एच.आर.डी.डी./स्टाफ जनरल ( 2 ) भारतीय लघु उद्योग विकास बैंक अधिनियम , 1989 ( 1989 का 39 ) की धारा 52 की उप - धारा ( 2 ) के खंड (घ ) के साथ पठित उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय लघु उद्योग विकास बैंक का निदेशक मंडल एतद्द्वारा भारतीय लघु उद्योग विकास बैंक ( कर्मचारी भविष्य निधि ) विनियमावली, 1990 , में निम्नलिखित संशोधन करता है, अर्थात्:
1. ( 1 ) यह विनियमावली भारतीय लघु उद्योग विकास बैंक (कर्मचारी भविष्य निधि) (संशोधन) विनियमावली, 2004 कहलाएगी
(2) ये विनियमावली, राजपत्र में प्रकाशित होने की तिथि से प्रभावी होगी.
2. भारतीय लघु उद्योग विकास बैंक (कर्मचारी भविष्य निधि) विनियमावली , 1990 (इसके बाद इसमें इसे मुख्य विनियमावली कहा गया है) में:
(1 ) विनियम 2 का उप विनियम ( iii ) प्रतिस्थापित किया जाएगा, अर्थातः
"(iii) "अध्यक्ष एवं प्रबंध निदेशक" से अभिप्राय है- लघु उद्योग बैंक के अध्यक्ष एवं प्रबंध निदेशक;
2. मुख्य विनियमावली का विनियम (4) निम्नलिखित से प्रतिस्थापित किया जाएगा, अर्थातः- " (4) संचालन - यह फंड लघु उद्योग बैंक द्वारा धारित किया जाएगा तथा इसका संचालन , संचालकों की एक समिति करेगी. समिति का संघटन तथा संचालकों के व्यक्तिगत नामांकन का निर्णय अध्यक्ष एवं प्रबंध निदेशक करेंगे . फंड के संचालकों विभिन्न विनियमों के अंतर्गत प्रदत विशेष शक्तियों के प्रत्ति 767 GI/2004

[PART III-SEC . 4] पूर्वाग्रह रहित होकर वे, इस विनियमावली के अंतर्गत, फंड की ओर से, सभी शक्तियों का प्रयोग करने तथा सभी कार्रबाइयाँ करने के हकदार होंगे. "
(3) मुख्यविनियमावली का विनियम ( 5 ) निम्नलिखित से प्रतिस्थापित किया जाएगा, अर्थात . " ( 5 ) गणपूर्ति तथा संचालकों की बैठकः व्यवसाय के लेनदेन के लिए गणपूर्ति ( कोरम ) हेतु न्यूनतम 3 संचालकों की उपस्थिति आवश्यक होगी. प्रत्येक संचालक का एक वोट होगा तथा दोनों पक्षों में बराबर संख्या होने की दशा में, सभी मामलों में बैठक के अध्यक्ष का वोट निर्णायक होगा. "
(4) मुख्य विनियमावली के विनियम ( 6 ) में ... ऐसी ही बाद की तिथि.... शब्दों के बाद ...छह महीने से अधिक नहीं.... ' शब्द जोड़े जाएंगे:
मुख्य विनियमावली के विनियम ( 11 ) में.
(क) ' .....लघु उद्योग बैंक के अंशदान -' शब्दों से आरंभ होने वाला तथा .....विनियम 9 के ...... ' शब्दों से समाप्त होने वाला पहला पैरा निम्नलिखित पैरा से प्रतिस्थापित किया जाएगा: -
" ( 11 ) लघु उद्योग बैंक का अंशदान- इस विनियमावली में अन्यथा किए गए प्रावधान को छोड़कर, लघु उद्योग बैंक हर महीने, फंड में प्रत्येक अंशदाता के खाते में, लघु उद्योग बैंक द्वारा प्रत्येक अंशदाता के लिए निर्धारित न्यूनतम राशि के बराबर राशि का अंशदान करेगा; बशर्ते लघु उद्योग बैंक द्वारा निम्नलिखित अंशदाताओं के संबंध में ऐसा कोई अंशदान नहीं किया जाएगा:
(i) जिन अंशदाताओं पर भारतीय लघु उद्योग विकास बैंक पेंशन विनियमावली , 2002 लागू होती है, अथवा
(ii) जिन अंशदाताओं को विनियम 7 के उप- विनियम (iii ) तथा विनियम 9 के उप विनियम ( ii ) के अंतर्गत अंशदान करने की अनुमति है;
(ख) ' ...और बशर्ते.....' शब्दों से आरंभ होने वाला तथा ' ....अस्थायी सेवा .....' शब्दों से समाप्त होने वाला पहला परंतुक निम्नलिखित पैरा से प्रतिस्थापित किया जाएगा , अर्थातः-
और बशर्ते , विनियम 7 के उप-विनियम (iii) के अंतर्गत अंशदान करने वाले अस्थायी कर्मचारी के मामले में, जो बाद में लघु उद्योग बैंक का स्थायी कर्मचारी बन गया है तथा जिस पर भारतीय लघु उद्योग विकास बैंक पेंशन विनियमावली, 2002 लागू नहीं होती है, लघु उद्योग बैंक उस कर्मचारी के स्थायी होने के बाद, उसकी अस्थायी सेवा के दौरान उस कर्मचारी के लिए निर्धारित न्यूनतम राशि के बराबर राशि का अंशदान करेगा . "
(6) मुख्य विनियमावली के विनियम ( 12) में ' ... की सेवा की शर्तें...' शब्दों के बाद 'अध्यक्ष अथवा प्रबंध निदेशक' शब्दों के स्थान पर 'अध्यक्ष एवं प्रबंध निदेशक अथवा उप प्रबंध निदेशक/पूर्णकालिक निदेशक ' शब्द आएँगे;

3 (7) मुख्य विनियमावली के विनियम ( 12 ) के बाद एक नया विनियम जोड़ा जाएगा, अर्थातः-
" ( 12 क) जिन कर्मचारियों पर भारतीय लघु उद्योग विकास बैंक पेंशन विनियमावली, 2002 लागू होती है, उनके मामले में संचालक, इस विनियमावली के अंतर्गत उन कर्मचारियों के बारे में लघु उद्योग बैंक द्वारा किए गए अंशदान की कुल राशि तथा उस पर अर्जित ब्याज, भारतीय लघु उद्योग विकास बैंक पेंशन विनियमावली 2002 के अंतर्गत गठित पेंशन फंड ट्रस्ट में पेंशन योजना के संचालन के उद्देश्य से अंतरित करेंगे. "
(8) मुख्य विनियमावली के विनियम ( 13 ) में ' ...बशर्ते ब्याज दर...' शब्दों के बाद .....समतुल्य...' शब्द के स्थान पर ' ...से कम नहीं... ' शब्द आएँगे:
(9) मुख्य विनियमावली के विनियम ( 19 ) में,
(क) उप- विनियम ( i ) में दूसरे परंतुक में, '... पूरा होने के बाद किसी भी समय... ' शब्दों के बाद ' ... यदि आहरण ...उद्देश्य के लिए है तो 15 वर्ष की सेवा' शब्दों के स्थान पर ' .... यदि आहरण नये मकान अथवा नए फ्लैट की खरीद के उद्देश्य से है तो 10 वर्ष की सेवा पूरी करने के बाद अथवा यदि आहरण अन्य आवास उद्देश्यों के लिए है तो 15 वर्ष की सेवा पूरी करने के बाद' आएगा;
(ख) उप-विनियम (ii ) के खंड ( ख) के उप- खंड (5) के परंतुक में ' ...बशर्ते आहरण.....' शब्दों से आरंभ होने वाले तथा ' विनियम 19 का उप- विनियम ( v) ... ' शब्दों से समाप्त होने वाले शब्द निम्नलिखित से प्रतिस्थापित किए जाएंगे, अर्थातः-
" बशर्ते विनियम 19 के उप-विनियम (v) के अंतर्गत मामले को छोड़कर, दो मकानों/ भूखंडों से अधिक की खरीद के लिए आहरण नहीं दिए जाएंगे . "
( 10 ) मुख्य विनियमावली के विनियम 20 के उप- विनियम (iii ) में ' ... लघु उद्योग बैंक को संतुष्ट करेगा... ' के बाद 'लघु उद्योग बैंक द्वारा निर्धारित उचित अवधि... ' शब्दों के स्थान पर ' ...आहरण की तिथि से छह महीने... ' शब्द आएंगे.
(11 ) मुख्य विनियमावली के विनियम 22 में,
(क) उप-विनियम (i ) में ...जैसा भी वे उचित समझें ... ' के बाद ' ...किसी भी अधिकारी को सौंप सकते हैं.. ' शब्दों के स्थान पर ' ...कार्यपालक निदेशक अथवा मुख्य महाप्रबंधक अथवा महाप्रबंधक अथवा उप महाप्रबंधक... ' शब्द आएंगे.
(ख) उप- विनियम (ii ) के खंड (क) में THE GAZETTE OF INDIA : EXTRAORDINARY
[PART III-SEC. 4] (i ) ' ..द्वारा मंजूर किया जा सकता है... ' के बाद ' ...महाप्रबंधक...' शब्दों के स्थान पर ...मुख्य महाप्रबंधक... ' शब्द आएंगे;
(ii ) ' ..कार्यपालक निदेशक द्वारा .. ' के बाद ' ... अथवा प्रबंध निदेशक... ' शब्द हटा दिए जाएंगे.
( ग) उप- विनियम ( ii ) के खंड (ख) में ' ..द्वारा मंजूर किया जा सकता है... ' के बाद '...महाप्रबंधक... ' शब्दों के स्थान पर '...मुख्य महाप्रबंधक...' शब्द आएंगे ;
(घ) उप -विनियम (ii ) के खंड (ग) में,
( i ) '..द्वारा मंजूर किया जा सकता है... ' के बाद '... महाप्रबंधक... ' शब्दों के स्थान पर '...मुख्य महाप्रबंधक... ' शब्द आएंगे: '
( ii ) ' ..कार्यपालक निदेशक द्वारा .. ' के बाद ... अथवा प्रबंध निदेशक... ' शब्द हटा दिए जाएंगे.
(च) उप-विनियम ( iii ) के खंड ( क) के स्थान पर निम्नलिखित अभिव्यक्ति आएगी, अर्थातः-
"मुख्य महाप्रबंधक में महाप्रबंधक तथा उप महाप्रबंधक भी शामिल हैं.

SMALL INDUSTRIES DEVELOPMENT BANK OF INDIA [ EMPLOYEES ' PROVIDENT FUND] ( AMENDMENT) REGULATIONS , 2004
H.O. No. 6684/ H.R.D.D./ Staff General (2) .- In exercise of the powers conferred by Sub- section ( 1 ) read with clause (d) of Sub-section (2) of Section 52 of the Small Industries Development Bank of India Act, 1989 (39 of 1989) , the Board of Directors of Small Industries Development Bank of India hereby makes the following amendments to Small Industries Development Bank of India [ Employees ' Provident Fund ] Regulations , 1990, namely : -
1. ( 1 ) These regulations may be called Small Industries Development Bank of India [ Employees ' Provident Fund] ( Amendment ) Regulations , 2004.
(2) They shall come into force on the date of publication in the Official Gazette .

5 2. In Small Industries Development Bank of India [Employees ' Provident Fund] Regulations , 1990 (hereinafter referred to as the principal regulation) :
( 1) Sub - Regulation ( iii ) of Regulation (2) shall be substituted namely : -
66 (iii) " Chairman and Managing Director " means the Chairman and Managing Director of the Small Industries Bank;
(2) Regulation (4) of the principal regulation shall be substituted by the following namely: -
" (4) Administration: - The Fund shall be held by the Small Industries Bank and shall be administrated by a Committee of Administrators . The composition of the Committee and nomination of individual members shall be decided by the Chairman and Managing Director . Without prejudice to the specific powers conferred on them under the various Regulations , the Administrators of the Fund shall be entitled to exercise all powers and to do all acts and things on behalf of the Fund under these Regulations ."
(3) Regulation (5) of the principal regulation shall be substituted by the following namely: -
" (5) The quorum and meeting of Administrators : - The presence of at least three Administrators shall be necessary to form a quorum for the transaction of business . Each Administrator shall have one vote and in all cases of an equal division, the chairman of the meeting shall have a casting vote . " (4) In Regulation (6) of the principal regulation , after the words ' or such later date' the words ' not exceeding six months ' shall be inserted;
(5) In Regulation ( 11 ) of the principal regulation,
(a) the first paragraph beginning from the words ' Small Industries Banks ' contribution ' and ending with the words ' of Regulation 9 ' shall be substituted by the following paragraph namely : -
"( 11 ) Small Industries Banks ' contribution Save as otherwise provided. in . these Regulations , the Small Industries Bank shall contribute every month a sum equal to the minimum prescribed by the Small Industries Bank for each subscriber to his account in the Fund , provided that no such contribution shall be made by the Small Industries Bank in respect of subscribers ,
(i) governed by Small Industries Development Bank of India Pension Regulations , 2002 , or 6

[PART III-SEC. 4] (ii) permitted to subscribe under sub- regulation (iii) of Regulation 7 and sub - regulation (ii) of Regulation 9 ; "
(b) the first proviso beginning from the words ' provided further that in the case of' , and ending with the words ' temporary service , ' shall be substituted by the following paragraph namely : -
" provided further that in the case of a temporary employee subscribing under sub- regulation (iii ) of Regulation 7 who has subsequently become permanent employee of the Small Industries Bank and who is not governed by the Small Industries Development Bank of India Pension Regulations , 2002 , the Small Industries Bank shall , after such employee is made permanent , contribute a sum equal to the minimum prescribed for such employee during his temporary service" .
(6) In Regulation ( 12) of the principal regulation , after the words ' the terms of service of ' , the words ' a Chairman or Managing Director ' shall be substituted by the words ' the Chairman and Managing Director or Deputy Managing Director/Whole- time Director ' ;
(7) After Regulation ( 12) of the principal regulation , a new Regulation shall be inserted , namely : -
"( 12A) The Administrators , shall in the case of the employees to whom Small Industries Development Bank of India Pension Regulations , 2002 apply , transfer the aggregate amount of contributions made by the Small Industries Bank under these regulations in respect of those employees together with interest accrued thereon ,to the Trust of the Pension Fund constituted under Small Industries Development Bank of India Pension Regulations , 2002 for the purpose of administration of the Pension Scheme" .
(8) In Regulation 13 of the principal regulation , after the words " provided that the rate of interest shall be " , the words " equal to " shall be substituted by the words " not lower than" ;
(9) In Regulation 19 of the principal regulation: -
(a) in second proviso in sub - regulation ( i) , after the words " at any time after completion of" , the words 15 years service , if the withdrawal is for the purpose ' shall be substituted by the words '10 years service , if the withdrawal is for the purpose of acquisition of a new house or new flat or 15 years service ifthe withdrawal is for other housing purposes ' ;
(b) the proviso in sub - clause (5) in clause (b) of sub- regulation ( ii) , the words beginning from ' provided that withdrawal shall not be ' and ending with the words ' sub - regulation (v) of Regulation 19 ' shall be substituted by the following namely: - [ भाग III- खण्ड 4 ]

7 "provided that withdrawals shall not be granted for acquisition of more than two houses / sites except in a case covered by sub - regulation (v) of Regulation 19."
(10) In sub -regulation (iii) of Regulation 20 of the principal regulation , after the words ' shall satisfy the Small Industries Bank within ' , the words ' a reasonable period as may be specified by the Small Industries Bank ' , shall be substituted by the words ' six months from the date of withdrawal ' .
(11). In Regulation 22 of the principal regulation ,
(a) in sub - regulation ( i) , after the words ' as they may think fit to impose , ' the words ' delegate to any officer' shall be substituted by the words ' delegate to Executive Director or a Chief General Manager or a General Manager or a Deputy General Manager ' ;
(b) in clause (a) of sub -regulation (ii ),
(i) after the words ' may be sanctioned by' , the words ' the General Manager' , shall be substituted by the words ' the Chief General Manager';
(ii) after the words ' by an Executive Director ' , the words ' or Managing Director ' shall be deleted;
(c) in clause (b) of sub - regulation ( ii ) , after the words ' may be sanctioned by' , the words ' the General Manager ' , shall be substituted by the words ' the Chief General Manager ' ;
(d) in clause ( c) of sub - regulation (ii ) ,
(i) after the words ' may be sanctioned by' , the words ' the General Manager' , shall be substituted by the words ' the Chief General Manager' ;
(ii) after the words by an Executive Director' , the words ' or Managing Director ' shall be deleted;
(e) clause (a) of sub - regulation ( iii) shall be substituted by the following clause, namely:-
" (a) Chief General Manager includes a General Manager and a Deputy General Manager .
