का.आ. 320(अ).- राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण , भारत सरकार के रसायन और उर्वरक मंत्रालय द्वारा जारी का. आ. 637 ( अ) तारीख 4 सितम्बर, 1997 के साथ पठित औषध ( कीमत नियंत्रण ) आदेश , 1995 के पैरा 9 के उप पैरा ( 1 ) और ( 2 ) और पैरा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, नीचे की सारणी के स्तंभ ( 5 ) में विनिर्दिष्ट कीमत को उक्त सारणी के स्तंभ ( 3 ) और ( 4 ) में की क्रमशः तत्स्थानी प्रविष्टियों में विनिर्दिष्ट प्रबलता और पैक आकार सहित उस सारणी के स्तंभ ( 2 ) में की तत्स्थानी प्रविष्टि में विनिर्दिष्ट अनुसूचित विनिर्मितियों में से प्रत्येक की, उत्पाद शुल्क और स्थानीय कर, यदि कोई है, को छोड़कर अधिकतम कीमत के रूप में नियत करती है ।

नोट:
(क) ये कीमतें विनिर्दिष्ट पैक व समान प्रबलता के पैकों पर उत्पाद शुल्क और स्थानीय कर को छोड़कर अधिकतम कीमत के रूप में नियत की जाती हैं, और कम्पनी किसी छूट का दावा नहीं कर सकती, जब तक उसे छूट के लिये सरकार/रा.औ.मू.नि.प्रा. से आदेश प्राप्त न हों । (ख ) वह पैक जिसकी कम्पोजिशन समान है लेकिन आकार में अन्तर है, वह प्रो - राटा प्राइजिंग आदेश का.आ. 83 ( अ ) दिनांक 27-1-1998 के तहत आयेगी ।
( ग ) अगर कम्पनी, विभिन्न प्रकार की पैकिंग सामग्री या उसमें विशेष लक्षण का दावा करती है तो उसे राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण के पास कीमत के अनुमोदन/नियत कराने के लिये आना होगा।

New Delhi , the 9th March, 2004
S.O. 320(E) . In exercise of the powers , conferredby Sub -paragraphs ( 1 ) and (2) of paragraph 9 and paragraph 11 oftheDrugs (Prices Control) Order, 1995, read with No. S.O. 637 (E) dated the 4th September, 1997 issued by the Government ofIndia in the Ministry of Chemicals and Fertilizers , the National Pharmaceutical Pricing Authority, hereby fixes the prices as specified in column (5) of the table below as ceiling prices exclusive of excise duty and local tax, if any, of each ofthe Scheduled formulations specified in the corresponding entry in column (2) of the said Table with the strength and pack size specified respectively in the corresponding entries in columns (3 ) and (4) thereof:

Note:
(a) The prices fixed are the maximum ceiling prices ( exclusive ofexcise duty and local taxes if any) for the specified pack and packs of similar strength , and companies cannot claim exemption on any ground therefrom , unless specifically permitted by the Government/NPPA through an order.
(b) Pro-ratapricing for packs of same composition but of different sizes will be applicable vide S.O. No. 83 (E) dated 27-1-1998 .
(c) For different packing material used or any special feature claimed, companies are required to approach NPPA forapproval/fixation of specific prices.
