सा.का.नि. 179( अ ) . प्रौद्योगिकी विकास बोर्ड, प्रौद्योगिकी विकास बोर्ड अधिनियम, 1995 ( 1995 का 44 ) की धारा 15 और धारा 22 की उपधारा (2 ) के खण्ड (ग) के साथ पठित उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और प्रौद्योगिकी विकास बोर्ड ( विवरणियों का प्रस्तुतीकरण ) विनियम, 1998 को अधिक्रांत करते हुए , केन्द्रीय सरकार के पूर्वानुमोदन से निम्नलिखित विनियम बनाता है, अर्थात् : -
1. ( 1 ) इन विनियमों का संक्षिप्त नाम प्रौद्योगिकी विकास बोर्ड ( विवरणियों का प्रस्तुतीकरण ) विनियम, 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं इन विनियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षितं न हो,
(क) " अधिनियम " से प्रौद्योगिकी विकास बोर्ड अधिनियम , 1995 (1955 का 44 ) अभिप्रेत है ;
( ख) " करार " से बोर्ड द्वारा वित्तीय सहायता उपलब्ध कराने के लिए बोर्ड और किसी
i औद्योगिक समुत्थान के बीच सम्यक् रूप से निष्पादित की गई कोई संविदा अभिप्रेत है ; -

(ग) 66 बोर्ड से अधिनियम की धारा 3 का उपधारा (1 ) के अधीन गठित प्रौद्योगिकी विकास बोर्ड अभिप्रेत है ;
" (घ) " औद्योगिक समुत्थान का वही अर्थ है जो भारतीय औद्योगिक विकास बैंक अधिनियम, 1964 ( 1964 का 18 ) की धारा 2 के खण्ड (ग ) में है और इसके अन्तर्गत कोई अन्य व्यक्ति भी है जिसके पक्ष में कोई विदेशी सहयोग है जिसमें समय - समय पर भारत सरकार की औद्योगिक नीति के अनुसरण में अनुमोदित या स्वतः अनुमोदित प्रौद्योगिकी का आयात अन्तर्वलित है ।
3. विवरणियों का प्रस्तुतीकरण -
(1 ) बोर्ड से वित्तीय सहायता प्राप्त करने वाला कोई औद्योगिक समुत्थान, बोर्ड के साथ करार के चालू रहने के दौरान इन विनियमों से संलग्न अनुसूची में विनिर्दिष्ट प्ररूप में बोर्ड को विवरणियां प्रस्तुत करेगा ।
(2) वोर्ड से वित्तीय सहायता प्राप्त करने वाला प्रत्येक औद्योगिक समुत्थान, संहायता के पहले आबंटन की तारीख से प्रत्येक छह मास पर बोर्ड को विवरणी प्रस्तुत करेगा ।
(3 ) इन विनियमों के अधीन फाइल की जाने वाली प्रत्येक विवरणी, पूर्वगामी छह मास की अवधि के पूरा होने की तारीख से पैंतालीस दिन की अवधि के भीतर बोर्ड को भेजी जाएगी ।

10. (क) करार के अनुसार परियोजना पूरी होने की तारीख ( अनुपूरक द्वारा यथा संशोधित, यदि कोई हो ) ।
(ख) पूरा होने की आशयित तारीख / पूरा होने में हुए विलंब के कारण ।.
11. करार के उपबंधों के प्रतिनिर्देश से कार्य की प्रगति ( अनुपूरक करार द्वारा यथा संशोधित, यदि कोई हो ) जिसके अन्तर्गत परियोजना लागत में यथाउपदर्शित प्रत्येक शीर्ष के संबंध में लक्ष्य और शोध चार्ट भी हैं ।
12. प्रौद्योगिकी प्रदाता और औद्योगिक समुत्थान के बीच हुई अन्तिम बैठक के अभिलिखित कार्यवृत्त की एक प्रति प्रस्तुत करें ( यदि लागू हो ) ।
13. वैज्ञानिक, तकनीकी, विपणन और वित्त संबंधी कृत्यों के लिए ज्येष्ठतम कार्मिक के नाम और पदनाम दें ।
14. (क) क्या आन्तरिक अनुसंधान और विकास एकक. मान्यताप्राप्त है ?
(ख) यदि हां, तो उसके ब्यौरे दें ।
15. मात्रा और लागत सहित परियोजना के लिए उपाप्त संयंत्र और मशीनरी की एक सूची संलग्न करें । ( यह साधारण तौर पर करार के अनुसार होना चाहिए और यदि उसमें फेरफार है तो उसको स्पष्ट किया जाना चाहिए ) ।
16. यदि करार पर हस्ताक्षर के समय परिकलन से संयंत्र और / या उत्पाद प्रोफाइल की स्थापित क्षमता में कोई विचलन है ?

17. प्रौद्योगिकी विकास बोर्ड को आडमान की जाने वाली सम्पत्ति के वीमा की प्रास्थिति ।
18. कोई प्रतिधारण लेखा नहीं का अन्तिम विवरण ( लेखा संख्या और बैंकर के पत्र सहित ) ।

22. (क) क्या औद्योगिक समुत्थान प्रौद्योगिकी विकास बोर्ड की संदाय अनुसूची से आबद्ध है ?

NOTIFICATION
New Delhi , the 10th March, 2004
G.S.R. 179(E). In exercise of the powers conferred by sub - section ( 1 ) , read with clause ( c) of sub - section (2 ) , of section 22 and section 15 of the Technology Development Board Act, 1995 (44 of 1995 ) and in supersession of the Technology Development Board (submission of returns ) Regulations , 1998 , the Technology Development Board , with the previous approval of the Central Government, hereby makes the following regulations, namely: -
1. ( 1 ) These regulations may be called the Technology Development Board ( Submission ofReturns) Regulations, 2004.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Definitions . In these regulations , unless the context otherwise requires , -
(a) " Act " means the Technology Development Board Act, 1995 (44 of 1995);
(b) " agreement" means a contract duly executed between the Board and an industrial concern for providing financial assistance to such concern by the Board;
(c) "Board" means the Technology Development Board constituted under sub - section (1) of section 3 of the Act;
(d) " industrial concern " has the meaning assigned to it in clause (c) of section 2 of the Industrial Development Bank of India Act, 1964 ( 18 of 1964 ) , and includes any other person in whose favour a foreign collaboration involving the import of technology is approved or automatically approved in accordance with the industrial policy of the Government of India in force from time to time ;

3. Submission of returns.-
(1 ) An industrial concern receiving financial assistance from the Board shall, during the currency of the agreement with the Board, furnish returns to the Board in the form as specified in the Schedule annexed to these regulations.
(2) Every industrial concern receiving financial assistance from the Board shall furnish the return to the Board every six months from the date of first disbursement of assistance .
(3) Every return to be filed under these regulations shall be sent to the Board within a period forty - five days from the date of completion of the preceding six months period.
