सा.का.नि. 180( अ) .- केन्द्रीय सरकार, प्रौद्योगिकी विकास बोर्ड अधिनियम, 1995 ( 1995 का 44 ) की धारा 21 प्रदत्त शक्तियों का प्रयोग करते हुए, प्रौद्योगिकी विकास बोर्ड नियम, 1996 का संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् : -
1. ( 1 ) इन नियमों का संक्षिप्त नाम प्रौद्योगिकी विकास बोर्ड ( संशोधन ) नियम , 2004 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. प्रौद्योगिकी विकास बोर्ड नियम, 1996 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 19 में, -
(क) उपनियम (12) में ,
(i ) 66 पांच वार्षिक किस्तों में " शब्दों के स्थान पर, पांच वर्षों में " शब्द रखे जाएंगे ;
(ii) निम्नलिखित परन्तुक अन्त में अन्तः स्थापित किया जाएगा, अर्थात्ः -
परन्तु यह कि संचित व्याज, पहली किस्त के प्रतिसंदाय तक, प्रतिसंदाय के दूसरे वर्ष से समाप्त होने वाली और प्रतिसंदाय के चौथे वर्ष में होने वाली तीन वर्ष की अवधि में वितरित किया जाएगा । "
(ख) उपनियम ( 13 ) के पश्चात् निम्नलिखित उपनियम अन्तः स्थापित किया जाएगा , अर्थात्ः -

[PART II-SEC. 3 ( i) ] " (14) बोर्ड, ऋण के मूल धन के संदाय और ऐसे निवन्धनों और शर्तों पर जो औद्योगिक समुत्थान की धन जुटाने की क्षमता को ध्यान में रखते हुए बोर्ड विनिश्चित करे, उद्भूत या बकाया अतिशेष ब्याज के संदाय को पुनरीक्षित , आस्थगित या उसमें परिवर्तन कर सकेगा ।
( 15) बोर्ड, आपवादिक मामलों में, बोर्ड को शोध्य राशि के संबंध में औद्योगिक समुत्थान या किसी अभिकरण के साथ एक बार परिनिर्धारण का विनिश्चय कर सकेगा । कोई औद्योगिक समुत्थान जिसे एक बार परिनिर्धारण से लाभ हुआ है, भविष्य में बोर्ड से किसी वित्तीय सहायता के लिए पात्र नहीं होगा । "

NOTIFICATION
New Delhi , the 10th March , 2004
G.S.R. 180(E).--In exercise of the powers conferred by section 21 of the Technology Development Board Act , 1995 (44 of 1995 ) , the Central Government hereby makes the following rules to amend the Technology Development Board Rules , 1996 , namely: - 1. ( 1 ) These rules may be called the Technology Development Board ( Amendment ) Rules, 2004.
(2 ) They shall come into force on the date of their publication in the Official Gazette.
2. In the Technology Development Board Rules , 1996 ( hereinafter referred to as the said rules) , in rule 19,
(a) in sub - rule ( 12) , ( i) for the words " in five annual instalments " , the words " in five years " shall be substituted;
(ii ) the following proviso shall be inserted at the end, namely: -
"Provided that the accumulated interest up to the repayment of the first instalment may be distributed over a period of three years commencing from the second year of repayment and terminating in the fourth year of repayment . " .
(b) after sub - rule 13 , the following sub - rule shall be inserted, namely: -
"( 14) The Board may revise, postpone or vary the repayment of the principal amount of the loan and payment of interest accrued or the balance outstanding upon such terms and conditions as the Board maydecide after taking into consideration the cash generation capacity of the industrial concern .
( 15) The Board may , in exceptional cases, decide one time settlement with the industrial concern or any agency in respect of the amount due from it to the Board. Any industrial concern that has benefited from one- time settlement would be ineligible for any financial assistance from the Board in future . " .
