सा.का.नि. 188 (अ) .-केन्द्र सरकार, महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 132 की उपधारा ( 1 ) के साथ पठित धारा 124 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए मद्रास पत्तन न्यास के न्यासी मंडल द्वारा बनाए गए और इस अधिसूचना के साथ संलग्न अनुसूची में दर्शित मद्रास पोर्ट ट्रस्ट कर्मचारी ( नियुक्ति, पदोन्नति आदि ) संशोधन विनियम , 2004 का अनुमोदन करती है ।
2. ये विनियम इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से लागू होंगे ।

चेन्नैपोर्ट ट्रस्ट
मद्रास पोर्ट ट्रस्ट कर्मचारी ( नियुक्ति, पदोन्नति आदि) ( संशोधन ) विनियम, 2004
महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 वां ) की धारा 28 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए मद्रास पोर्ट ट्रस्ट बोर्ड निम्नलिखित संशोधन विनियम बनाता है ।
1. लघु शीर्ष :
ये विनियम मद्रास पोर्ट ट्रस्ट कर्मचारी ( नियुक्ति , पदोन्नति आदि ) ( संशोधन ) विनियम, 2004 के नाम से कहलाए जाएंगे ।
2. ये विनियम शासकीय राजपत्र में प्रकाशित होने की तारीख से लागू होंगे।
3. मद्रास पोर्ट ट्रस्ट कर्मचारी (नियुक्ति, पदोन्नति आदि) विनियम, 1977 में मौजूदा विनियम 5 के तहत विनियम 5 - ए के रूप में निम्नलिखित को शामिल किया जाएगा।
विनियम 5-ए
सींधी भर्ती के लिए मौजूदा कर्मचारी की पात्रता:
जब पदों को सीधी भर्ती द्वारा भरना अपेक्षित है तब ऐसे कर्मचारी जो पहले से ही सेवा में हैं, के बीच परिचालित किया जाएगा तथा आवेदकों पर विचार किया जाएगा बशर्ते कि उनके पास निर्धारित अर्हक सेवा व अनुभव हो । इनके मामलों में आयु सीमा लागू नहीं होगी ।
नोट : बशर्ते कि एक बार कर्मचारी की पुनरतैनाती करने के फलस्वरूप उत्पन्न रिक्ति को उन्मूलन करने के समान माना जाएगा ।

NOTIFICATION
NewDelhi , the 11th March, 2004
G.S.R 188 (E ) . In exercise of the powers conferred by Sub - section ( 1 ) of Section 124 , read with Sub - section ( 1 ) of Section 132 of the Major Port Trusts Act , 1963 (38 of 1963 ) , the Central Government hereby approves the Madras Port Trust Employees (Appointment, Promotion , etc.) Amendment Regulations , 2004 made by the Board of Trustees of Madras Port Trust as set out in the Schedule annexed to this Notification.
The said Regulations shall come into force from the date of publication of this Notification in the Official Gazette.

MADRAS PORT TRUST EMPLOYEES ' ( APPOINTMENT, PROMOTION ETC. ) (AMENDMENT) REGULATIONS, 2004
In exercise of the powers conferred under Section 28 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Madras Port Trust Board hereby makes the following amendment Regulations :---
1. Short Title:
These Regulations shall be called Madras Port Trust Employees ( Appointment , Promotion etc. ), ( Amendment ) Regulations , 2004 .

2. These Regulations shall come into force from the date of publication of the Regulations in the Official Gazette.
3. In the Madras Port Trust Employees ' (Appointment, Promotion, etc. ) Regulations , 1977 the following shall be included as Regulation 5 - A under the existing Regulation 5:-
Regulation 5 - A :
Eligibility of existing employees for direct recruitment :
When the posts are required to be filled by direct recruitment, the same shall be circulated amongst the employees already in service and the applicants may be considered provided they possess the prescribed qualifications and experience. Age limit in their case will not apply.
Note: Provided that once the employee is re -deployed, the resultant vacancy shall be deemed to be abolished .
