का.आ. 348(अ).- केंद्रीय सरकार ने पैट्रोलियम और खनिज पाइप लाइन (भूमि में उपयोग के अधिकार का अर्जन) अधिनियम, 1962 (1962 का 50) ( जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 3 की उप धारा ( 1 ) के अधीन जारी भारत सरकार के इस्पात मंत्रालय की अधिसूचना सं. का. आ. (अ) 1089, तारीख 10 अक्तूबर , 2002 जो भारत के राजपत्र, असाधारण भाग-2, खंड 3, उप खंड (ii) , तारीख 12 अक्तूबर , 2002 में प्रकाशित हुई थी, के द्वारा उस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में, आन्ध्र प्रदेश राज्य में मै . एस्सार स्टील लिमिटेड , विशाखापत्तनम द्वारा स्लरि के रूप में लौह अयस्क के परिवहन के लिए बैलाडिला से विशाखापत्तनम तक पाइप लाइन बिछाई जाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन करने के अपने आशय की घोषणा की थी;
और सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 6 की उपधारा ( 1 ) के अधीन केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है;
और, केन्द्रीय सरकार ने उक्त रिपोर्ट पर विचार करने के पश्चात , इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में उपयोग के अधिकार का अर्जन करने का विंनिश्चय किया है;
अतः , अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 6 की उप धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह घोषणा करती है कि स्लरि के रूप में लौह अयस्क के परिवहन के लिए इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में उपयोग के अधिकार का अर्जन किया जाए;
और केन्द्रीय सरकार, उक्त अधिनियम की धारा 6 की उपधारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह निदेश देती है कि उक्त भूमि में उपयोग का अधिकार इस घोषणा के प्रकाशन की तारीख से केन्द्रीय सरकार में निहित होने की बजाय सभी विल्लगमों से मुक्त मै. एस्सार स्टील लिमिटेड में निहित होगा ।

MINISTRY OF STEEL
NOTIFICATION
New Delhi , the 11th March, 2004
S.O. 348 (E) . Whereas by the notification of the Government of India in the Ministry of Steel , number S.O. 1089 (E) , dated the 10th October, 2002 , issued under sub -section ( 1 ) of section 3 of the Petroleum and Mineral Pipelines (Acquisition of Right of User in Land) Act , 1962 (50 of 1962) (herein after referred to as the said Act) and published in the Gazette of India Extraordinary , Part II , Section 3 , Sub-section (ii) , dated the 12th October 2002, the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for transport of iron ore in slurry from Bailadilla to Visakhapatnam in the State of Andhra Pradesh by M /s . ESSAR Steel Limited , Visakhapatnam;
And whereas , under sub- section ( 1 ) of section 6 of the said Act the Competent Authority has submitted its report to the Central Government;
And, whereas , the Central Government has , after considering the said report , decided to acquire the right of user in the lands specified in the Schedule appended to this notification ;
Now, therefore , in exercise of the power conferred by sub-section ( 1 ) of section 6 of the said Act, the Central Government hereby declares that the right ofuser in the lands specified in the Schedule appended to this notification is to beacquired for laying the pipelines for transport of iron ore in the form of slurry;
And, further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the lands specified in the Schedule below shall , instead of vesting in the Central Government, vest on the date of the publication of this notification in the Official Gazette, in the said M/s . ESSAR Steel Limited , free from all encumbrances .
