सा. का. नि. 199(अ). केन्द्रीय सरकार, सीमाशुल्क अधिनियम, 1962 (1962 का 52) की धारा 25 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह समाधान हो जाने पर कि ऐसा करना लोकहित में आवश्यक है, भारत सरकार, के वित्त मंत्रालय (राजस्व विभाग ) , की अधिसूचना सं. 39/96- सीमाशुल्क, तारीख 23जुलाई, 1996 का निम्नलिखित और संशोधन करती है, अर्थातः-
उक्त अधिसूचना में, सारणी के कम सं० 25 के पश्चात निम्नलिखित क्रम संख्यांक और प्रविष्टियां अंजः स्थापित की जायेंगी, अर्थातः-

" 26 रक्षा मंत्रालय के धनुष यदि,
कार्यक्रम के प्रयोजनों
के लिए अपेक्षित
मशीनरी, उपस्कर,
उपकरण, संघटक,
(क) उक्त माल का आयात धनुष कार्यक्रम के कर्मशाला केन्द्र, सरकारी अभिकरण या पब्लिक सेक्टर उपक्रम द्वारा , जो किसी ऐसे अधिकारी द्वारा , जो भारत सरकार के रक्षा मंत्रालय में उप सचिव की पंक्ति से नीचे का न हो, अभिहित किए जाए, किया जाता है ; और
अतिरिक्त पुर्जे, जिंग,
फिक्सचर, डाई,
(ख) ऐसे आयातकर्ता, प्रत्येक मामले में, आयात के समय , उक्त माल के सुसंगत वर्णन सहित एक सूची,-
औजार, उपसाधन,
कंप्यूटर साफटवेयर,
कच्ची सामग्री और
खपने वाली सामग्री ।
( 1 ) जो कार्यक्रम सदस्य सचिव , प्रोग्राम प्रबंधन बोर्ड (एकीकृत मिसाइल विकास कार्यक्रम ) द्वारा सम्यक रूप से इस आशय के बारे में प्रमाणित हो कि उक्त माल धनुष कार्यक्रम के लिए अपेक्षित है, उनका उपयोग केवल धनुष कार्यक्रम के लिए किया जाएगा और भारत में विनिर्माण नहीं किया गया है । और

(2) जो किसी ऐसे अधिकारी द्वारा भी, जो भारत सरकार के रक्षा मंत्रालय में अवर सचिव की पंक्ति से नीचे का न हो इस आशय के बारे में सम्यक रूप से प्रमाणित हो कि उक्त सूची में उल्लिखित उक्त माल के आयात धनुष कार्यक्रम के अधीन और उसके प्रयोजनों के लिए रक्षा मंत्रालय द्वारा प्राधिकृत है, यथास्थिति, उप सीमाशुल्क आयुक्त या सहायक सीमाशुल्क आयुक्त को प्रस्तुत करते हैं । "

NOTIFICATION
New Delhi , the 18th March , 2004 No. 48/2004- CUSTOMS
G.S.R. 199 (E) . In exercise of the powers conferred by sub - section ( 1 ) of section 25 of the Customs Act, 1962 ( 52 of 1962 ) , the Central Government, being satisfied that it is necessary in the public interest so to do , hereby makes the following further amendment in the notification of the Government of India in the Ministry of Finance (Department of Revenue) , No. 39 /96-Customs , dated the 23rd July, 1996, namely: -
In the said notification , in the Table , after S. No. 25 and the entrics relating thereto, the following S. No. and entries shall be added, namely: -

If, -
"26 . Machinery, equipment ,
the (a) the said goods are imported by work centres of DHANUSH Programme , Governinent agencies or public sector undertakings , as the case may be, designated by an officer not below the rank of a Deputy Secretary to the Government of India in the Ministry of Defence ; and
instruments , components, spares , jigs and fixtures, dies , tools , accessories , computer software , raw materials and consumables required for the purpose ofDHANUSH
(b) such importers produce to the Deputy Commissioner of Customs or the Assistant Commissioner of Customs , as the case may be , at the time of import , in each case , a list of the said goods with their relevant description, -
Programme of the Ministry of Defence .
(1) duly certified by the Member Secretary, Programme Management Board ( Integrated Guided Missile Development Programme) to the effect that the said goods are required for the DHANUSH Programme , shall be used only for the DHANUSH programme and that they are not manufactured in India; and भारत का राजपत्र असाधारण

(2) duly certified also by an officer not below the rank of an Under Secretary to the Government of India in the Ministry of Defence to the effect that the import of the said goods mentioned in the said list is authorized by the Ministry of Defence under and for the purposes of the DHANUSH Programme." .

Note :-The principal notification No.39 / 96 - Customs dated the 23rd July , 1996 was published in the Gazette of India, Extraordinary , vide G.S.R. 291 (E) , dated the 23rd July, 1996 and was last amended by notification No.41/2004-Customs , dated the 27th February, 2004 [G.S.R. 150 (E) , dated the 27th February , 2004].
