रा० वि० एकक सा. का. नि. 200(अ). केन्द्रीय मोटर यान नियम , 1989 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप मोटर यान अधिनियम, 1988 ( 1988. का 59 ) की धारा 212 की उपधारा 1 की अपेक्षानुसार भारत के राजपत्र, असाधारण , भाग II , खंड 3 , उपखंड ( i ) तारीख 29 दिसम्बर, 2003 में, भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्यांक सा.का. नि. 971 ( अ ) तारीख 29 दिसम्बर, 2003 के अधीन प्रकाशित किया गया था जिसमें उन सभी व्यक्तियों से जिनके उससे प्रभावित होने की संभावना थी, उस तारीख से जिसको भारत के उस राजपत्र की प्रतियाँ जिसमें उक्त अधिसूचना प्रकाशित की गई थी, जनता को उपलब्ध करा दी गई थीं तीस दिन की अवधि के भीतर आक्षेप या सुझाव मांगे गए थे;
और भारत के उक्त राजपत्र की प्रतियाँ जनता को 31 दिसम्बर, 2003 को उपलब्ध करा दी गई थीं;
और उक्त प्रारूप नियमों की बाबत जनता से प्राप्त सुझावों पर केन्द्रीय सरकार द्वारा सम्यक् रूप से विचार कर लिया गया है ;
अतः , अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय मोटर यान नियम , 1989 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्: -
1. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मोटर यान ( दूसरा संशोधन ) नियम, 2004 है ।
(2) ये 1 जून, 2004 से प्रवृत्त होंगे ।
2. केन्द्रीय मोटर यान नियम , 1989 के नियम 115 में उपनियम ( 13 ) के पश्चात् निम्नलिखित परन्तुक अंतःस्थापित किए जाएंगे, अर्थात्: - " परन्तु यह कि उपनियम ( 11 ) के उपबन्ध, शोलापुर और लखनऊ में रजिस्ट्रीकृत होने वाले चार पहिया यानों की बाबत शोलापुर और लखनऊ में, 1 जून, 2004 से प्रवृत्त होंगे ।
परन्तु यह और कि उपरोक्त उपबन्ध शोलापुर से महाराष्ट्र राज्य के अन्य भागों में या लखनऊ से उत्तर प्रदेश के अन्य भागों में, या उक्त शहरों कीक्षेत्रीय अधिकारिता के भीतर अन्तर - राज्यीय या राष्ट्रीय अनुज्ञप्ति या अखिल भारतीय पर्यटक अनुज्ञप्ति पर चलने वाले चार पहियों वाले परिवहन यानों की बाबत लागू नहीं होंगे । "

NOTIFICATION
New Delhi , the 18th March , 2004
G.S.R. 200 ( E) .-Whereas the draft of certain rules further to amend the Central Motor Vehicles Rules , 1989 , were published as required by Sub - section ( 1 ) of Section 212 of the Motor Vehicles Act , 1988 ( 59 of 1988 ) in the Gazette of India, Extraordinary , Part II , Section 3 , Sub - section ( i) , dated the 29th December, 2003 in the notification of Govemment of India in the Ministry of Road Transport and Highways, number G.S.R. 971 (E ) , dated the 29th December , 2003 , inviting objections or suggestions from all persons likely to be affected thereby within a period of thirty days from the date on which copies of the Gazette of India, in which the said notification was published , were made available to the public ;
And whereas the copies of the said Gazette of India were made available to the public on the 31st December , 2003 ;
And whereas the suggestions received from the public in respect of the said draft rules have been duły considered by the Central Government;
Now, therefore, in exercise of the powers conferred by Section 110 of the said Act, the Central Govern- ment hereby makes the following rules further to amend the Central Motor Vehicles Rules , 1989 , namely :
1. ( 1 ) These rules may be called the Central Motor Vehicles ( Second Amendment) Rules , 2004.
(2) They shall come into force from 1st June , 2004 .
2. In the Central Motor Vehicles Rules , 1989 in rule 115 , after sub - rule ( 13 ) , the following proviso shall be inserted, namely
"Provided that provisions of sub - rule ( 11) shall , in respect of four - wheeled vehicles to be registered in Sholapur and Lucknow, come into force in Sholapur and Lucknow from the 1st June , 2004 .
Provided further that the above said provision shall not apply in respect of four- wheeled transport vehicles plying from Sholapur to other parts of the State of Maharashtra or from Lucknow to the other parts of the State of Uttar Pradesh ; or on inter- State or National Permit or on the All India Tourist Permit, within the territorial jurisdiction of the said cities . "

Note . The principal rules were notified vide GSR 590 (E) , dated 2nd June , 1989 and last amended vide GSR 111 (E) , dated 10th February, 2004 .
