सा.का.नि. 203 (अ)/आवश्यक वस्तु/ गन्ना.-माननीय पटना उच्च न्यायालय ने 2004 की एम.जे.सी. सं. 75 में तारीख 16 मार्च , 2004 के अपने आदेश में केन्द्रीग सरकार को यह निदेश दिया है कि गन्ना गरिवहन रिवेट की बाबत अधिसूचनाएं जारी की जाएं,
अतः , अब, केन्द्रीय सरकार, आवश्यक वस्तु अधिनियम, 1955 ( 1955 का 10 ) की धारा 3 के अधीन किए गए गन्ना ( नियंत्रण ) आदेश, 1966 के खण्ड 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, आदेश संख्या सा.का.नि. 44( अ)/आवश्यक वस्तु/ गन्ना, तारीख 14 जनवरी , 2004 ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) का और संशोधन करने के लिए निम्नलिखित आदेश करती है, अर्थात्: -
उक्त आदेश में, प्रारम्भिक पैरा में, " उक्त आदेश के खण्ड उक के अधीन उसके लिए संदेय रिबेट के अधीन रहते हुए किया जाएगा " शब्दों, अंक और अक्षर के पश्चात् निम्नलिखित परन्तुक अन्तःस्थापित किए जाएगा , अर्थात्: -
" परन्तु उत्तर प्रदेश, उत्तरांचल, बिहार और हरियाणा राज्यों में ऐसे किसी क्रय केन्द्र पर जो रेल या सड़क द्वारा जुड़ा हुआ है, क्रय के लिए परिदत्त गन्ने के लिए 29 पैसे प्रति क्विटल प्रति किलोमीटर की दर से परिवहन रिबेट का संदाय अधिकतम 5.83 रुपए प्रति क्विटल के अधीन रहते हुए किया जाएगा;
परन्तु यह और कि कानूनी न्यूनतम कीमत में से पूर्वोक्त परिवहन रिबेट केवल उन चीनी मिलों को ही अनुज्ञात की जाएगी जो समय पर गन्ने की कीमत का संदाय करते हैं और गन्ने के शोध्य संदाय के सभी बकायों का गन्ना ( नियंत्रण ) आदेश, 1966 के खण्ड 3 के अनुसार शोध्य ब्याज के साथ भुगतान कर देते हैं । "

ORDER
NewDelhi , the 22nd March , 2004
G.S.R. 203(E)/Ess . Com./Sugarcane. Whereas the Hon'ble High Court of Judicature at Patna in its Order dated the 16th March, 2004 in M.J. C. No. 75 of 2004 directed the Central Government to ensure issuance of notifications with respect to sugarcane transport rebate:
Now, therefore, in exercise of the powers conferred by clause 3 of the Sugarcane ( Control ) Order, 1966 made under Section 3 of the Essential Commodities Act, 1955 ( 10 of 1955 ), the Central Government hereby makes the following Order further to amend Order Number G.S.R. 44 (E) /Ess.Com./Sugarcane dated the 14th January, 2004 (hereinafter referred to as the said Order ) , namely:-
In the said Order , in the opening paragraph, after the words , figure and letter " subject to the rebates payable therefor under clause 3A of the said Order" , the following provisos shall be inserted, namely:--
"Provided that in the States of Uttar Pradesh, Uttaranchal , Bihar and Haryana for sugarcane delivered for purchase at any purchasing centre connected by rail or road, payment of transport rebate at the rate of 29 paise per quintal per kilometre shall be made subject to a maximum ofRs . 5.83 per quintal ;
Provided further that the aforesaid transport rebate from Statutory Minimum Price shall be allowed only to those sugar mills which make cane price payment timely and clear all arrears of cane payment dues , together with due interest as per clause 3 of the Sugarcane ( Control ) Order, 1966 " .
