( 2 ) के बैंक(एके द्वारा प्रदत्त सा.का.नि. 206(अ). केन्द्रीय सरकार, विद्युत अधिनियम, 2003 ( 2003 का 36 ) की धारा 176 कीउप - धारा ( 2 ) के शक्तियों का प्रयोग करते हुए, धारा 15 की उप - धारा ( 1 ) के अधीन अनुज्ञप्ति प्रदान करने हेतु आवेदन के लिए फीस के संदाय के बारे में निम्नलिखित नियम बनाती है , अर्थात्: -
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम अनुज्ञप्ति प्रदान करने हेतु आवेदन के लिए फीस नियम , 2004 है । (2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं. इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-
(क) " अधिनियम " से विद्युत अधिनियम, 2003 अभिप्रेतहै ;
(ख) " धारा " से अधिनियम की धारा अभिप्रेत है; और
( ग) उन पदोंके, जो इसमें प्रयुक्त हैं और परिभाषित नहीं हैं , किन्तु विद्युत अधिनियम, 2003 ( 2003 का 36 ) में परिभाषित हैं, क्रमशः वही अर्थ होंगे जो उनके उस अधिनियम में हैं ।
3. अनुज्ञप्ति प्रदान करने हेतु आवेदन करने के लिए फीस ( 1 ) केन्द्रीय विद्युत विनियामक आयोग द्वारा अनुज्ञप्ति प्रदान करने के लिए धारा 14 के अधीन प्रत्येक आवेदन के साथ केवल एक लाख रुपए फीस होगी ।
(2) फीस सहायक सचिव , केन्द्रीय विद्युत विनियामक आयोग के पक्ष में मांग देय ड्राफ्ट के माध्यम से भेजी जाएगी ।

G.S.R. 206 (E ) .- In exercise of the powers conferred by clause (c) of sub - section (2) ofSection 176 of the Electricity Act, 2003 (36 of 2003 ) , the Central Government hereby makes the following rules regarding payment offees for application forgrant of licence under sub -section ( 1) of Section 15, namely :-

[PART II-SEC. 3 (1) ] .
1. Short title and commencement.--~~( 1 ) These rules may be called the Fees for Making Application for Grant of Licence Rules , 2004.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.-( 1 ) In these rules unless the context otherwise requires,-
(a) " Act" means the Electricity Act, 2003 ;
(b ) " section " means a section of the Act; and
(c) expression used and not defined in these rules but defined in the Electricity Act , 2003 (36 of 2003 ), shall have the meanings respectively assigned to them in that Act .
3. Fees for making application for grant of licence. ~~( 1 ) Every application under Section 14 for grant oflicence bythe Central Electricity Regulatory Commission, shall be accompanied by a fee of rupees one lakh only .
(2) The fee shall be remitted through demand draft in favour of the Assistant Secretary , Central Electricity Regulatory Commission .
