विधान सभा निर्वाचन क्षेत्रों के लिए नामावलियाँ 12 मार्च, 2004 को अन्तिम रूप से प्रकाशित की गई थीं; और
आदेश

विषयः-अरुणाचल प्रदेश से लोकसभा के लिए साधारण निर्वाचन-निर्वाचक नामावलियों का पुनरीक्षण
5. यतः , उपर्युक्त पैरा 4 में उल्लिखित, अरुणाचल प्रदेश राज्य में चार विधान सभा निर्वाचन क्षेत्रों को छोड़कर, सभी अहंता को तसिख 1-1-2004 को मानकर विधान सभा निर्वाचन क्षेत्रों की निर्वाचक नामावलियाँ संक्षिप्त पुनरीक्षण के बाद 1 मार्च, 2004 को प्रकाशित की गई थीं; और
आ. अ. 35(अ).-यतः निर्वाचन आयोग ने नई लोक सभा के गठन के लिए अरुणाचल प्रदेश राज्य को सम्मिलित करते हुए लोकसभा के लिए साधारण निर्वाचन का कार्यक्रम घोषित कर दिया है ; और
6. यतः , लोक प्रतिनिधित्व अधिनियम, 1950 की धारा 13 ष के अनुसार, अरुणाचल प्रदेश राज्य में, संसदीय निर्वाचन क्षेत्रों के लिए निर्वाचक नामावलियों में, ऐसे संसदीय निर्वाचन क्षेत्रों के अन्तर्गत सम्मिलित सभी विधान सभा निर्वाचन क्षेत्रों की निर्वाचक नामावलियाँ होती हैं; और 2. यतः , लोक प्रतिनिधित्व अधिनियम, 1950 की धारा 21 ( 2) (क) ( i ) के अनुसार, निर्वाचक नामावलियाँ, लोकसभा के लिए प्रत्येक साधारण निर्वाचन से पहले अर्हता की तारीख के संदर्भ में, निर्धारित रीतिसे तब तक संशोधित नहीं की जाएंगी , जब तक लिखित में रिकार्ड किए गए कारणों, से निर्वाचन आयोग द्वारा निदेश नहीं दिया जाता ; और
7. यतः , लोक प्रतिनिधित्व अधिनियम, 1950 की धारा 21 ( 2 ) के परन्तुक के अनुसार, यदि किसी भी निर्वाचन क्षेत्र की निर्वाचक नामावली पुनरीक्षित नहीं की गई है , तो उक्त निर्वाचक नामावली की वैधता अथवा उस पर चल रहे कार्य इसके द्वारा प्रभावी नहीं होंगे; और 3. यतः , लोक प्रतिनिधित्व अधिनियम, 1950 की धारा 14 (ख) के अनुसार निर्वाचक नामावलियों की तैयारी और पुनरीक्षण के सम्बन्ध में, इस प्रकार तैयार अथवा पुनरीक्षित नामावलियों की अर्हता की तारीख से तात्पर्य उस वर्ष की जनवरी का पहला दिन है;
8. यतः , सम्बंधित संसदीय निर्वाचन क्षेत्रों से लोक सभा के लिए साधारण निर्वाचन कराने के लिए उपर्युक्त चार विधान सभा निर्वाचन क्षेत्रों अर्थात् 14 - डोइमुख ( अ.ज.जा. ) , 46- चौरवाम ( अ.ज.जा. ) , 49-बोरडुमसा दियुम और 50 - मियाओ ( अ.ज.जा. ) की निर्वाचक नामावलियाँ के पुनरीक्षण का काम 1-1-2004 को अर्हता की तारीख के रूप में शुरू करना तथा उसे समय पर पूरा करना संभव नहीं है;
१. अतः , अब उपर्युक्त कारणों से निर्वाचन आयोग, लोक प्रतिनिधित्व अधिनियम, 1950 की धारा 21 ( 2 ) ( क) ( i ) के अधीन एतद्द्वारा निदेश देता है कि 1 - अरुणाचल पश्चिम संसदीय निर्वाचन क्षेत्र से लोक सभा के लिए साधारण निर्वाचन 14-डोइमुख (अ.ज.जा. ) विधान सभा खण्ड आता है , और 2-अरुणाचल पूर्व संसदीय निर्वाचन क्षेत्र के अन्तर्गत 46 - चौरवाम ( अ.ज.जा. ) , 49- बोरडुमसा दियुम और 4. यतः , आयोग ने दिनांक 16-10-2003 के पत्र संख्या 23/सं./2003-यो.- II के द्वारा सभी विधान सभा निर्वाचन क्षेत्रों में अर्हता की तारीख के रूप में 1-1-2004 के सन्दर्भ में अरुणाचल प्रदेश राज्य में निर्वाचक नामावलियों के संक्षिप्त पुनरीक्षण का आदेश दिया है , सिवाय 14 - डोइमुख ( अ.ज.जा. ) , 46- चौरवाम (अ.ज.जा. ) , 49 - बोरडुमसा दियुम और 50- मियाओ ( अ.ज.जा. ) , विधान सभा क्षेत्रों के जहाँ कुछ प्रशासनिक कठिनाइयों के कारण 1-1-2003 को अर्हता की तारीख मानकर निर्वाचक नामावलियाँ उस समय अन्तिम रूप से प्रकाशित नहीं हो पाई थीं और उक्त चार 992GI/2004 2

been finally published at that time because of some administrative problems and the rolls for the said four Assembly Constituencies were finally published on 12th March, 2004; and
50-मियाओ (अ.ज.जा. ) के लिए 1-1-2003 को अर्हता की तारीख मानकर पुनरीक्षित की गई विद्यमान निर्वाचक नामावलियों के आधार पर साधारण निर्वाचन किया जाएगा; उक्त संसदीय निर्वाचन क्षेत्रों के अन्य सभी विधान सभा खण्डों के बारे में 1-1-2004 को अर्हता की तारीख मानकर संशोधित निर्वाचक नामावलियाँ उक्त संसदीय निर्वाचन क्षेत्रों से निर्वाचनों के लिए प्रयुक्त की जाएंगी ।

5.Whereas the final electoral rolls of all the Assembly Constituencies excepting the four Assembly Constituencies toreferred to in para 4 above in the State ofArunachal Pradesh w.r.t. 1-1-2004 as qualifying date, after the summary revision, were published or 1st March, 2004; and आदेश से और भारत निर्वाचन आयोग के नाम पर,

6. Whereas , according to Section 13D of the Representation ofthe People Act, 1950, the electoral rolls for the Parliamentary Constituencies in the State of Arunachal Pradesh consist of the electoral rolls for all the Assembly Constituencies comprised within such Parliamentary Constituencies ; and

7.Whereas, according to the proviso to Section. 2.1 (2) oftheRepresentation of the People Act, 1950, ifthe electoral roll of any constituency is not revised, the validity or continued operation of the said electoral roll shall not thereby be affected; and
Subject : General Elections to the House of thePeople Revision of from Arunachal Pradesh electoral roll .
Ο.Ν. 35(E). Whereas the Election Commission has announced the programme of general election to the House ofthe People including from the State of Arunachal Pradesh to constitute a new House ; and
8. Whereas , it is not possible to undertake and complete the revision of the electoral rolls of above mentioned fourAssembly Constituencies viz . , 14-Doimukh (ST) , 46-Chiowkham (ST) , 49-Bordumsa Diyum and 50-Miao (ST) w.r.t. 1-1-2004 as qualifying date in time for the conduct of the general election to the House of the People from the Parliamentary Constituencies concerned;
2. Whereas , according to Section 21 ( 2 ) ( a) (i ) of the Representation of the People Act , 1950, the electoral rolls , unless otherwise directed by the Election Commission for the reasons to be recorded in writing be revised in the prescribed manner by reference to the qualifying datebefore each general election to the House of the People ; and
3. Whereas the qualifying date in relation to the preparation and revision of the electoral roll means the 1st day of January of the year in which it is so prepared or revised as per Section 14 (b) of the Representation of the People Act, 1950; and
9.Now, therefore , the Election Commission, for the aforesaid reasons , hereby directs under Section 21 (2) ( a) (i) of the Representation of the People Act , 1950 that the general election to the House of the People from 1-Arunachal West Parliamentary Constituency, in so far as it relates to 14-Doimukh ( ST) Assembly Segment and from 2-Arunachal East Parliamentary Constituency, in do far as it relates to 46-Chiowkham (ST) , 49-Bordumsa Diyum and 50-Miao ( ST) Assembly Segments shall be conducted on the basis of the existing electoral rolls revised w.r.t. 1-1-2003 as the qualifying date . In respect of all the other Assembly Segments of the said Parliamentary Constituencies, the electoral rolls as revised w.r.t. 1-1-2004 qualifying date shall be used for the elections from the said Parliamentary Constituencies .

Whereas the Commission had ordered, vide letter No. 23 /Summary/2003 -PLN-II dated 16-10-2003 a summary revision of the electoral rolls in the State of Arunachal Pradesh with reference to 1-1-2004 as qualifying date in all the Assembly Constituencies except the Constituencies of14-Doimukh (ST), 46-Chiowkham (ST) , 49-Bordumsa Diyum and 50- Miao (ST) Assembly Constituencies, where the electoral rolls w.r.t. 1-1-2003 as qualifying date had not
