1 सं. टीएएमपी/73/2003 सीएचपीटी. महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 48 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, महापत्तन प्रशुल्क प्राधिकरण एतद्वारा दिनांक 27 नवम्बर, 2003 के अपने पूर्व आदेश द्वारा अनुमोदित चेन्नई कंटेनर टर्मिनल लिमिटेड के अन्तरिम दरमान की वैधता का, संलग्न आदेशानुसार, विस्तार करता है ।

यह प्रकरण भारत सरकार द्वारा महापत्तन न्यास अधिनियम , 1963 की धारा 111 के अधीन जारी किए गए नीति निदेश के अनुपालन में चेन्नई कंटेनर टर्मिनल लिमिटेड (सीसीटीएल) के मामले में इस प्राधिकरण द्वारा 27 नवम्बर , 2003 को पारित आदेश द्वारा निर्धारित अंतरिम दरमान की वैधता का विस्तार करने से संबंधित है ।
2. इस प्राधिकरण के दिनांक 27 नवम्बर , 2003 के आदेश द्वारा निर्धारित अंतरिम दरमान , जोकि भारत सरकार के नीति निदेश के अनुपालन में पारित किया गया था , शुरू में 31 जनवरी , 2004 तक अथवा अंतिम आदेश पारित होने तक , जो भी पहले हो , वैध था । 3. अपने प्रशुल्क की विस्तृत समीक्षा के लिए सीसीटीएल द्वारा दाखिल प्रस्ताव परामर्शी प्रक्रिया पर लिया गया है. और इस प्राधिकरण के दिनांक 27 नवम्बर , 2003 द्वारा अनुमोदित अंतरिम दरमान की वैधता का 31 जनवरी , 2004 से 31 मार्च , 2004 तक अथवा संशोधित दरमान के लागू होने की प्रभावी तारीख तक , जो भी पहले हो , विस्तार किया गया था ।
4. संदर्भित प्रकरण की संयुक्त सुनवाई 20 फरवरी , 2004 को आयोजित की गई थी । संयुक्त सुनवाई में लिए गए निर्णयानुसार , सीसीटीएल को लागत की कुछ मदों पर अतिरिक्त सूचना प्रस्तुत करने के लिए कहा गया था । चेन्नई पत्तन न्यास (सीएचपीटी) द्वारा चेन्नई के अन्दर और आसपास विभिन्न कंटेनर फ्रेट स्टेशनों में प्रभार्य दरों के ब्योरे भी प्रस्तुत किए जाने हैं । प्रस्ताव के लागत पहलू पर सीसीटीएल का पक्ष एक बार दोबारा सुना जाएगा।

5. इस प्रकरण में लंबित आगामी कार्रवाइयों के मद्देनज़र , सीसीटीएल के प्रस्ताव के निपटान में कुछ और समय लगने की संभावना है । इसलिए , इस प्राधिकरण के दिनांक 27 नवम्बर , 2003 के आदेश द्वारा अनुमोदित अंतरिम दरमान की वैधता का विस्तार करना आवश्यक है । 6. परिणामस्वरूप , और उपर्युक्त कारणों से, यह प्राधिकरण अपने दिनांक 27 नवम्बर , 2003 के आदेश द्वारा अनुमोदित सीसीटीएल के अंतरिम दरमान की वैधता का 31 मई , 2004 तक अथवा संशोधित दरमान के लागू होने की प्रभावी तारीख तक, जो भी पहले हो , विस्तार करता है।

Mumbai , the 22nd March, 2004
No. TAMP/ 73/2003 - CHPT. In exercise of the powers conferredby Section 48 of the Major Port Trusts Act, 1963 (38 of1963), the Tariff Authority for Major Ports hereby extends the validity of the interim Scale of Rates of Chennai Container Terminal Limited approved vide the earlier Order dated 27 November, 2003 as in the Order appended hereto.

(Passed on this 15th day of March 2004)
This case relates to extension of the validity of the interim Scale of Rates prescribed vide the Order passed by this Authority on 27 November 2003 in the case of the Chennai Container Terminal Limited ( CCTL) in compliance of the policy direction issued by the Government of India under Section 111 of the Major Port Trusts Act , 1963 .
2. The interim Scale of Rates prescribed vide this Authority's Order dated 27 November 2003 , which was passed in compliance with the policy direction issued by the Government of India , was initially valid till 31 January 2004 or till final Order is passed whichever is earlier .
3. The proposal filed by the CCTL on comprehensive review of its tariff has been taken on consultation process and the validity of the interim Scale of Rates approved vide the Order of this Authority dated 27 November 2003 was extended from 31 January 2004 to 31 March 2004 or effective date ofimplementation of revised Scale of Rates whichever is earlier.
4. A joint hearing in the case in reference has been held on 20 February 2004. As decided at the joint hearing , the CCTL is required to furnish additional information on certain items of cost. The details of rates levied at different Container Freight Station in and around Chennai are also to be furnished by the Chennai Port Trust (CHPT). The CCTL will be heard once again on costing aspect of the proposal .

3 5. inview of the further actions pending in this case , disposal of the proposal of the CCTL is likely to take some more time . It is , therefore, necessary to extend the validity of the interim Scale of Rates approved vide the Order of this Authority dated 27 November 2003 .
6. In the result , and for the reasons given above , this Authority extends the validity of interim Scale of Rates of the CCTL approved vide its Order dated 27 November 2003 till 31 May 2004 or effective date of implementation of the revised Scale of Rates , whichever is earlier .
