सा.का.नि. 220(अ) .- केन्द्रीय सरकार, भारतीय तार अधिनियम, 1885 ( 1885 का 13 ) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय तार नियम, 1951 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्: -
1. (1 ) इन नियमों का संक्षिप्त नाम भारतीय तार ( संशोधन ) नियम, 2004 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. भारतीय 'तार नियम , 1951 में, नियम 522 के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्:-

523. परिभाषाएं. इस भाग में-
(क) " प्रशासक" से, केन्द्रीय सरकार द्वारा निधि के प्रशासन के लिए नियुक्त निधि का प्रशासक अभिप्रेत है;
(ख) " करार " से, प्रशासक और सार्वभौमिक सेवा बाध्यता के कार्यान्वयन के प्रयोजन के लिए एक और उससे अधिक सार्वभौमिक सेवा प्रदाता के बीच किया गया कोई करार अभिप्रेत है;

[PART II-SEC. 3 (1)] (ग) "पूंजी लागत " से, प्रशासक द्वारा यथा अवधारित पहुंच की व्यवस्था करने पर उपगत पूंजी व्यय अभिप्रेत है ;
(घ) "पूंजी वसूली " से, सात वर्ष से अधिक की अवधि में मूल्यह्रास, ऋण पर ब्याज और वार्षिक रूप से परिकलित पूंजी लागत पर इक्विटी के संबंध में विवरणी अभिप्रेत है ;
(ङ) "निधि" से, भारतीय तार अधिनियम , 1885 (1885 का 13) की धारा 9- क की उपधारा (1 ) के अधीन स्थापित सार्वभौमिक सेवा बाध्यता निधि अभिप्रेत है ;
(च) "उच्च गति सार्वजनिक दूरसंचार और सूचना केंद्र " से, ऐसा केंद्र अभिप्रेत है, जो जनता के उपयोग के लिए 128 केबीपीएस की न्यूनतम डाटा गति पर दूर- शिक्षण तथा दूर चिकित्सा सहित अतिरिक्त सुविधाओं की प्रस्थापना करता है ;
(छ) "बहु पहुंच रेडियो रिले प्रौद्योगिकी " से, ऐसी प्रौद्योगिकी अभिप्रेत है जिसका उपयोग टेलिफोन सेवाएं प्रदान करने के लिए किया जाता है;
(ज) " सार्वजनिक दूरसंचार और सूचना केंद्र " से, ऐसा केंद्र अभिप्रेत है, जो जनता के उपयोग के लिए वॉइस टेलीफोनी के अतिरिक्त, फैक्स , ई- मेल , इंटरनेट सहित डाटा उपयोजन की प्रस्थापना करता है ;
(झ) "शुद्ध लागत " से प्रचालन व्यय धन पूंजीगत वसूली ऋण राजस्व अभिप्रेत है ;
स्पष्टीकरण- जहां प्रचालन और अनुरक्षण के लिए ही सहायता दी जानी है, वहां शुद्ध लागत से. प्रचालन व्यय ऋण राजस्व अभिप्रेत होगा ;
(ञ) "प्रचालन व्यय " से, प्रशासक द्वारा जो यथा अवधारित विनिर्दिष्ट सुविधाओं के प्रचालन और अनुरक्षण पर होने वाली वार्षिक प्रचालन लागत अभिप्रेत है ;
(ट) "राजस्व" से वार्षिक प्रभार अभिप्रेत हैं जिसके अंतर्गत विनिर्दिष्ट सेवा से प्राप्त उपयोग प्रभार और लागू किराया भी है, किन्तु इसमें सरकार को विनिर्दिष्ट सेवा के संबंध में, यदि कोई हो , किसी कर के संदाय के सिवाय किसी प्रकार की कटौती नहीं है । 3

(ठ) "गौण स्विचन क्षेत्र " से वह क्षेत्र अभिप्रेत है जिसमें दूरसंचार प्राधिकरण द्वारा देश को बांटा गया है तथा यह लंबी दूरी प्रभारण क्षेत्र का सहविस्तारी है ।
(ड) "सार्वभौमिक सेवा बाध्यता " से ग्रामीण और दूरस्थ इलाकों में लोगों को वहनीय और उचित दामों में बुनियादी दूरसंचार सेवाएं मुहैया कराने संबंधी दायित्व अभिप्रेत है ।
(ढ) "सार्वभौमिक सेवा प्रदाता " से ऐसा व्यक्ति अभिप्रेत है जिसने सार्वभौमिक सेवा बाध्यता के कार्यान्वयन के लिए प्रशासक के साथ करार किया है ।
(ण) "ग्रामीण सार्वजनिक टेलीफोन" से, किसी गांव में संस्थापित प्रथम सार्वजनिक टेलीफोन अभिप्रेत है ।
524. सार्वभौमिक सेवा बाध्यता निधि का प्रशासन प्रशासक को निम्नलिखित शक्तियां होंगीः- (i) सार्वभौमिक सेवा बाध्यता के कार्यान्वयन के प्रयोजनों के लिए उसकी निबंधन और शर्तों सहित, बोली लगाने की प्रक्रिया तैयार करना ;
(ii) सार्वभौमिक सेवा बाध्यता के कार्यान्वयन के प्रयोजनों के लिए आमंत्रित बोलियों का मूल्यांकन करना ;
(iii) सार्वभौमिक सेवा बाध्यता के कार्यान्वयन के प्रयोजनों के लिए सार्वभौमिक सेवा प्रदाता के साथ करार करना;
(iv) सम्यक सत्यापन के पश्चात् सार्वभौमिक सेवा प्रदाता के दावे को निपटाना और तदनुसार निधि से संवितरण करना;
(v) सुसंगत उपविधान, प्रक्रिया और अभिलेख विनिर्दिष्ट करना, जिन्हें सार्वभौमिक सेवा प्रदाता द्वारा अनुरक्षित व प्रस्तुत किया जाना है;
(vi) समय समय पर उसके द्वारा विनिर्दिष्ट प्रक्रिया के अनुसार, सार्वभौमिक सेवा प्रदाता के कार्य निष्पादन को मानीटर करना । 4

[PART II -SEC . 3 (1) ] 525. सार्वभौमिक सेवा बाध्यता निधि से समर्थन का विस्तार ( 1 ) प्रशासक द्वारा समय समय पर विनिर्दिष्ट सार्वभौमिक सेवा बाध्यता प्रदान करने संबंधी शुद्ध लागत की पूर्ति के लिए निधि से वित्तीय समर्थन प्रदान किया जाएगा और वह अवधि जिसके लिए उक्त समर्थन प्रदान किया जाएगा तथा उसमें सम्मिलित सेवाओं को सार्वभौमिक सेवा प्रदाता के साथ किए गए किसी करार द्वारा शासित किया जाएगा ।
(2) निधि द्वारा निम्नलिखित सेवाओं को समर्थन दिया जाएगा, अर्थातृ : -
( i) स्ट्रीम 1 : सार्वजनिक दूरसंचार और आसूचना सेवाओं का उपबंध करना-
(क) 1991 की जनगणना के अनुसार पहचाने गए राजस्व गांवों में ग्रामीण सार्वजनिक टेलीफोन का प्रचालन और अनुरक्षण तथा 2001 की जनगणना के अनुसार पहचाने गए अतिरिक्त राजस्व गांवों में ग्रामीण सार्वजनिक टेलिफोन का संस्थापन:- 1991 की जनगणना के अनुसार पहचाने गए राजस्व गांवों में ग्रामीण सार्वजनिक टेलीफोनों के संस्थापन हेतु शुद्ध लागत अवधारित करने के लिए केवल प्रचालन व्यय और राजस्व को हिसाब में लिया जाएगा । 2001 की जनगणना के अनुसार पहचाने गए अतिरिक्त राजस्व गांवों के लिए शुद्ध लागत के अवधारण हेतु अतिरक्त पूंजी वसूली को भी हिसाब में लिया जाएगा ।
परन्तु यह कि 1991 की जनगणना के अनुसार पहचाने गए गांवों में अभी संस्थापिते किए जाने वाले ग्रामीण सार्वजनिक टेलीफोन के मामले में शुद्ध लागत का निर्धारण करते समय पूंजी वसूली को भी हिसाब में लिया जाएगा ।
(ख) प्रत्येक राजस्व गांव में एक ग्रामीणा सार्वजनिक टेलीफोन संस्थपित करने का लक्ष्य प्राप्त कर लेने के पश्चात् उन क्षेत्रों में अतिरिक्त ग्रामीण सामुदायिक फोनों का उपबंध करना :- जिन गांवों में जनसंख्या 2000 से अधिक हो और कोई सार्वजनिक कॉल केन्द्र विद्यमान न हो, वहां एक दूसरा [ भाग II- खण्ड 3(i) ]

सार्वजनिक फोन संस्थापित किया जाएगा और उसके लिए शुद्ध लागत का अवधारण करने के लिए पूंजी वसूली, प्रचालन व्यय और राजस्व को हिसाब में लिया जाएगा 1
(ग) 1 अप्रैल , 2002 से पूर्व संस्थापित बहु पहुंच रेडियों रिले प्रौद्योगिकी पर आधारित ग्रामीण सार्वजनिक टेलीफोनों का प्रतिस्थापन : - शुद्ध लागत को अवधारित करने के लिए पूंजी वसूली, प्रचालन व्यय और राजस्व के हिसाब में लिया जाएगा ।
(घ) सार्वजनिक टेलीफोन केंद्रो का सार्वजनिक दूर सूचना केंद्रों के रूप में उन्नयन : 2000 से अधिक जनसंख्या वाले गांवों, अधिमानतः ऐसे गांवों जहां डाकघर अवस्थित हैं, की 5 किमी की परिधि के भीतर डाटा पारेषण सुविधाएं उपलब्ध कराई जाएंगी और शुद्ध लागत का अवधारण करने के लिए केवल उपभोक्ता परिसर में प्रदान किए जाने वाले उपस्कर अर्थात् कंप्यूटर, निर्बाध विद्युत आपूर्ति तथा मोडेम के लिए की जाने वाली पूंजी वसूली, प्रचालन व्यय और राजस्व को हिसाब में लिया जाएगा ।
(ङ) ब्लाक मुख्यालयों और 2000 से अधिक की जनसंख्या वाले ग्रामों में किसी सार्वजनिक स्थान पर उच्च गति के सार्वजनिक दूरसंचार सूचना केन्द्रों की संस्थापना करने का कार्य चरणबद्ध रूप से किया जाएगा । शुद्ध लागत का अवधारण करने के लिए सार्वनजिक दूरसंचार सूचना केन्द्रों की भांति उपभोक्ता के परिसर में लगाए जाने वाले उपस्कर तथा अपेक्षित अभिगम्यता के लिए पूंजी वसूली के साथ- साथ प्रचालन व्यय तथा राजस्व को हिसाब में लिया जाएगा ।

टिप्पण : जब तक केन्द्रीय सरकार द्वारा अन्यथा रूप से विनिर्दिष्ट न किया जाए तब तक कार्यक्षेत्र I की मद सं० (क) से (ङ) में विनिर्दिष्ट कार्यकलापों के लिए शुद्ध लागत का परिकलन करने के प्रयोजन हेतु गौण स्विचन क्षेत्र को एक इकाई माना जाएगा ।
(ii ) कार्य क्षेत्र- II केन्द्रीय सरकार द्वारा समय - समय पर यथा अवधारित ग्रामीणा तथा दूर- दराज के क्षेत्रों में घरेलू टेलीफोन प्रदान करना :
(क) पहली अप्रैल, 2002 से पूर्व संस्थापित घरेलू सीधी एक्सचेंज लाइनों के लिए ग्रामीण उपभोक्ताओं से वास्तविक रूप से प्रभारित किराए और भारतीय दूरसंचार विनियामक प्राधिकरण द्वारा ऐसे उपभोक्ताओं के लिए विहित किए गए किराए के अंतर की उस समय तक प्रतिपूर्ति नहीं की जाएगी जब तक भारतीय दूरसंचार विनियामक प्राधिकरण द्वारा समय- समय पर विहित किए गए अभिगम्यता घाटा प्रभारों को इस अंतर के लिए हिसाब में नहीं लिया जाएगा ।
(ख) पहली अप्रैल, 2002 के पश्चात् संस्थापित घरेलू सीधी एक्सचेंज लाइनों के लिए शुद्ध लागत का अवधारण करने के लिए पूंजी वसूली, प्रचालन व्ययों और राजस्व को हिसाब में लिया जाएगा । टिप्पण : जब तक कि केन्द्र सरकार विनिर्दिष्ट नहीं करती है कार्यक्षेत्र II की मद सं० (ख) में विनिर्दिष्ट कार्यकलापों के लिए शुद्ध लागत तय करने के प्रयोजन के लिए कम दूरी प्रभारण क्षेत्र को एक इकाई माना जाएगा
526. सार्वभौमिक सेवा प्रदाता के चयन के लिए मानदंड नियम 525 के उपनियम (2) के खंड (ii) की मद (क) में निर्दिष्ट घरेलू सीधी एक्सचेंज लाइनों को छोड़कर सार्वभौमिक सेवा प्रदाता का चयन बोली प्रक्रिया के द्वारा पात्र प्रचालकों में से किया जाएगा तथा बोली प्रक्रिया के परिणामस्वरूप भारत का राजपत्र असाधारण

7 हस्ताक्षरित करार को भारतीय तार अधिनियम, 1885 (1885 का 13) के अधीन नवीन लाइसेंस की स्वीकृति नहीं माना जाएगा ।
स्पष्टीकरण- इस नियम के प्रयोजनार्थ " पात्र प्रचालकों" से बुनियादी सेवा प्रचालक, सेल्यूलर मोबाइल सेवा प्रदाता और एकीकृत अभिगम सेवा लाइसेंसधारक अथवा इस संबंध में केन्द्रीय सरकार द्वारा समय- समय यथा विनिर्दिष्ट अन्य कोई निकाय अभिप्रेत है ।
527. सार्वभौमिक सेवा प्रदाताओं को निधियां जारी करना सार्वभौमिक सेवा प्रदाताओं को करार में यथा विनिर्दिष्ट रीति से और अन्तरालों पर निधियां जारी की जाएंगी ।

NOTIFICATION
New Delhi , the 26th March, 2004

G.S.R. 220 (E) . In exercise of the powers conferred by section 7 of the Indian Telegraph Act , 1885 ( 13 of 1885 ) , the Central Government hereby makes the following rules further to amend the Indian Telegraph Rules , 1951 , namely: -
1. ( 1 ) These rules may be called the Indian Telegraph (Amendment ) Rules , 2004 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Indian Telegraph Rules, 1951 , after rule 522 , the following shall be inserted, namely;

UNIVERSAL SERVICE OBLIGATION FUND
523. Definitions . In this part
(a) "Administrator" means the Administrator of the Fund appointed by the Central Government for the administration of the Fund;
(b) " Agreement " means an agreement made between the Administrator and one and more of the Universal Service Provider for the purpose of implementation of Universal Service Obligation;
(c) " Capital Cost " means the capital expenditure incurred on providing access as may be determined by the Administrator ;
(d) "Capital Recovery " means the aggregate of depreciation , interest on debt and return on equity on the capital cost annualized over a period of seven years ;

[PART II -SEC. 3 (i )] (e) " Fund" means the Universal Service Obligation Fund established under sub section (1 ) of section 9A of the Indian Telegraph Act, 1885 ( 13 of 1885) ;
(f) " High Speed Public Telecom and Information Centre " means a centre which offers additional facilities including tele-education and tele - medicine at a minimum data speed of 128 Kbps , for use by public ;
(g) "Multi Access Radio Relay Technology " means a technology used for providing telephone services ;
(h) "Public Telecom and Information Centre " means a centre which offers data applications including FAX , e - mail , internet besides voice telephony , for use by the Public ;
(i) "Net Cost" means Operating Expenses plus Capital Recovery minus Revenue ;
Explanation.- Where support is to be extended towards Operation and Maintenance only, Net Cost shall mean Operating Expenses minus Revenue ;
(j ) " Operating Expenses " means the annual Operating Cost incurred on operation and maintenance of the specified facilities as may be determined by the Administrator ;
(k) "Revenue " means the annual charges including usage charge and applicable rental from the specified Service , without any deduction of any kind whatsoever except taxes relating to the specified Service , if any , paid to the Government ;
(1) " Secondary Switching Area" means the area in which the country is divided by the Telegraph Authority , and is co -terminus with a Long Distance Charging Area ;
(m) "Universal Service Obligation " means the obligation to provide access to basic telegraph services to people in the rural and remote areas at affordable and reasonable prices ;
(u) "Universal Service Provider " means the person who has entered into an Agreement with the Administrator for the purpose of implementation of Universal Service Obligation ;

11 (0) "Village Public Telephone " means the first public telephone installed in a village.
524. Administration of the Universal Service Obligation Fund. - The Administrator shall have powers to, -
(i) formulate bidding procedures including its terms and conditions for the purposes ofimplementation of Universal Service Obligation;
(ii) evaluate the bids called for the purposes of implementation of Universal Service Obligation;
(iii) enter into Agreement with the Universal Service Provider for the purposes of implementation of Universal Service Obligation;
(iv) settle the claim of Universal Service Provider after due verification, and make disbursements accordingly from the Fund;
(v) specify relevant formats , procedures and records to be maintained and furnished by the Universal Service Provider;
(vi) monitor the performance of the Universal Service Provider as per the procedure specified by him from time to time.
525. Scope of support from Universal Service Obligation Fund. - ( 1 ) Financial Support from the Fund shall be provided to meet the Net Cost of providing the specified Universal Service Obligation as per the procedure specified by the Administrator from time to time , and the period for which such support shall be provided and the services covered shall be governed by an Agreement entered into with the Universal Service Provider .
( 2) The following services shall be supported by the Fund, namely: -

(a) Operation and Maintenance of Village Public Telephone in the revenue villages identified as per Census 1991 and Installation of Village Public Telephone in the additional revenue villages as per Census 2001.- For installation of Village Public Telephone in the revenue villages , identified as per 1991 Census , only the Operating Expenses and Revenue shall be taken into account for determining the Net Cost. For the additional revenue villages identified as per 2001 Census , Capital Recovery in addition shall also be taken into account for determining the Net Cost:
Provided that in the case of the Village Public Telephone which are still to be installed in the villages identified as per Census 1991 , Capital Recovery shall also be taken into account while determining the Net Cost ;
2 (b) Provision of additional rural community phones in areas after achieving the target of one Village Public Telephone in every revenue village.- Where in a village the population is more than 2000 and no public call office is existing , a 'second public phone shall be installed and for the purposes of determining the Net Cost, Capital Recovery , Operating Expenses and Revenue shall be taken into account;
(c) Replacement of Multi Access Radio Relay Technology Village Public Telephone installed before 1st day of April 2002.- Capital Recovery , Operating Expenses and Revenue shall be taken into account for determining the Net Cost .
(d
) Up - gradation of a Public Telephone to Public Tele Information Centres.- The data transmission facilities shall be provided within 5 Kms . of a village with a population exceeding 2000 , preferably in those villages where post offices are [ भाग II- खण्ड 3 (i ) ]

13 located and the Capital Recovery only towards provision of customer premises equipment ; namely, Computer , Uninterrupted Power Supply and Modem , Operating Expenses and Revenue shall be taken into account to determine the Net Cost.
(e) Installation of High Speed Public Telecom Information Centres in a public place at Block Headquarters and in villages with a population exceeding 2000 shall be made in a phased manner . Capital Recovery towards customer premises equipment as in the case of Public Telecom Information Centres , and required access as well as Operating Expenses and Revenue shall be taken into account to determine the Net Cost .
Note. - Unless otherwise specified by the Central Government , the Secondary Switching Area shall be taken as a unit for the purpose of arriving at the Net Cost for activities specified in items (a) to (e) of stream I.
(ii) Stream - II - Provision of household telephones in rural and remote areas as may be determined by the Central Government from time to time:
(a) For household Direct Exchange Lines installed prior to 1st day of April , 2002 , the difference in rental actually charged from rural subscribers and rent prescribed by Telecom Regulatory Authority of India for such subscribers shall be reimbursed until such time the Access Deficit Charges prescribed by Telecom Regulatory Authority of India from time to time take into account such difference .
(b) For household Direct Exchange Lines installed after 1st day of April , 2002, Capital Recovery , Operational Expenses and Revenue shall be taken into account to determine the Net Cost.

[PART II-SEC. 3 (i ) ] Note. Unless otherwise specified by the Central Government, the Short Distance Charging Area shall be taken as a unit for the purpose of arriving at the Net Cost for activities specified in item (b) of Stream II .
526. Criteria for selection of Universal Service Provider . - The selection of the Universal Service Provider shall be made by a bidding process from amongst the eligible operators , except for household Direct Exchange Lines referred to in item (a) of clause ( ii ) of sub - rule (2) of rule 525 and the Agreement signed as a result of the bidding process shall not be treated as grant of fresh license under the Indian Telegraph Act , 1885 ( 13 of 1885) .
Explanation . For the purposes of this rule , " eligible operators " means the Basic Service Operators , Cellular Mobile Service Providers and Unified Access Services Licencees or any other entities as may be specified in this behalf by the Central Government from time to time .
527. Release of Funds to Universal Service Providers . Fund shall be released to the Universal Service Provider in a manner and at such intervals as may be specified in the Agreement. '
