सा.का.नि. 223(अ). केन्द्रीय सरकार, महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 132 की उपधारा ( 1 ) के साथ पठित धारा 124 कीं उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कोलकाता पत्तन न्यास के न्यासी मण्डल द्वारा बनाए गए और इस अधिसूचना के नाथ संलग्न अनुसूची में दर्शित कोलकाता पत्तन न्यास कर्मचारी ( वर्गीकरण नियंत्रण एवं अपील ) संशोधन विनियम, 2004 का अनुमोदन करती है । 2. ये विनियम इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से लागू होंगे ।

सीपीटी कर्मचारी ( वर्गीकरण नियंत्रण व अपील ) तृतीय संशोधन विनियम , 2004
मप्नन्, अधिनियम 1963 (1963 का 38) की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा उसी अधिनियम की धारा 124 की उपधारा (1 ) के तहत केन्द्रीय सरकार की मंजूरी के साथ कोलकाता पत्तन के न्यासी मंडल सी पी टी कर्मचारी ( वर्गीकरण , नियंत्रण व अपील) विनियम , 1987 का संशोधन कर एतदद्वारा निम्नलिखित विनियम बनाते हैं ।
1. संक्षिप्त शीर्षक
इन विनियमों को सीपीटी कर्मचारी ( वर्गीकरण , नियंत्रण व अपील) तृतीय संशोधन विनियम , 2004 कहा जा सकेगा ।

(क) विनियम 4 में, पदो क
११. खंड ( 1 ) ( ख) में वर्णित तक "रू. 1980/ - को "रू.15100/-" (या जैसा कि स्मथ समय पर संशोधित हो ) " के द्वारा प्रतिस्थापित किया जाएगा ।
( 1 ) खंड (2 ) ( क ) में वर्णित अंक "रू 1679/--" तथा " 1980/-" को क्रमशः रू .11975/- ( या जैसा समय - समय पर संशोधित हो) " तथा रू. 15100/- ( या जैसा समय- समय पर संशोधित हो " से प्रतिस्थापित किया जाएगा ।
1 ) खंड में वर्णित अंक "रू .927/--" तथा " रू .1679/- " को क्रमश " रू.7330/- (या जैसर ओ समय - समय पर संशोधित हो) " तथा " रू .11975/- ( या जैसा भी समय -समय पर संशोधित हों) से प्रतिस्थापित किया जाएगा ।
खांड में पर्जित अंक " .927/--" को "रू .7330/- ( या जैसा भी समय - समय पर संसंचित हो) ने प्रतिस्थापित किया जाएगा।
(2) ॐ जया विनियम २ था विनियम 8(22 ) ( 111 ) को इस प्रकार शामिल किया जाएगा : -
विनियम 8 (22) (111 ) जब कभी जाचं अधिकारी अनुशासनिक प्राधिकरण को एक रिपोर्ट जांच विष्दार्थ के अद प्रस्तुत करता है किसी अपराधी को सभी दोषों या किसी एक आरोप का दोषी ठहराते हुए जिसके लिए कोई विशेष सजा का प्रस्ताव हो या न हो , तो दोषी ऐसी रिपोर्ट की एक प्रतिलिपि पाने का हकदार है ताकि अगर चाहे तो वह उक्त रिपोर्ट के विरूद्ध , रिपोर्ट की प्राप्ति की तिथि से 15 दिनों के भीतर अनुशासनिक प्राधिकरण के समक्ष आवेदन करने का अवसर प्राप्त कर सके ।
बशर्ते कि अगर अनुशारानिक प्राधिकरण स्वयं इस जाँच का संचालन कर रहे है तो यह रिपोर्ट दोषी को दी जानी अपेक्षित नहीं है ।
(ग) विनियम क ( 1 ) (1 ) प्को निम्नलिखित द्वाथ प्रतिस्थापित किया जाएगा : -
अनुशासनिक प्राधिकरण वभर स्वर्ग लॉन प्राधिकारी नहीं है तो वे जाँच रिपोर्ट व दोषी के वेदन अगर से तो उसके अवलोकन २१ म के कारणों को लिखित में दर्ज करने के उपरान्त आगे की जाँच व रिपोर्ट के लिए जाँच प्रधिकारी को प्रेषित कर सकते हैं तथा जॉच प्राधिकारी तदुपरान्त नियमानुसार आगे की कार्रवाई के लिए बढ़ सकते हैं ।
(घ) विनियम 8 क 3 में शब्द "आगे का "को अंतिम पंक्ति में शब्द " किसी " के बाद तथा शब्द "अवतर " के पहले शामिल किया जा सकता है । 3

NOTIFICATION
New Delhi, the 26th March, 2004
G.S.R. 223 (E ) .- In exercise of the powers conferred by Sub - section ( 1 ) of Section 124 , read with Sub -section (1 ) of Section 132 of the Maior Port Trusts Act , 1963 (38 of 1963 ) , the Central Government hereby approves the Kolkata Port Trust Employees' ( Classification, Control and Appeal ) Amendment Regulations, 2004 made by the Board ofTrustees of Kolkata Port Trust as set out in the Schedule annexed to this Notification .
2. Thesaid Regulations shall come into force from the date of publication of this Notification in the Official Gazette .
SCHEDULE
CPT EMPLOYEES ' ( CLASSIFICATION , CONTROL & APPEAL) 3RD AMENDMENT REGULATIONS , 2004
In exercise of powers conferred by Section 28 of MPT Act, 1963 ( 38 of 1963) and with sanction of the Central Government under Sub - Section ( i) of Section 124 of that Act, the Board of Trustees for the Port of Calcutta hereby makes the following Regulations to amend the CPT Employees ' ( Classification , Control & Appeal ) Regulations , 1987 .
1 . Short Title -
These Regulations may be called the CPI Employees ' ( Classification , Control & Appeal ) Third Amendment Regulations , 2004.
2. In the Calcutta Port Trust Employees ' (Classification , Control & Appeal ) Regulations , 1987 -
(a) In Regulation 4 , Classification of posts
(i) The figures " Rs.1980/ - " appearing in Clause ( 1 ) ( b) shall be submitted by " Rs.15100/-(or as may be revised from time to time)" .
(ii) The figures " Rs.1679/ - " and " Rs.1980/- " appearing in Clause (2) (a) shall be substituted by " Rs.11975/-" (or as may be revised from time to time)" and " Rs . 15100/- (or as may be revised from time to time) " respectively .
(iii) The figures "Rs.927 / - " and Rs.1679/-" appearing in Clause 3 (a) shall be substituted by " Rs.7330/- (or as may be revised from time to time) " and " Rs.11975/- (or as may be revised from time to time) " respectively .
(iv) The figure " Rs.927/ - " appearing in Clause (4) shall substituted by "Rs.7330/-(or as may be revised from time to time) " .

[PART II-SE . 3 ( 1) (b) A new Regulation viz . Regulation 8 (22 ) ( iii ) shall be inserted as follows :
Regulation 8 ( 22) ( iii ) Whenever the enquiry officer has furnished a report to the disciplinary authority at the conclusion of the enquiry holding the delinquent guilty of all or any of the charges with proposal for any particular punishment or not, the delinquent is entitled to a copy of such report for having an opportunity to make a representation if any , against said report before the disciplinary authority within fifteen days Com the date of receipt of said report .
Provided that no such report is required to be given to the delinquent if the enquiry is conducted by the disciplinary authority himself.
Regulation 8A ( 1 ) ( i ) shall be substituted by following : (c)
"The disciplinary authority if it is not itself the enquiry authority, may on perusal of the enquiry report and representation , if any , of the delinquent , remit the case to the enquiring authority, for further enquiry and report after recording its reasons in writing and the enquiring authority shalt thereupon proceed to hold further enquiry as per Rule".
(d) In Regulation 8 ( A) (3 ) word " further " may be inserted in the last line after the word " any " and before the word " opportunity" .
(e) Schedule A & B will be replaced by the following : -
