सं. टीबीडी/ पीसी/2003-2004/02.- बैंककारी कंपनी ( उपक्रमों का अर्जन और अंतरण ) अधिनियम, 1970 ( 1970. का 5 ) की धारा 19 द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए बैंक ऑफ इंडिया का निदेशक बोर्ड भारतीय रिज़र्व बैंक के परामर्श से और केंद्रीय सरकार की पूर्व स्वीकृति से एतद्द्वारा बैंक ऑफ इंडिया ( कर्मचारी ) पेंशन विनियमावली, 1995 संशोधित करने के लिए निम्नलिखित विनियम करता है, अर्थात्:-
1. ( 1 ) इन विनियमों को बैंक ऑफ इंडिया ( कर्मचारी ) पेंशन ( संशोधन ) विनियमावली , 2004 कहा जाएगा ।.
(2) वे सरकार के राजपत्र में प्रकाशित होने की तारीख से प्रभावी होंगे ।
2. बैंक ऑफ इंडिया ( कर्मचारी ) पेंशन विनियमों में :-
(क) विनियम 2
विनियम 2के उप-विनियम ( एस ) के खंड ( बी ) में उप- खंड ( iii ) के बाद निम्नलिखित का समावेश किया जाएगा अर्थात्ः- ( iv) औद्योगिक कामगारों के लिए 1960 = 100 की श्रृंखला में अखिल भारतीय औसत उपभोक्ता मूल्य सूचकांक में 1148 पॉइंट सूचकांक तक परिकलित महंगाई भत्ता ।
(ख) विनियम 41 में,
उप -विनियम ( 6 ) के लिए, निम्नलिखित उप- विनियम प्रतिस्थापित किया जाएगा अर्थात्: -
" (6 ) जो आवेदक अधिवार्षिकी पेंशन या स्वैच्छिक निवृत्ति पेंशन या अवधिपूर्व निवृत्ति पेंशन या अनिवार्य निवृत्ति पेंशन या अक्षमता पेंशन या अनुकंपा भत्ता के लिए अधिकृत हैं , वे इन विनियमों के अतंर्गत अपनी पेंशन के एक अंश का संराशीकरण ( कम्यूटेशन ) करने के लिए पात्र होंगे । " बशर्ते कि दिनांक 1-7-2003 को और आगे , उस आवेदक के संबंध में जिसके मामले में पेंशन का संराशीकृत मूल्य उसकी निवृत्ति की तारीख के बाद के दिन या उस तारीख से जिससे संराशीकरण निरपेक्ष होता है, देय होता हो तो संराशीकरण के कारण पेंशन की राशि में कटौती उसके प्रारंभ से परिचालित होगी । तथापि, जहां पेंशन के संराशीकृत मूल्य का भुगतान सेवानिवृत्ति की तारीख के बाद के प्रथम माह के भीतर या संराशीकरण निरपेक्ष होने की तारीख के बाद प्रथम माह के भीतर, जो भी मामला हो, नहीं किया गया तो मासिक पेंशन और संराशीकृत पेंशन के बीच के अंतर 1077 G1/2004

का भुगतान सेवा निवृत्ति के अगले दिन की तारीख या संराशीकरण निरपेक्ष होने की तारीख , जो भी मामला हो , तथा उस तारीख के बाद की तारीख जिस पर पेंशन का संराशीकृत मूल्य अदा किया माना जाएगा , के बीच की अवधि के लिए किया जाएगा ।

Mumbai , the 15th March, 2004 .
No. TBD/PC/2003-2004/ 02.- In exercise of the powers conferred by Section 19 , of the Banking Companies (Acquisition and Transfer of Undertakings ) Act, 1970 (5 of 1970) , the Board of Directors of the Bank of India in consultation with the Reserve Bank of India and with the previous sanction of the Central Government , hereby makes the following regulations further to amend the Bank of India (Employees ' ) Pension Regulations , 1995 , namely:-
1. ( 1 ) These regulations may be called the Bank of India (Employees ' ) Pension (Amendment) Regulations , 2004.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Bank of India (Employees ' ) Pension Regulations: ---
(a) Regulation 2 ,
In clause (b) to sub - regulation ( s ) of Regulation 2 , after sub - clause ( iii ) the following sub- clause shall be inserted, namely
"( iv) dearness allowance calculated upto index number 1148 points in the All India Average Consumer Price Index for industrial workers in the series 1960-100 " .
(b) Regulation41 ,
for sub - regulation (6) ; the following sub - regulation shall be substituted, namely: --
"(6) . An applicant who is authorised a superannuation pension or voluntary retirement pension or prema- ture retirement pension or compulsory retirement pension or invalid pension or compassionate allowance shall be eligible to commute a fraction of his pension under these regulations :
Provided that on and from 01-07-2003 , in case of an applicant in whose case, the commuted value of pension becomes payable on the day following the date of his retirement or from the date from which the commuta- tion becomes absolute , the reduction in the amount of pension on account of commutation shall become operative from its inception . Where, however , payment of commuted value of pension could not be made within the first month after the date of retirement or within the first month after the date when the commuta- tion becomes absolute as the case may be , the difference between the monthly pension and the commuted pension shall be paid for the period between the date following the date of reitrement or the date when the commutation becomes absolute , as the case may be , and the date preceding the date on which commuted value of pension is deemed to have been paid. "
