फा. सं. 11 /4/95- आई.आर. और 11 / 2/98- आई आर/सं. एक्जिम/सेवा/2004.- भारतीय निर्यात- आयात बैंक अधिनियम, 1981 ( 1981 का संख्यांक 28 ) की धारा 27 के साथ पठित धारा 39 , की उप - धारा 2 ( घ ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय निर्यात-आयात बैंक का निदेशक मंडल निर्यात- आयात बैंक अधिकारी सेवा विनियमावली, 1982 में संशोधन करने के लिए केन्द्रीय सरकार की पूर्व मंजूरी से, एतद्द्वारा निम्नलिखित विनियम बनाता है, अर्थात्

1. (1) ये विनियम निर्यात-आयात बैंक अधिकारी सेवा (संशोधन) विनियमावली , 2004 कहलाएंगे :

(2) यह विनियमावली अन्यथा स्पष्टतः उपबंधित स्थिति को छोड़कर , शासकीय राजपत्र में इसके प्रकाशन की तारीख को लागू होगी ।

2. निर्यात-आयात बैंक अधिकारी सेवा विनियमावली , 1982 ( जिसे यहाँ इसके बाद मूल विनियमावली के रूप में उल्लेख किया गया है ) , के विनियम 4 के उप -विनियम ( 1 ) , के लिए निम्नलिखित उप-विनियम प्रतिस्थापित किया जाएगा और यह समझा जाएगा कि यह जुलाई 1993 की पहली तारीख से प्रभावी प्रतिस्थापित कर दिया गया है, अर्थात:-

अधिकारियों के लिए निम्नलिखित पाँच श्रेणियाँ होंगी और प्रत्येक श्रेणी के सामने उनका वेतनमान निर्दिष्ट है:

3. (i ) विनियम 10 में , उप विनियम ( 1 ) , के लिए निम्नलिखित उप -विनियम प्रतिस्थापित किये जायेंगे , अर्थात्ः

"( 1 ) बैंक का कोई अधिकारी 60 वर्षों की आयु पूरी होने पर सेवा निवृत्त होगा;

बशर्ते , बैंक अपने विवेकाधिकार से जैसा कि इसके बाद उप विनियम (2 ) में दिया गया है विशेष समिति द्वारा समीक्षा पर किसी अधिकारी को 55 वर्ष की आयु पूरा करने पर या कुल 30 वर्षों की सेवा पूरी होने पर या अन्यथा इसमें जो भी पहले हो कभी भी किसी अधिकारी को सेवानिवृत्त कर सकता है ;

बशर्ते यह भी कि ऐसे किसी अधिकारी को सेवानिवृत्त करने के पहले जैसा कि उप विनियम ( 1 ) के परंतुक में दिया गया है ऐसे अधिकारी को लिखित रूप से तीन महीने की नोटिस या तीन महीने की परिलब्धियों के बराबर राशि दी जाएगी ;

बशर्ते यह भी कि इस विनियमावली में ऐसा कुछ नहीं होगा जो किसी अधिकारी को पहले सेवानिवृत्त होने से रोके जो उसके ऐसे निबंधनों एवं शर्तों के पूरा होने के अधीन होगा जो बैंक द्वारा विहित की जाएँ । 3 [ भाग III-- खण्ड 4 ]

स्पष्टीकरण

(क) प्रत्येक अधिकारी उस महीने की अंतिम तारीख के अपराह्न में सेवानिवृत्त होगा जिसमें वह 60 वर्ष की आयु पूरा करता होः बशर्ते जिस अधिकारी का जन्म दिन महीने की 1 तारीख को होगा वह 60 वर्ष की आयु पूरा करने पर उसके पहले महीने की अंतिम तारीख के अपराह्न में सेवानिवृत्त होगा ।

(ख) किसी अधिकारी को 60 वर्षों के बाद किसी प्रकार का विस्तार नहीं दिया जाएगा ।

(ii) उप-विनियम (2) , शब्दों और आंकड़ों के लिए " दूसरे उप-विनियम के परन्तुक (1 ) " , ये शब्द और आंकड़े उप-विनियम ( 1 ) के पहले परन्तुक के लिए प्रतिस्थापित किये जायेंगे ।

4. मूल -विनियमावली के विनियम 12 के लिए , निम्नलिखित विनियम प्रतिस्थापित होगा और इसे 1 जुलाई 1993के पहले दिन से प्रतिस्थापित होना माना जाएगा , अर्थात: -

" 12 किसी भी अधिकारी को महँगाई भत्ता निम्नलिखित अनुसूची के अनुसार देय होगा: -

(i ) महँगाई भत्ता अखिल भारतीय श्रमिक वर्ग उपभोक्ता मूल्य सूचकांक ( आधार 1960= 100 ) से जुड़ाहोगा ।

(ii) महँगाई भत्ता केवल उस समय देय होगा जब औसत सूचकांक 1148 उपभोक्ता मूल्य सूचकांक से अधिक हो ।

(iii) 1148 अंकों से अधिक के (औद्योगिक श्रमिकों के अखिल भारतीय उपभोक्ता मूल्य सूचकांक -1960 = 100 अंक) प्रत्येक 4 अंक चक्र की वृद्धि अथवा गिरावट के लिए तिमाही औसत और तिमाही समायोजन निम्न होगा:-

पहला वेतन -स्तर ( स्लैब)

0.35% जमा

4800/- रुपये तक के मूल वेतन के लिए

दूसरा वेतन-स्तर ( स्लैब)

0.29% जमा

मूल वेतन के 4801/- रुपये से 7700/ - रुपये तक के भाग के लिए

तीसरा वेतन -स्तर ( स्लैब)

0.17% जमा

मूल वेतन के 7701/- रुपये से 8200/- रुपये तक के भाग के लिए

चौथा वेतन-स्तर

0.09% "

[PART III-SEC. 4] 5. मूल विनियमावली के 13 के लिए निम्नलिखित विनियम प्रतिस्थापित होगा , अर्थात: -

" 13(1) जहाँ किसी अधिकारी को बैंक द्वारा आवासीय सुविधा प्रदान की गयी है तो ऐसे मामले में बैंक द्वारा अधिकारी को बिना सज्जित आवास के लिए 1 नवंबर , 1994 से मूल वेतन जिसमें उसे रखा गया है के पहले चरण का 4% या मानक किराया , इनमें से जो भी कम हो वह अदा करेगा ।

ऐसा अधिकारी , प्रथम चरण के जिस वेतनमान में वह रखा गया हो उस मूल वेतन का 1 % बैंक द्वारा उपलब्ध कराए गए फर्नीचर के लिए तब अदा करेगा , जब बैंक द्वारा उसके आवास पर कोई फर्नीचर उपलब्ध कराया गया हो ।

7 (2) जहाँ अधिकारी को बैंक द्वारा आवास उपलब्ध नहीं कराया गया हो तो ऐसे मामले में अधिकारी 1 नवंबर , 1992 से तैनाती के स्थान पर निर्भर , मकान किराया भत्ता के लिए निम्नानुसार पात्र होगा:

प्रतिमाह वेतन का 13 % (i) 'क' श्रेणी के प्रमुख शहर ( नई दिल्ली , मुंबई , कोलकाता , चेन्नई , हैदराबाद , बैंगलोर , अहमदाबाद) और समूह 'क' में परियोजना क्षेत्र केंद्र

प्रतिमाह वेतन का 12% (ii) क्षेत्र 1 के अन्य स्थानों ( 12 लाख से अधिक जनसंख्या वाले ) तथा समूह ख में परियोजना क्षेत्र केंद्र

प्रतिमाह वेतन का 102 % (iii) क्षेत्र ।। ( 1 लाख एवं उससे अधिक जनसंख्या ) तथा राज्य की राजधानियाँ और संघ क्षेत्र की राजधानियाँ जो उपर्युक्त ( i ) एवं (ii ) में शामिल नहीं है ।

( iv) क्षेत्र III (जहाँ जनसंख्या 1 लाख से कम है)

प्रतिमाह वेतन का 92% (समूह 'क' एवं समूह 'ख' में परियोजना क्षेत्र केन्द्र बैंकिंग उद्योग के वर्गीकरण के अनुसार होंगे ) 5

(i ) बशर्ते यदि कोई अधिकारी किराए के मकान में रहता है तथा मकान किराया की रसीद प्रस्तुत करता है तो उसे, उसके आवास के लिए देय मकान किराया भत्ता उसके द्वारा अदा किया गया वास्तविक किराया उसे रखे गए प्रथम चरण के वेतनमान में 4 प्रतिशत से अधिक वेतन का उपर्युक्त देय मकान किराए या मकान किराया भत्ता के 150 प्रतिशत में से जो भी कम हो , देय होगा ।

(ii) बशर्ते यह भी कि ऐसे सभी अधिकारी जो बैंक की सेवा में 01.11.1987 में आए हैं , और प्रमुख 'क' शहर क्षेत्र में रहे हैं , को मकान किराया भत्ता उपर्युक्त परन्तुक ( i) में विनिर्दिष्ट दरों पर 13 फरवरी 2001 तक अदा किया जाएगा ।

टिप्पणी: मकान किराया भत्ता के प्रयोजन से "वेतन" का आशय 1 जुलाई , 1993 को संशोधित वेतनमानों का मूल वेतन एवं अवरुद्ध वेतनवृ‌द्धियाँ होगीं ।

(3) यदि कोई अधिकारी अपने खुद के आवास में रहता हो तो उप-विनियम (2 ) में वर्णित उसी आधार पर वह मकान किराया भत्ता का पात्र होगा जैसे कि वह मासिक किराया के बारहवें हिस्से के बराबर अधिकारी द्वारा घोषित क से उच्चतर या ख से कम के लिये पात्र होगा ।

क

निम्नका कुल: -

(1) आवास के संबंध में देय महापालिका कर; और

(ii) भूमि की लागत सहित आवास की पूँजीगत लागत का 12 % तथा यदि आवास किसी भवन का हिस्सा हो तो उस आवास के लिए दी जानेवाली पूँजीगत लागत का आनुपातिक हिस्सा जिसमें विशेष फिक्चर्स जैसे एअर कंडीशनर शामिल नहीं होंगे या

आवास के नगरपालिका मूल्यांकन के लिए लिया गया वार्षिक किराया मूल्य स्पष्टीकरण: इस विनियमावली के लिए "मानक किराया" का आशय है :

(क) बैंक के स्वामित्व के किसी आवास के मामले में सरकार में ऐसी गणना के लिए प्रचलित क्रियाविधि केअनुसार गणना किए जानेवाले मानक किराए के अनुसार होगी;

[PART III-SEC . 4] (ख) ऐसे मामले में जहाँ आवास बैंक द्वारा किराए पर लिया गया हो तो बैंक द्वारा देय संविदात्मक किराया या आकार में ऐसे किराया के प्रचलित गणना के लिए क्रियाविधि के अनुसार , में से जो भी निम्नतर हो , गणना की जाएगी ।

6. मूल विनियमावली के विनियम 14 के लिए , निम्नलिखित विनियम प्रतिस्थापित होगा और इसे 1 नवंबर 1994 के पहले दिन से प्रतिस्थापित हुआ समझा जाएगा , अर्थातः-

" 14 कोई भी अधिकारी बैंक द्वारा उपलब्ध कराए जानेवाले आवास को अपना अधिकार नहीं समझेगा । तथापि असज्जित आवास के लिए अधिकारी द्वारा प्रथम चरण के वेतनमान जिसमें वह रखा गया हो का 4% की अदायगी और सज्जित आवास के लिए प्रथम चरण के वेतनमान जिसमें उसे रखा गया हो के 5% की अदायगी या मानक किराया में से जो भी कम हो की अदायगी पर बैंक आवास उपलब्ध कराने के लिए स्वंतत्र होगा । जब बैंक द्वारा इस तरह का सज्जित या असज्जित आवास उपलब्ध कराया जाए तो बिजली , पानी , गैस एवं संरक्षण प्रभार अधिकारी द्वारा वहन किए जाएंगे न कि बैंक द्वारा । "

7. मूल विनियमावली के विनियम 15 के लिए , निम्नलिखित विनियम प्रतिस्थापित होगा और इंसे 1 नवंबर 1993 के पहले दिन से प्रतिस्थापित प्रभावी हुए समझा जाएगा , अर्थात: -

" 15. कोई अधिकारी नगर प्रतिपूरक भत्ते के लिए पात्र होगा , जो उसके तैनाती के स्थान पर निम्न 'अनुसार निर्भर करेगा ।

क्षेत्र

दरें

(i ) क्षेत्र 1 के स्थान ( 12 लाख और उससे अधिक जनसंख्या वाला) तथा गोवा राज्य में

मूल वेतन का 4½ जो 335/-रुपये प्रतिमाह से अधिक नहीं होगा ।

मूल वेतन का 32 % जो 230 रुपये प्रतिमाह से अधिक नहीं होगा ।

(ii ) 5 लाख एवं उससे अधिक जनसंख्या वाले स्थान किंतु 12 लाख से कम तथा राज्य की राजधानियाँ एवं चण्डीगढ़ , पांडिचेरी तथा पोर्ट ब्लेयर जो. उपर्युक्त (i ) में शामिल नहीं हैं । [भाग III- खण्ड 4 ]

7 8. मूल विनियमावली के विनियम के 15 विनियम के बाद , निम्नलिखित विनियम अंतःस्थापित होगा , अर्थातः- " 15 क अग्रिम वेतनवृद्धि / निश्चित व्यक्तिगत भत्ता: -

सभी अधिकारी जो 1 नवंबर , 1993 को बैंक की स्थायी सेवा में हों उन्हें वेतनमान में एक अग्रिम वेतनवद्धि दी जायगी । ऐसे अधिकारी जो 1 नवंबर , 1993 को परिवीक्षा पर रहे हों उन्हें एक वर्ष के बाद स्थायीकरण पर एक अग्रिम वेतनवृद्धि दी जाएगी ।

बशर्ते जब कोई अधिकारी वेतनमान के अधिकतम पर हो जो 1 नंवबर , 1993 को अवरुद्ध वेतनवृद्धि पा रहा हो तो उसे 1 नवंबर , 1993 से निश्चित व्यक्तिगत भत्ता दिया जाएगा जो अंतिम आहरित वेतनवृद्धि एवं 1 नवंबर 1993 को देय महंगाई भत्ते के बराबर राशि होगी । साथ ही विनियम 13 की शर्तों पर लागू मकान किराया भत्ता दिया जाएगा । मकान किराया भत्ता के साथ इसके अंतर्गत दिया जाने वाला निश्चित व्यक्तिगत भत्ता यदि कोई हो तो वह सम्पूर्ण सेवा अवधि के लिए एक ही होगा ।

टिप्पणी:

(i) उपर्युक्त (ग) में दर्शाया गया निश्चित व्यक्तिगत भत्ता उन अधिकारी कर्मचारियों को दिया जाएगा

(ii) मकान किराया भत्ता के लिए पात्र अधिकारियों के लिए , निश्चित व्यक्तिगत भत्ता , संबंधित अधिकारी कर्मचारी द्वारा संबंधित वेतनमान में विनियम 4 के उप-विनियम (i ) में विनिर्दिष्ट के अनुसार अंतिम वेतनवृद्धिमिले तो ( क) + (ख) + संबंधित अधिकारी कर्मचारी द्वारा आहरित मकान किराया भत्ता होगा । (iii) निश्चित व्यक्तिगत भत्ता वेतनवृद्धि घटक को अधिवर्षिता लाभ के लिए माना जाएगा ।

( iv) कोई अधिकारी जिसने यह अग्रिम वेतन वृद्धि अर्जित की है उपर्युक्त वर्णित निश्चित व्यक्तिगत भत्ते की राशि वेतनमान के अधिकतम पर पहुँचने के एक वर्ष बाद आहरित कर सकता है ।

9. मूल विनियमावली के विनियम 33 के उप-विनियम (4) के लिए निम्नलिखित उप -विनियम प्रस्थापित किया जाएगा और यह समझा जायेगा कि इसे 1 नवंबर 1995 से प्रस्थापित किया गया है अर्थात:-

"(4) नीचे की तालिका के स्तंभ 1 में निर्धारित ग्रेडों / वेतनमानों का कोई भी अधिकारी उसके स्तंभ 2 में निर्धारित दरों की तदनुरूप दरों पर विराम भत्ते का पात्र होगा:

परंतु यह शर्त है कि-

(क) जहाँ अनुपस्थिति की कुल अवधि 8 घंटों से कम परंतु 4 घंटों से अधिक है वहाँ विराम भत्ता उपर्युक्त दरों की आधी दर से देय होगा। [भाग III- खण्ड 4 ]

9 (ख) विभिन्न वेतनमानों के अधिकारियों को नीचे दी गई सीमाओं के अधीन भारतीय पर्यटन विकास निगम (आइ टी डी सी) के होटलों के एकल कमरे के स्थान तक सीमित करते हुए वास्तविक होटल व्ययों की प्रतिपूर्ति की जा सकती है :

10. मूल विनियमावली के विनियम 38 के लिए , निम्नलिखित विनियम प्रतिस्थापित होगा, अर्थात: -

"38. भविष्य निधि

(1 ) प्रत्येक अधिकारी , बैंक द्वारा गठित भविष्य निधि का सदस्य बनेगा वह ऐसी निधि को शासित करने वाले नियमों द्वारा आबद्ध होने के लिए सहमत होगा।

(2) बैंक उस भविष्य निधि में , भविष्य निधि पर समय- समय पर लागू नियमों के अनुसार , अभिदाय करेगा परंतु उसके द्वारा अभिदत्त रकम , निम्न से अधिक नहीं होगी:

[PART III-SEC. 4] i) 1.11.87 से 31.12.88 तक वेतन के 80% का 10%

ii) 1.1.89 से 31.12.89 तक वेतन के 90 % का 10%

1.1.90 और उसके आगे से वेतन का 10%

'बशर्ते संशोधित वेतनमानों के अंतर्गत 1 जुलाई 1993 से प्रभावी वेतन 1 नवम्बर , 1993 से प्रभावी भविष्य निधि अंशदान के लिए लागू होगा ।

11. मूल विनियमावली में , विनियम 39 के लिए , निम्नलिखित विनियम प्रतिस्थापित होगा , अर्थात: -

39. (1 ) प्रत्येक अधिकारी निम्न पर उपदान का पात्र होगा:

(क) सेवा निवृत्तिः

(ख) सेवा के दौरान उसकी मृत्यु:

(ग) आगे की सेवा के लिए अयोग्य होने पर जैसा कि बैंक द्वारा अनुमोदित चिकित्सा अधिकारी द्वारा प्रमाणित किया गया हो ।

लगातार दस वर्षों की सेवा करने के बाद त्यागपत्रः

(घ)

(ङ) दस वर्षों की सेवा पूरी करने के बाद दण्ड के अलावा बैंक द्वारा किसी प्रकार सेवा समाप्त करने पर ।

(2) किसी अधिकारी को देय उपदान की राशि प्रत्येक पूरे किए गए वर्ष की सेवा के लिए एक महीने का वेतन होगा जो अधिकतम 15 महीने के वेतन के अधीन होगा ।

बशर्ते जब कोई अधिकारी 30 वर्षों से अधिक की सेवा पूरी कर लेता है तो वह तीस वर्षों के बाद पूरे किए गए प्रत्येक वर्षों की सेवा के लिए एक महीने के आधे वेतन के बराबर अतिरिक्त राशि का पात्र होगा ।

बशर्ते आगे यह कि कोई अधिकारी विकास बैंक या इस संबंध में अध्यक्ष एवं प्रबंध निदेशक द्वारा अनुमोदित किसी अन्य संस्था से एक्ज़िम बैंक में समाहित किया गया हो तो यहाँ ऊपर दी गई दर के अनुसार उपदान का पात्र होगा जो विकास बैंक या एक्ज़िम बैंक में समाहित होने के पहले की [भाग III- खण्ड 4 ]

11 तारीख को किसी ऐसी संस्था में की गई सेवा अवधि के लिए होगा बशर्ते उसे अपने पैत्रिक संस्था द्वारा उपदान नहीं दिया गया हो ।

स्पष्टीकरण:

इस विनियमावली के उद्देश्य से 'वेतन' का अर्थ होगा अंतिम आहरित या संबंधित अधिकारी को देय वेतन इसके अतिरिक्त ऐसे किन्ही अधिकारियों के मामले में जो 1 जुलाई , 1993 से 31 अक्तूबर , 1994 (दोनों दिन शामिल हैं ) की अवधि के दौरान उपदान के लिए पात्र हो , वेतन का अर्थ 1 नवम्बर , 1987 से संशोधित वेतनमानों के अंतर्गत आहरित अंतिम वेतन होगा ।

व्याख्यात्मक ज्ञापन

छठे द्विपक्षीय निपटान के पश्चातवर्ती , केन्द्र सरकार ने भारतीय निर्यात-आयात बैंक के 18.10.95 को अनुमोदन प्रदान किया कि वह सार्वजनिक क्षेत्र के बैंकों द्वारा किए गए संशोधनों को ध्यान में रखते हुए अपने अधिकारियों के वेतनमानों तथा अन्य सेवा शर्तों को संशोधित करें और बैंक के अधिकारियों को तदर्थ अदायगी करे । यह प्रमाणित किया जाता है कि इन संशोधनों को भूतलक्षी प्रभाव देने से बैंक के किसी अधिकारी- कर्मचारी के हितों पर कोई प्रतिकूल प्रभाव नहीं पड़ेगा । THE GAZETTE OF INDIA EXTRAORDINARY

NOTIFICATION

Mumbai , the 23rd March , 2004

F. No. 11 /4/95-1 R & 11 /2/98- IR /No . EXIM/Service/2004.-In exercise ofthe powers conferred by clause (d) ofSub - section (2) of Section 39 , read with Section 27 ofthe Export - Import Bank of India Act, 1981 (28 of1981), the Board of Directors of the Export - Import Bank of India, with the previous approval ofthe Central Government, hereby makes the following regulations , further to amend the Export - Import Bank Officers ' Ser- vice Regulations , 1982, namely:

1. (1) These regulations may be called the Export - Import Bank Officers ' Service(Amendment) Regulations , 2004 ;

(2) Save as otherwise expressly provided, these regulations shall come into force on the date of their publication in the Official Gazette .

2. In the Export - Import Bank Officers ' Service Regulations , 1982 (hereinafter referred to as the principal regulations ) , in regulation 4, for sub - regulation ( 1 ) , the following sub - regulation shall be substituted and shall be deemed to have been substituted with effect from the 1st day of July, 1993 , namely : -

"( 1 ) There shall be the following five grades for officers with the scales ofpay specified against each of the grades :

3. (i) In regulation 10, for sub - regulation ( 1 ) , the following shall be substituted, namely: -

"( 1 ) AnOfficer of the Bank shall retire on completion of 60 years of age ;

Provided that the Bank may, at its discretion , on review by the Special Committee as provided hereinafter in sub - regulation (2) retire an officer on or at any time after the completion of 55 years of age or on or at any time after the completion of 30 years of total service as an officer or otherwise , whichever is earlier ;

Provided further that before retiring such an officer, as mentioned in the first proviso of sub - regulation (1 ) , at least three months ' notice in writing or an amount equivalent to three months ' emoluments shall be given to such anofficer;

Provided also that nothing in this regulation shall be deemed to preclude an officer from retiring earlier subject to his fulfilling such terms and conditions which may be prescribed by the Bank .

EXPLANATION

(a) Every officer shall retire from the service on the afternoon of the last day of the month in which he attains the age of 60 years ;

Provided that the officer whose date of birth is 1st of month, he shall retire from the service on the afternoon of the last day of the preceding month , on attaining the age of 60 years .

(b) No extension shall be given to any officer beyond 60 years of age . "

(ii) In sub - regulation (2) , for the words and figures " second proviso to sub - regulation (1 ) " , the words and figures " first proviso to sub - regulation ( 1 ) " shall be substituted .

4. For regulation 12 of the principal regulations , the following regulation shall be substituted and shall be deemed to have been substituted with effect from the 1st Day of July, 1993 , namely: -

" 12. Dearness Allowance payable to officers shall be as per following schedule : - i) Dearness Allowance will be liked to the All India Working Class Consumer Price Index (CPI) (Base 1960-100) .

ii) Dearness Allowance will be payable only when the Average Index is above CPI 1148 .

Above 1148 points (All India Consumer Price Index for Industrial Workers- 1960-100 points ) , for each 4 point cycle , rise or fall , quarterly average , quarterly adjustments shall be as follows:-

5. For regulation 13 of the principal regulations , the following regulation shall be substituted , namely: -

" 13 ( 1 ) Where an officer is provided with residential accommodation by the Bank, the officer shall pay to the Bank every month with effect from the 1st day of November , 1994 a sum equal to 4% of the Basic Pay in the first stage of the Scale of Pay in which he is placed or the standard rent , whichever is less , for the unfurnished accommodation provided to him by the Bank.

Such an officer shall also pay a further sum equal to 1% of the basic pay in the first stage of the scale of pay in which he is placed towards the furniture , ifany, provided at his residential accommodation by the Bank.

(2) Where an officer is not provided with residential accommodation by the Bank , the officer shall be eligible , with effect from the 1st day of November , 1992 , for a House Rent Allowance, depending on place of posting , as under : -

Area II ( population of 1 lakh and above) and State Capitals and Capitals of Union Territories not covered by (i ) and ( ii ) above

(Project area centres in Group ' A' and Group ' B ' will be as per classification in Banking Industry)

(i) Provided that if an officer resides in a rented accommodation and produces a rent receipt , the house rent allowance payable to him shall be the actual rent paid by him for his residential accommodation in excess over 4 per cent of the pay in the first stage of the scale of pay in which he is placed or 150 percent of the House Rent Allowance payable as above , whichever is lower.

( ii ) Provided further that all officers who joined the Bank before 01.11.1987 and reside in major ' A' class cities , will be paid HRA at a rate as specified in proviso ( i ) above , until February 13 , 2001 .

Note : ' Pay' for the purpose of House Rent Allowance shall mean basic pay including stagnation increments in terms of revised pay scales as on the 1st day ofJuly, 1993.

(3) Where an officer resides in his own accommodation, he shall be eligible for a house rent allowance on the same basis as mentioned in sub - regulation (2) as if the officer was paying , by way of monthly rent a sum equal to one- twelfth of the higher ofA or B below , as declared by the officer .

The aggregate of: -

(i) Municipal taxes payable in respect of the accommodation ; and

(ii) 12% of the capital cost of the accommodation including the cost of the land and if the accommodation is part of a building, the proportionate share of the capital cost of the land attributable to that accommodation, excluding the cost of special fixtures like air conditioners , or

The annual rental value taken for municipal assessment of the accommodation .

EXPLANATION : For the purpose of this regulation " standard rent" means

(a) in the case of any accommodation owned by the Bank, the standard rent calculated in accordance with the procedure for such calculation in vogue in Government;

[ PART III- SEC . 4] (b) where accommodation has been hired by the Bank , the contractual rent payable by the Bank or rent calculated in accordance with procedure for such calculation in vogue in Government , whichever is lower . "

6. For regulation 14 of the principal regulations , the following regulation shall be substituted and shall be deemed to have been substituted with effect from the 1st Day of November 1994 , namely : -

1 " 14. No officer shall be entitled as of right to be provided with residential accommodation by the Bank . It shall, however , be open to the Bank to provide residential accommodation on payment by the officer of 4% of the basic pay at the first stage of the scale of pay in which he is -placed for unfurnished accommodation and 5% of the basic pay at the first stage of the scale of pay in which he is placed for furnished accommodation or the standard rent , whichever is less for such accommodation. Where such furnished or unfurnished residential accommodation is provided by the Bank , the charges for electricity, water, gas and conservancy shall be borne by the officer and not by the Bank . "

7. For regulation 15 of the principal regulations , the following regulation shall be substituted and shall be deemed to have been substituted with effect from the 1st day of November , 1993 , namely : -

" 15. An officer shall be eligible for City Compensatory Allowance , depending on place of posting, as under :

" 15A. Advance Increment/Fixed Personal Allowance : -

All Officers who are in the Bank's permanent service as on the 1st day of November , 1993 shall get one advance increment in the scale of pay . Officers who are on probation on the 1st day of November, 1993 shall get one advance increment one year after his confirmation;

Provided that an officer who is at the maximum of the scale or who is in receipt of stagnation increment (s ) as on the 1st day of November, 1993 , will draw a Fixed Personal Allowance from the 1st day of November , 1993 which shall be equivalent to an amount of last increment drawn plus dearness allowance payable thereon as on the 1st day of November , 1993 , plus house rent allowance , at such rates as applicable in terms of regulation 13. The Fixed Personal Allowance given hereunder together with House Rent Allowance, if any, shall remain frozen for the entire period of service :

Note :

(i) Fixed Personal Allowance as indicated in (C ) above shall be payable to those officer employees who are provided with Bank's accommodation .

(ii ) Fixed Personal Allowance for officers eligible for House Rent Allowance shall be (A) + (B) + House Rent Allowance drawn by the concerned officer employees when the last increment of the relevant scale of pay as specified in sub -regulation ( 1 ) of regulation 4 is earned.

(iii) The increment component of Fixed Personal Allowance shall rank for superannuation benefits .

An officer who has earned this advance increment shall draw the quantum of Fixed Personal Allowance, as mentioned above , one year after reaching the maximum of the scale . " [PART III-SEC. 4] THE GAZETTE OF INDIA : EXTRAORDINARY

9. In regulation 33 of the principal regulations , for sub- regulation (4) , the following sub - regulation shall be substituted and shall be deemed to have been substituted with effect from the 1st day of November, 1995 , namely : -

"(4) An officer in the Scales set out in column 1 of the Table below shall be entitled to Halting Allowance at the corresponding rates set out in Column 2 thereof :

10. For regulation 38 of the principal regulations , the following regulation shall be substituted , namely : -

" 38. PROVIDENT FUND

(1) Every officer shall become a member of the Provident Fund constituted by the Bank and shall agree to be bound by the rules governing such Fund .

(2) The Bank shall contribute to the Provident Fund in accordance with the rules governing the Provident Fund from time to time , provided that the amount contributed by it shall not be more than:

i) 10 % of 80 % of payfrom 1.11.87 to 31.12.88

ii), 10% of 90 % of pay from 1.1.89 to 31.12.89

iii ) 10 % of pay from 1.1.90 onwards

Provided that the pay, under revised scales effective from the 1st day of July , 1993 , shall apply for Provident Fund Contributions effective from 1st day of November , 1993. "

11. In the principal regulations , for regulation 39, the following regulation shall be substituted, namely : -

"39. ( 1 ) Every officer shall be eligible for gratuity on:

retirement;

(a)

death during his service;

(b)

(d) resignation after completing ten years of continuous service;

[PART III-SEC . 4] (e) termination of service by the Bank in any other way except by way of punishment after completion of ten years of service.

( 2) The amount of gratuity payable to an officer shall be one month's pay for every completed year of service , subject to a maximum of 15 months ' pay;

Provided that where an officer has completed more than 30 years of service , he shall be eligible by way of gratuity for an additional amount at the rate of one half of a month's pay for each completed year of service beyond thirty years ;

Provided further that an officer , who has been absorbed in Exim Bank's service from the Development Bank or any other institutions approved in this behalf by the Chairman & Managing Director , shall be eligible for the gratuity at the rate provided herein above for the period of his service in Development Bank or any such institution prior to the date of his absorption in the Exim Bank provided he had not been paid gratuity for such period by his parent institution.

EXPLANATION :

For the purpose of this regulation , ' Pay' shall mean last drawn pay or payable to the officer concerned , save that in the case of officers who became eligible for gratuity during the period from the 1st day of July, 1993 to 31st day of October , 1994 ( both days inclusive) , ' Pay' shall mean the last drawn pay under Scales of Pay as revised with effect from 1st day of November , 1987 .

21 Explanatory Memorandum

Subsequent to the Sixth Bipartite Settlement , the Central Government has accorded its approval to Export - Import Bank of India on 18.10.95 to modify the pay scales and other service conditions of their officers keeping in view the modifications made by the public sector banks and also to make ad -hoc payments to officers of the Bank .

It is certified that giving retrospective effect to these amendments will not effect adversely the interests of any officer - employee of the Bank.
