है:- सा.का.नि. 231 ( अ ).- राष्ट्रपति द्वारा किया गया निम्नलिखित आदेश सर्वसाधारण की जानकारी के लिए प्रकाशित किया जाता

संविधान ( राजस्व वितरण ) संख्यांक 2 , आदेश, 2004
राष्ट्रपति, संविधान के अनुच्छेद 275 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, वित्त आयोग की सिफारिशों पर विचार करने के पश्चात्, निम्नलिखित आदेश करते हैं, अर्थात्: -
1. इस आदेश का संक्षिप्त नाम संविधान ( राजस्व वितरण ) संख्यांक 2 , आदेश , 2004 है ।
2. साधारण खंड अधिनियम, 1897 ( 1897 का 10 ) इस आदेश के निर्वचन के लिए उसी प्रकार लागू होगा जिस प्रकार वह किसी केन्द्रीय अधिनियम के निर्वचन के लिए लागू होता है ।
3. ( 1.) अनुच्छेद 275 के खंड ( 1 ) के उपबंधों के अनुसार, 1 अप्रैल, 2003 को प्रारंभ होने वाले वित्तीय वर्ष में, नीचे विनिर्दिष्ट राज्यों में से प्रत्येक के लिए राजस्वों में सहायता अनुदान के रुप में, उसके सामने विनिर्दिष्ट राशियां भारत की संचित निधि पर भारित होंगी:-

(2) उपपैरा (1 ) के स्तंभ (2) मे विनिर्दिष्ट राशियां, ग्यारहवें वित्त आयोग द्वारा वर्ष 2003-2004 के लिए सिफारिश की गई रकमों का 85 प्रतिशत है । ग्यारहवें वित्त आयोग ने अपनी अंतिम रिपोर्ट में उपर्युक्त राज्यों के लिए सिफारिश किए गए अनुदान के 15 प्रतिशत को रोक कर और उतना ही अंशदान केंद्रीय सरकार से लेकर एक प्रोत्साहन निधि में जमा करने की सिफारिश की थी, जिसमें से सभी राज्यों को राजवित्तीय निष्पादन के आधार पर अनुदान जारी किए जाएंगे ।
(3) प्रत्येक राज्य के सामने यथा विनिर्दिष्ट निम्नलिखित सहायता अनुदान को, चालू वर्ष के दौरान राज्यों के राजवित्तीय निष्पादन के आधार पर प्रोत्साहन निधि से वर्ष 2001-2002 और 2002-2003 के दौरान निर्मुक्त किया गया था : -

(4) उपपैरा (1 ) और उपपैरा (3) के अधीन संदेय कोई राशि या राशियां, राज्यों को अनुच्छेद 275 के खंड (1 ) के परंतुकों में से प्रत्येक के अधीन संदेय किसी राशि या किन्हीं राशियों के अतिरिक्त होंगी ।

THE CONSTITUTION (DISTRIBUTION OF REVENUES )
No. 2 ORDER, 2004
In exercise of the powers conferred by article 275 of the Constitution, the President, after having considered the recommendations of the Finance Commission, hereby makes the following Order, namely:-
1. This Order may be called the Constitution (Distribution of Revenues ) No. 2 Order, 2004.
2. The General Clauses Act, 1897 (10 of 1897 ), shall apply for the interpretation of this Order as it applies for the interpretation of a Central Act .
3. ( 1) In accordance with the provisions of clause (1 ) of article 275, there shall be charged on the Consolidated Fund of India, in the financial year commencing on the 1st day of April , 2003 , as grants- in - aid of the revenues to each of the States

[PART II -SEC . 3 (i ) ] (2) The sums specified in column (2 ) of sub - paragraph ( 1 ) represent 85 per cent. of the amount recommended by the Eleventh Finance Commission for the year 2003-04. The Eleventh Finance Commission in its last report had recommended withholding of 15 per cent . of the grant recommended to the above States with matching contribution by the Central Government for crediting into an Incentive Fund from which fiscal performance based grants will be released to all the States .
(3) The following grants - in - aid as specified against each State were released during current year from Incentive Fund based on the fiscal performance of States during 2001-02 and 2002-03 :-

(4) Any sum or sums payable under sub - paragraphs ( 1 ) and (3 ) shall be in addition to any sum or sums payable to the States under each of the provisos to clause ( 1 ) of article 275 .
