सा.का.नि. 759(अ).- केन्द्रीय सरकार, सीमाशुल्क अधिनियम , 1962 ( 1962 का 52) की धारा 25 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने पर कि ऐसा करना लोकहित में आवश्यक है, एतद्वारा भारत सरकार के वित्त मंत्रालय (राजस्व विभाग) की अधिसूचना सं0 21 / 2002 - सीमाशुल्क, दिनांक 1 मार्च, 2002 में निम्नलिखित और संशोधन करती है, अर्थात्, -
उक्त अधिसूचना में, -
(i) सारणी में, क्रम संख्या 167 ख तथा इससे संबंधित प्रविष्टियों के बाद, निम्नलिखित क्रम संख्या और प्रविष्टियां अंतःस्थापित की जाएंगी , अर्थात्, -

[PART II SEC. 3(i ) ] (ii) अनुबंध में, -
(क) शर्त संख्या 21 में , शर्त ( ख ) के लिए निम्नलिखित शर्त प्रतिस्थापित की जाएगी , अर्थात्,-
"(ख) आयातित माल का कुल मूल्य टैक्सटाइल गारमेंट्स ( हैण्डलूम गारमेंट्स को छोड़कर) अथवा लेदर गारमेंट्स के पोत- पर्यन्त निःशुल्क मूल्य के 3 प्रतिशत से अधिक नहीं होगा , या पूर्ववर्ती वित्तीय वर्ष के दौरान निर्यात किए गए हैण्डलूम गारमेंट्स के पोत-पर्यन्त निःशुल्क मूल्य का 5 प्रतिशत , जैसा भी मामला हो, तथापि, आयात किए गए लाइनिंग एवं इंटरलाइनिंग सामग्री का मूल्य उक्त कुल मूल्य के 2 प्रतिशत से अधिक नहीं होगा ।"
(ख) शर्त संख्या 21 ख और इससे संबंधित प्रविष्टियों के बाद निम्नलिखित शर्त संख्या और प्रविष्टियां अंतःस्थापित की जाएंगी, अर्थात :-

(क) आयात किए गए माल का कुल मूल्य पूर्ववर्ती वित्तीय वर्ष के दौरान निर्यात किए गए कालीनों के पोत- पर्यन्त निःशुल्क मूल्य के 1 प्रतिशत से अधिक नहीं होगा,
(ख) आयातकर्ता , कालीन निर्यात संवर्धन परिषद से एक प्रमाणपत्र प्रस्तुत करे जो शर्त (क) में उल्लिखित पूर्ववर्ती वित्तीय वर्ष के दौरान किए गए निर्यात के मूल्य को प्रमाणित करता हो तथा इस अधिसूचना के तहत चालू वित्त वर्ष के दौरान पहले से आयातित माल की मात्रा और मूल्य को भी प्रमाणित करता हो । "

G.S.R. 759( E) . In exercise of the powers conferredby sub-section ( 1 ) of section 25 of the Customs Act, 1962 (52 of 1962) , the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue) , No.21 /2002-Customs, dated the 1st March , 2002, namely: -
In the said notification , -
(i ) in the Table, after Sr.No. 167B and the entries relating thereto, the following Sr.No. and entries shall be inserted, namely, -

(ii) in the Annexure, -
(a) incondition No.21 , for condition(b), the folowing condition shall be substituted, namely, - " (b) the total value of goods imported shall not exceed 3 percent of the FOB value oftextile garments ( other than handloom garments) or leather garments , as the case may be, or 5 percent of the FOB value of handloom garments exported during thepreceding financial year; however, the value of lining and inter- lining materials imported shall not exceed 2 percent of the sad total value" .
(b) after condition No.21B and the entries relating thereto, the following condition No. and entries shall be inserted namely, -

(a) the total value of goods imported shall not exceed 1 per cent of the FOB exports of carpets during the preceding financial year;

[PART II-SEC. 3 ( i ) ] (b) the importer produces a Certificate from Carpet Export Promotion Council certifying the value of exports made during the preceding financial year, mentioned in condition (a) , and also the value and quantity of goods already imported under this notification during the current financial year .
