का० आ ० 1292 (अ).- यतः बोडो स्विक्युरिटी फोर्स जिसका परिवर्तित नाम अब नेशनल डेमोक्रेटिक फ्रंट ऑफ बोडोलैंड है ( जिसे इसमें इसके पश्चात एन.डी.एफ.बी. कहा गया है ) का घोषित उद्देश्य पूर्वोत्तर क्षेत्र के अन्य सशस्त्र पृथकतावादी संगठनों से मिलकर बोडोलैण्ड को 'मुक्त कराना ' , जिसके परिणामस्वरूप उक्त क्षेत्र भारत से अलग हो जाए और भारत - बर्मा क्षेत्र की राष्ट्रीय मुक्ति के लिए उस क्षेत्र के समरुचि संगठनों से मिलकर संघर्ष जारी रखना और इस प्रकार बोडोलैण्ड को भारत से अलग कराना है ;
और यतः , केन्द्रीय सरकार की यह राय है कि एन.डी.एफ.बी.--
(i ) पृथक बोडोलैण्ड स्थापित करने के अपने उद्देश्य को अग्रसर करने के लिए, भारत की प्रभुता और क्षेत्रीय अखंडता को विच्छिन्न करने वाले या विच्छिन्न करने का आशय रखने वाले अनेक अवैध और हिंसात्मक क्रियाकलापों में लिप्त रहा है ;
( ii ) पृथक बोडोलैण्ड के सृजन के लिए अन्य विधिविरुद्ध संगमों, जैसे यूनाइटेड लिब्रेशन फ्रंट ऑफ असम और नेशनल सोशलिस्ट काउंसिल ऑफ नागालैण्ड ( इसाक- मुइवाह ) के साथ संबद्ध रहा है;
( iii ) उस अवधि के दौरान भी जब इसे विधिविरुद्ध संगम घोषित किया गया था, अपने ध्येय और उद्देश्य के अनुसरण में कई हिंसक और विधिविरुद्ध क्रियाकलापों में लगा हुआ था, इस प्रकार इसने उसने सरकार के प्राधिकार को नजरअंदाज किया है और जनता में आतंक और संत्रास फैलाया है;
(iv) 1 जनवरी , 2003 से 30 सितम्बर , 2004 की अवधि के दौरान बड़े पैमाने पर हिंसक और आतंकवादी वारदातों में संलिप्त रहा जिनमें वे 167 हत्याएं भी सम्मिलित हैं जो एन.डी.एफ.बी. द्वारा ही की गईं;

[PART II-SEC. 3 (ii)] ( v ) पृथक बोडोलैण्ड के सृजन के लिए वित्त पोषण और योजनाओं के निष्पादन की दृष्टि से फिरौती के लिए अपहरण के कार्यों के अतिरिक्त व्यापारियों , सरकारी अधिकारियों और अन्य नागरिकों से निधियों क़ा उद्यापन करने में संलिप्त रहा;
( vi ) अपने आतंकवादी और विद्रोही क्रियाकलापों को जारी रखते हुए, नए कॉडरों की भर्ती और जिला , आंचलिक और शाखा समितियों के पुनर्गठन के लिए व्यवस्थित अभियान चलाता रहा ;
( vii ) अपने उद्देश्य को प्रमुखता देने वाली तथा केन्द्रीय सरकार पर शोषण का आरोप लगाने वाली और लोगों को तथाकथित मुक्ति संघर्ष में शामिल होने के लिए प्रेरित करने वाली और इस प्रकार उन्हें निष्ठा - विमुख करने वाली गुप्त पत्रिका प्रकाशित करता रहा ;
( viii ) अपने कॉडरों को पुलिस भेदियों/ सरकार के सहयोगियों की सूची तैयार करने के लिए हिदायतें देता रहा जिससे उनके विरुद्ध बदले की कार्रवाई करने के लिए लक्ष्य की पहचान की जा सके;
( ix ) गैर- बोडो लोगों में डर और असुरक्षा फैलाने और उन्हें बोडो क्षेत्रों से प्रवास के लिए मजबूर करने की दृष्टि से हत्याकाण्ड और जातीय हिंसा फैलाने में लिप्त रहा , जिसके परिणामस्वरूप हत्याएं, संपत्ति का विध्वंस और हजारों गैर बोडो लोगों का असम, बोंगईगांव और बरपेटा जिलों में स्थित उनकी रोजी- रोटी और घरों से निर्गमन हुआ; :
(x ) अपने पृथकतावादी क्रियाकलापों को चलाने के लिए देश की सीमा से पार कैंपों और छिपने के ठिकानों की स्थापना करता रहा;
( xi ) पृथक बोडोलैण्ड के सृजन के लिए अपने संघर्ष में शस्त्र और अन्य सहायता प्राप्त करने के लिए अन्य देशों की भारत -विरोधी शक्तियों की सहायता लेता रहा, आदि;
और यतः केन्द्रीय सरकार की यह भी राय है कि पूर्वोक्त कारणों से, एन.डी.एफ.बी. के क्रियाकलाप भारत की प्रभुता और अखण्डता के लिए हानिकर हैं और यह एक विधिविरुद्ध संगम है ;
और यतः केन्द्रीय सरकार की यह भी राय है कि यदि एन.डी.एफ.बी. के विधिविरुद्ध क्रियाकलापों पर नियंत्रण नहीं लगाया जाता है तो संगठन पुनः समूहित हो सकता है और पुनः स्वयं को शस्त्र से सज्जित रख सकता है, नई भर्तियां कर सकता है, हिंसा, आतंकवादी और पृथकतवादी क्रियाकलापों में लग सकता है, निधि आदि का संचय कर सकता है और निर्दोष नागरिकों तथा सुरक्षा बलों के कार्मिकों के जीवन के लिए खतरा पैदा कर सकता है और इसलिए ऐसी परिस्थितियां विद्यमान हैं जिनसे एन.डी.एफ.बी. को तात्कालिक प्रभाव से, विधि विरुद्ध संगम घोषित किया जाना आवश्यक हो जाता है ;
अतः , अब, केन्द्रीय सरकार, विधिविरुद्ध क्रियाकलाप ( निवारण ) अधिनियम, 1967 ( 1967 का 37 ) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , नेशनल डेमोक्रेटिक फ्रंट ऑफ बोडोलैण्डको विधिविरुद्ध संगम घोषित करती है ;

केन्द्रीय सरकार की यह भी राय है कि एन.डी.एफ.बी. को तात्कालिक प्रभाव से, विधिविरुद्ध संगम घोषित किया जाना आवश्यक है और तदनुसार, केन्द्रीय सरकार , उक्त अधिनियम की धारा 3 की उपधारा ( 3 ) के परंतुक द्वारा प्रदत्त शक्तियों का उपयोग करते हुए, यह निदेश देती है कि यह अधिसूचना किसी ऐसे आदेश के अधीन रहते हुए, जो उक्त अधिनियम की धारा 4 के अधीन किया जा सकेगा , सरकारी राजपत्र में इसके प्रकाशन की तारीख से प्रभावी होगी ।

NOTIFICATION
New Delhi , the 23rd November, 2004
S. O. 1292 (E). Whereas , the Bodo Security Force since rechristened as National Democratic Front of Boroland (hereinafter referred to as the NDFB ) has as its professed aim , the " Liberation " of Bodoland resulting in bringing about the secession of the said areas from India, in alliance with other armed secessionist organisations of the North East Region and to carry on struggle for the national liberation of the Indo- Burma region in alliance with like-minded organisations of that region and thereby , the secession of Bodoland from India;
AND WHEREAS , the Central Government is of the opinion that the NDFB has-
(i) indulged in various illegal and violent activities intended to disrupt or which disrupt the sovereignty and territorial integrity of India in furtherance of its objective of achieving a separate Bodoland;

[PART II-SEC. 3 (ii)] (ii) aligned itself with other unlawful associations like the United Liberation Front of Asom and the National Socialist Council of Nagaland ( Isac - Muviah) to create a separate Bodoland;
(iii) in pursuance of its aims and objectives , engaged in several unlawful and violent activities during the period when it had been declared as an unlawful association, thereby undermining the authority of the Government and spreading terror and panic among the people ;
(iv) indulging in large scale violent and terrorist incidents including 167 killings attributed to the NDFB during the period from 1st January , 2003 to 30th September , 2004 ;
(v) indulging in extortions of money from businessmen, Government officials and other civilians in addition to acts of kidnapping for ransom with a view to finance and execute plans for creation of a separate Bodoland;
(vi) embarking on a systematic drive for recruitment of fresh cadres and revamping the district, anchalik and sakha committees , while continuing its terrorist and insurgency activities ;
(vii) publishing clandestine magazines highlighting the goal of the outfit and alleging exploitation by the Central Government and inciting the people to join the so -called liberation struggle thereby subverting their loyalties ;
(viii) instructing its cadres to compile the list of police informers/Government collaborators to identify targets for retaliatory action against them;

(ix) carnage and ethnic violence resulting in killings , destruction of property and exodus of thousands of non- Bodos inhabiting in Bodo dominated areas in Assam from Bongaigaon and Barpeta districts with a view to spread panic and insecurity among non-Bodos and forcing them to migrate from Bodo areas ;
(x) establishing camps and hideouts across the Country's border to carry out its secessionist activities ;
(xi) obtaining assistance from anti - India forces in other Countries to procure arms and other assistance in their struggle for creation of a separate Bodoland;
AND WHEREAS , the Central Government is also of the opinion that for the reasons aforesaid , the activities of the NDFB are detrimental to the sovereignty and integrity of India and that it is an unlawful association;
AND WHEREAS , the Central Government is also of the opinion that unless the unlawful activities of the NDFB are kept under control , the organization may re-group and re - arm itself, make fresh recruitments , indulge in violent, terrorist and secessionist activities , collect funds and endanger the lives of innocent citizens and security forces personnel ; and therefore , circumstances do exist which render it necessary to declare the NDFB as an unlawful association with immediate effect;

[PART II-SEC. 3 (ii)] NOW, THEREFORE , in exercise of the powers conferred by sub- section ( 1 ) of section 3 of the Unlawful Activities (Prevention) Act, 1967 ( 37 of 1967) , the Central Government hereby declares the National Democratic Front of Boroland (NDFB) to be an unlawful association;
The Central Government, is of further opinion that it is necessary to declare the NDFB to be an unlawful association with immediate effect and accordingly , in exercise of the powers conferred by the proviso to sub -section (3 ) of section 3 of the said Act, the Central Government hereby directs that this notification shall , subject to any order that may be made under section 4 of the said Act, have effect from the date of its publication in the Official Gazette .
