सा.का.नि. 765 (अ).- चूना पत्थर और डोलोमाइट खान श्रम कल्याण निधि नियम, 1973 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप, चूना - पत्थर और डोलोमाइट खान श्रम कल्याण निधि अधिनियम, 1972 ( 1972 का 62) की धारा 16 की उपधारा ( 1 ) की अपेक्षानुसार भारत के राजपत्र, असाधारण, भाग 2 , खंड 3 , उपखंड(i) तारीख 19 मई, 2004 में भारत सरकार के श्रम मंत्रालय की अधिसूचना सं. सा.का.नि. 337(अ) , तारीख 19 मई, 2004 के अधीन प्रकाशित किए गए थे जिसके द्वारा ऐसे सभी व्यक्तियों से जिनके उससे प्रभावित होनें की संभावना थी, उस तारीख से, जिसको उस राजपत्र की प्रतियां, जिसमें उक्त अधिसूचना प्रकाशित की गई थी, जनता को उपलब्ध करा दी गई थीं, पैंतालीस दिन की अवधि के भीतर आक्षेप और सुझाव आमंत्रित किए गए थे ;
और उक्त राजपत्र जनता को 19 मई , 2004 को उपलब्ध करा दिया गया था ;
और केन्द्रीय सरकार को उक्त प्रारूप के संबंध में किसी व्यक्ति से कोई आक्षेप या सुझाव प्राप्त नहीं हुआ है ;
अतः अब केन्द्रीय सरकार, चूना पत्थर और डोलोमाइट खान श्रम कल्याण निधि अधिनियम, 1972 की धारा 16 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , चूना पत्थर और डोलोमाइट खान श्रम कल्याण निधि नियम, 1973 का और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात् : -
नियम
1. (1 ) इन नियमों का संक्षिप्त नाम चूना पत्थर और डोलोमाइट खान श्रम कल्याण निधि (संशोधन) नियम, 2004 है ।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. चूना- पत्थर और डोलोमाइट खान श्रम कल्याण निधि नियम, 1973 (जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 32 के स्थान पर निम्नलिखित नियम रखा जाएगा, }
अर्थात् : -
"32. औषधालय या अस्पताल का निरीक्षण चूना पत्थर या डोलोमाइट खानों के स्वामियों द्वारा चलाए जाने वाले औषधालय या अस्पताल का निरीक्षण वार्षिक रूप से उस क्षेत्र के कल्याण आयुक्त और ज्येष्ठतम चिकित्सा अधिकारी द्वारा संयुक्त रूप से किया जाएगा । यदि औषधालय या अस्पताल, यथास्थिति, श्रम कल्याण संगठन के औषधालयों या अस्पतालों के विहित स्तर मानकों के अनुरूप है तो वे प्रारूप क में एक प्रमाणपत्र जारी करेंगे जो जारी किए जाने की तारीख से एक वर्ष की अवधि पर्यन्त विधिमान्य होगा ।"
3. उक्त नियमों के नियम 35 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्: -
"35. प्रसूति केन्द्र का निरीक्षण चूना पत्थर या डोलोमाइट खानों के स्वामियों द्वारा चलाए जाने वाले प्रसूति केन्द्र का निरीक्षण वार्षिक रूप से उस क्षेत्र के कल्याण आयुक्त और चिकित्सा अधिकारी द्वारा संयुक्त रूप से किया जाएगा । यदि प्रसूति केन्द्र श्रम कल्याण संगठन के प्रसूति केन्द्र के विहित स्तर मानकों के अनुरूप है तो वे प्रारूप ख में एक प्रमाणपत्र जारी करेंगे जो जारी किए जाने की तारीख से एक वर्ष की अवधि पर्यन्त विधिमान्य होगा ।"
4. उक्त नियमों के नियम 37 के उपनियम (1 ) के खंड (2) में, " बीस पैसे " शब्दों के स्थान पर, "चालीस पैसे " शब्द रखे जाएंगे ।

NOTIFICATION
New Delhi , the 24th November, 2004
G.S.R. 765(E) .- Whereas the draft of certain rules further to amend the Limestone and Dolomite Mines Labour Welfare Fund Rules , 1973 , was published , as required by sub - section ( 1 ) of the section 16 of the Limestone and Dolomite Mines Labour Welfare Fund Act , 1972 (62 of 1972 ) in the Gazette of India , Extraordinary , Part- II , Section 3 , Sub- section ( i ) dated the 19th May , 2004 under the notification of Government of India in the Ministry of Labour , number G.S.R. 337 ( E) , dated the 19th May , 2004 , inviting objections and suggestions from all persons likely to be affected thereby within a period of forty five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
And whereas , the said Gazette was made available to the public on the 19th May, 2004;
And whereas , no objection or suggestion has been received from any person on the said draft by the Central Government;
Now, therefore , in exercise of the powers conferred by section 16 of the Limestone and Dolomite Mines Labour Welfare Fund Act , 1972 the Central Government hereby makes the following rules further to amend the Limestone and Dolomite Mines Labour Welfare Fund Rules , 1973 , namely : -
RULES.
1. (1) These rules may be called the Limestone and Dolomite Mines Labour Welfare Fund (Amendment) Rules , 2004.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. For rule 32 of the Limestone and Dolomite Mines Labour Welfare Fund Rules, 1973 ( hereinafter referred to as the said rules) , the following rule shall be substituted , namely: -
"32. Inspection of dispensary or hospital The dispensary or hospital maintained by owners of THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II -SEC . 3 (1 ) ]
They Limestone or Dolomite Mines shall be inspected annually by the Welfare Commissioner of the region and the Senior Most Medical Officer jointly . shall , if the dispensary or hospital conforms to the prescribed standard of the dispensaries or hospitals of the Labour Welfare Organisation , as the case may be , issue a certificate in Form A which shall be valid for a period of one year from the date of the issue . "
3. In the said rules , for rule 35 , the following rule shall be substituted , namely: -
"35. Inspection of maternity centre The maternity centre maintained by owners of Limestone or Dolomite Mines shall be inspected annually by the Welfare Commissioner of the region and the Senior Most Medical Officer jointly . They shall , if the maternity centre conforms to the prescribed standard of the maternity centre of the Labour Welfare Organisation , issue a certificate in Form B which shall be valid for a period of one year from the date of the issue."
4. In the said rules , in rule 37 , in sub - rule (1 ) , in clause (2) for the words " twenty paise " , the words " forty paise" shall be substituted .
