सा.का.नि. 771 (अ). केन्द्र सरकार, महा पत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 132 की उप- धारा ( 1 ) के साथ पठित धारा 124 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों को प्रयोग करते हुए, इस अधिसूचना के साथ संलग्नित तूत्तुक्कुडि पत्तन न्यास कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) पाँचवाँ संशोधन विनियम, 2004 का अनुमोदन करती है ।
2. उक्त विनियम , सरकारी राजपत्र में इस अधिसूचना के प्रकाशन होने की तारीख से प्रवृत्त होंगे ।
अनुसूची
तूत्तुक्कुडि पत्तनन्यास
तूत्तुक्कुडि पत्तन न्यास कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) पाँचवाँ संशोधन विनियम , 2004
महा पत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 28 द्वारा प्रदत्त शक्तियों को प्रयोग करते हुए, तूत्तुक्कुडि पत्तन के न्यासी बोर्ड, उक्त अधिनियम की धारा 124 के अधीन, केन्द्र सरकार के अनुमोदन के साथ तूत्तुक्कुडि पत्तन कर्मचारी ( वर्गीकरण, नियंत्रण और अपील ) विनियम, 1979 [ भारत के राजपत्र में दिनांक 1 मार्च, 1979 को प्रकाशित सा.का. नि. 101 ( अ ) ] , को आगे संशोधन करने हेतु निम्नलिखित विनियम बनाते हैं :-
1. लघु शीर्ष एवं प्रारंभ: ( i ) ये विनियम तूतुक्कुडि पत्तन कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) पाँचवाँ संशोधन विनियम, 2004 क़हे जायेंगे ।
(ii ) ये सरकारी राजपत्र में प्रकाशन होने की तारीख से प्रवृत्त होंगे ।
2. टी पी ई (सी सी ए) विनियम, 1979 के विनियम 7 में, उप- विनियम 7 के बाद, उप -विनियम 8 एवं 9 के रूप में निम्नानुसार दो विनियम समाविष्ट किये जाएंगे :-
(8) इस नियम के अधीन जारी या जारी जैसा समझा गया निलम्बन आदेश पर, निलम्बन आदेश की तारीख से नब्बे दिन के समाप्त होने से पहले , निलम्बन को परिवर्तित करने या प्रतिसंहरण करने के उद्देश्य के लिए गठित समीक्षा समिति की सिफारिश पर, सक्षम प्राधिकारी द्वारा परिवर्तित या प्रतिसंहरण किया जाएगा और निलम्बन को आगे बढ़ाना या प्रतिसंहरण करने का आदेश पारित करेगा । बाद की समीक्षायें, निलम्बन की बढ़ायी गयी अवधि की समाप्ति से पहले की जाएगी । निलम्बन की अवधि को एक समय पर एक सौ अस्सी दिनों से ज्यादा के लिए नहीं बढ़ायी जानी चाहिए ।

[PART II-SEC. 3(i ) ] (9 ) उप- विनियम, 6 एवं 7 में, निहित बातों के होते हुए, इस विनियम के उप- विनियम ( 1 ) से ( 3 ) के अधीन जारी या जारी जैसे समझे गये निलम्बन आदेश की वैधता नब्बे दिनों की अवधि के बाद नहीं होगी, जब तक कि नब्बे दिनों की समाप्ति से पहले अवधि को और बढ़ाने के लिए समीक्षा करते हुए बढ़ायी गयी हो ।
3. टीपीई ( सी सी ए ) विनियम , 1979 के विनियम 10 के अद्यतन उप - विनियम ( 2 ) में निम्नलिखित प्रतिस्थापित किये जाऐंगे: - जब कभी भी अनुशासनिक प्राधिकारी का यह मत है कि किसी भी कर्मचारी के विरुद्ध तूत्तुक्कुडि पत्तन कर्मचारी ( आचरण ) विनियम, 1979 में अपेक्षितानुसार किसी भी प्रकार के आरोपण या दुराचरण या कदाचार में सच्चाई जानने के लिए पूछताछ करने के कारण है , तो, उसकी सच्चाई जानने के लिए वे खुद पूछताछ कर सकते हैं या राज्य या केन्द्र सरकार, सार्वजनिक उपक्रम या किसी पत्तन में कार्यरत या सेवानिवृत्त हुए कर्मचारी को शामिल करते हुए एक प्राधिकारी को नियुक्त कर सकते हैं ।

G.S.R. 771 ( E) .-In exercise of the powers conferred by Sub- section ( i) of Section 124 , read with Sub- Section ( 1 ) of Section 132 of the Major Port Trusts Act , 1963 (38 of 1963 ) , the Central Government hereby approves the Tuticorin Port Employees ( Classification , Control and Appeal ) Fifth Amendment Regulations , 2004, as annexed to this notification.
2. The said Regulations shall come into force on the date of publication of this notification in the Official Gazette .

TUTICORIN PORT TRUST
TUTICORIN PORT EMPLOYEES ( CLASSIFICATION CONTROL AND APPEAL) (FIFTH) AMENDMENT REGULATIONS, 2004
In exercise of the powers conferred by Section 28 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Board of Trustees for the Port of Tuticorin hereby makes the following Regulations further to amend the Tuticorin Port Employees (Classification, Control and Appeal ) Regulations , 1979 , [ Published as G.S.R. 101 (E ) in the Gazette of India Extraordinary, dated the 1st March , 1979) , subject to approval of the Central Government under Section 124 ibid.
1. Short title and commencement : ( i) These Regulations maybe called the Tuticorin Port Employees ( Classification, Control and Appeal ) Fifth Amendment Regulations , 2004 .
(ii) They shall come into force with effect from the date of publication in the Gazette of India .
2. In Regulation 7 of TPE ( CCA) Regulations , 1979, two sub -regulations shall be incorporated after sub - regulation 7 as sub - regulations 8 & 9 as below :-
(8) An order of suspension made or deemed to have been made under this rule shall be reviewed by the authority competentto modify or revoke the suspension , before expiry of ninety days from the date of order of suspension , 3

on the recommendation of the Review Committee constituted for the purpose and pass order either extending or revoking the suspension. Subsequent reviews shall be made before expiry of the extended period of suspension . Extension of suspension shall not be for a period exceeding one hundred and cighty days at a time .
(9) Notwithstanding anything contained in Sub - regulations 6 and 7 , an order of suspension made or deemed to have been made under Sub - regulations ( 1 ) to (3 ) of this Regulation shall not be valid after a period of ninety days unless it is extended after review, for a further period before the expiry of ninety days.
3. The existing Sub - regulation (2 ) of Regulation 10 of TPE (CCA) Regulations , 1979 shall be substituted with the following:-
Whenever the Disciplinary Authority is of the opinion that there are grounds for inquiring into the truth of any imputations or misconduct or misbehaviour, as contemplated in the Tuticorin Port Employees (Conduct ) Regulations , 1979 against an employee, it may itself inquire into or appoint an authority, including any serving or retired official ofthe State or Central Government , Public Sector Undertaking or any Port , to inquire into the truth thereof.
