सा.का.नि. 780(अ) .- औषधि और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23 ) की पहली अनुसूची का और संशोधन करने के लिए एक प्रारूप, उक्त अधिनियम की धारा 33- ण की अपेक्षानुसार, भारत के राजपत्र, असाधारण, भाग II , खण्ड 3, उपखण्ड ( i ) , तारीख 31 जनवरी, 2003 में भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय की अधिसूचना में, ऐसे सभी व्यक्तियों से, जिनके उससे प्रभावित होने की संभावना थी, आक्षेप और सुझाव आमंत्रित करते हुए प्रकाशित किया गया था और यह सूचना दी गई थी कि उक्त प्रारूप पर उस तारीख से, जिसको उस राजपत्र की प्रतियां, जिसमें उक्त अधिसूचना प्रकाशित की गई थी जनता को उपलब्ध करा दी जाती हैं, 3 मास की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;
और उक्त राजपत्र की प्रतियां जनता को तारीख 31 जनवरी, 2003 को उपलब्ध करा दी गई थीं;
और उक्त प्रारूप पर जनता से कोई आक्षेप और सुझाव प्राप्त नहीं हुए हैं;
अतः , अब , केन्द्रीय सरकार, उक्त अधिनियम की धारा 33 - ण द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, आयर्वेदिक, सिद्धा और यूनानी औषधि तकनीकी सलाहकार बोर्ड से परामर्श के पश्चात् उक्त अधिनियम की पहली अनुसूची में निम्नलिखित और संशोधन करती है, अर्थात्: - उक्तअधिनियम की पहली अनुसूची में " ख- यूनानी तिब्बूप्रणाली " शीर्ष के अधीन,-
(क) क्रम सं. 13 के सामने प्रविष्टि में " ( भाग 1 ) " कोष्ठकों, शब्द और अंक का लोप किया जाएगा; और
( ख ) क्रम सं . 13 और उससे संबंधित प्रविष्टि के पश्चात् निम्नलिखित क्रम सं. और प्रविष्टि अंतःस्थापित की जाएगी , अर्थात्:-
* 14 भारत का यूनानी फारमेकोपिया" ।

तारादत्त, संयुक्त सचिव पाद टिप्पण : मूल नियम राजपत्र में अधिसूचना सं. एफ- 28-10/45 - एच ( 1 ) तारीख 21-12-1945 द्वारा प्रकाशित किए गए थे और इनमें अन्तिम संशोधन सं. सा.का.नि. 185 ( अ ) तारीख 9-3-2004 द्वारा किया गया था ।

NOTIFICATION

G.S.R. 780 (E) . Whereas a draft further to amend the First Schedule to the Drugs and Cosmetics Act , 1940 (23.of 1940) was published as required by Section 33-0 of the said Act in the notification of the Government of India in the Ministry ofHealth and Family Welfare No. G.S.R. 72 ( E) dated the 31st January, 2003 , in the Gazette of India Extraordinary Part II , Section 3 , Sub - section ( i ) dated 31st January, 2003 inviting objections and suggestions from persons likely to be affected thereby and notice was given that the said draft will be taken into consideration after the expiry of a period of 3 months from the date on which copies of the Official Gazette containing the said notification were made available to the public.
Andwhereas the said Gazette was made available to the public on the 31st January, 2003 ;
And whereas no objections and suggestions have been received from the public on the said draft .
Now, therefore , in exercise of the powers conferred by Section 33 -O of the said Act, the Central Government , after consultation with the Ayurvedic , Siddha and Unani Drugs Technical Advisory Board hereby makes the following further amendment in the First Schedule to the said Act , namely :-
In the First Schedule to the said Act, under the heading "B - Unani Tibb System, -- "
(a) in the entry, the brackets , word and figure " (Part I ) " appearing against serial No. 13 shall be omitted; and (b) after serial No. 13 , and the entry relating thereto, the following serial No. and the entry shall be inserted , namely:---
" 14 Unani Pharmacopoeia of India. "
