का.आ. 1311 (अ).- पूर्त विन्यास अधिनियम, 1890 (1890 का 6) की धारा 4 एवं 5 के द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए और सचिव, भारत सरकार, मानव संसाधन विकास मंत्रालय, महिला एवं बाल विकास विभाग के आवेदन पर, उक्त सचिव की सहमति से केन्द्र सरकार तत्कालीन समाज कल्याण विभाग के दिनांक 2 मार्च, 1979 के का.आ. 120 (अ) (यहां से आगे इसे उक्त अधिसूचना कहा जाएगा) में राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से प्रभावी होने वाले निम्नोक्त संशोधन करती है:-
उक्त अधिसूचना की अनुसूची ' ख' में, -
(क) पैरा 1 को निम्नोक्त पैरा से प्रतिस्थापित किया जाएगा : -
"I. राष्ट्रीय बाल निधि (जिसे इसमें इसके पश्चात् निधि कहा गया है) के उद्देश्य निम्नलिखित होंगे : - (i) व्यक्तियों, संस्थाओं , निगमित निकायों तथा अन्य से निधि उगाहना ।
(ii) प्राकृतिक आपदाओं, विध्वंस से प्रभावित , तंगहाल एवं कठिन परिस्थितियों में जीवन- यापन करने वाले बच्चों के लिए विभिन्न कार्यक्रमों को स्वैच्छिक अभिकरणों , राज्य सरकारों के माध्यम से बढ़ावा तथा निधि देना ; दिनांक 9 फरवरी , 2004 को भारत सरकार, महिला एवं बाल विकास विभाग द्वारा अधिसूचित राष्ट्रीय बाल चार्टर, 2003 के अनुसरण में जनजातीय एवं दूरवर्ती क्षेत्रों सहित वंचित तथा अल्प लाभान्वित क्षेत्रों में और कैदियों के बच्चों, दंगा एवं आक्रमण प्रभावित बच्चों, अवैध व्यापार प्रभावित बच्चों तथा वेश्याओं के बच्चों सहित कठिन परिस्थितियों में जीवन - यापन करने वाले बच्चों के लिए ;
(iii) विभिन्न कार्यक्रमों को कार्यान्वित करना ;
(iv) अन्य सभी ऐसे कार्य करना, जो उपर्युक्त उद्देश्यों के आनुषंगिक और साधक हों ।
(ख) पैरा 3 को निम्नलिखित पैरा से प्रतिस्थापित किया जाएगा ; अर्थात्

[PART II SEC. 3 ( ii)] 3. निधि की निधियों के प्रबंधन और प्रशासन के लिए एक प्रबंधन बोर्ड (जिसे इसमें इसके पश्चात् बोर्ड कहा गया है) गठित किया जाएगा, जिसमें निम्नलिखित सदस्य होंगे, अर्थात्:-

)عل( पैरा 4 में 'सात सदस्यौं शब्दों को' पांच सदस्यौं शब्दों से प्रतिस्थापित किया जाएगा ।
(घ) पैरा 8 में उप- पैरा ( ⅰ) को निम्नलिखित उप- पैरा से प्रतिस्थापित किया जाएगा, अर्थात्:-
" ( i) बोर्ड निधि के कार्यकारी अध्यक्ष की अध्यक्षता में कार्यकारी समिति का गठन करेगा, जिसमें बोर्ड से लिये जाने वाले सदस्यों की संख्या 4 से अधिक नहीं होगी, जिनमें निधि के सचिव कोषपाल शामिल होंगे, ताकि प्रत्येक मामले में निधि से पांच लाख रुपये तक की वित्तीयं सहायता मांगने वाले आवेदनों का निपटान किया जा सके "
(ड.) पैरा 9 को हटा दिया जाएगा ।
(
च) पैरा 10 और 11 को निम्नलिखित पैरा से प्रतिस्थापित किया जाएगा ; अर्थात्
" 10. बोर्ड किन्हीं शर्तों एवं सीमाओं के अधीन अपनी किसी एक अथवा सभी शक्तियों को निधि की कार्यकारी समिति या कार्यकारी अध्यक्ष को प्रत्यायोजित कर सकता है ।
11. बोर्ड , अपनी शक्तियों में से ऐसी शक्तियों को भी, जो बोर्ड की राय में दैनंदिन प्रशासनिक कार्य मात्र हैं, और जो विवेकाश्रित नहीं हैं, कार्यकारी अध्यक्ष को प्रत्यायोजित कर सकता है ।" 3

(छ) पैरा 13 को निम्मलिखित पैरा से प्रतिस्थापित किया जाएगा ; अर्थात्
" 13. सभी संविदाएं और अन्य आश्वासन बोर्ड के नाम में होंगे और उसकी ओर से कार्यकारी अध्यक्ष तथा सचिव-कोषपाल द्वारा हस्ताक्षरित होंगे ।"
(ज) पैरा 15 हटा दिया जाएगा ;
(झ) पैरा 18 निम्नलिखित पैरा से प्रतिस्थापित किया जाएगा, अर्थात्
" 16. अलाभकारी संस्थाएं , स्वैच्छिक संगठन, धर्मार्थ न्यास, पंचायतों सहित स्थानीय निकाय, व्यक्ति, राज्य सरकारें तथा संघ राज्य क्षेत्र प्रशासन इस निधि के उद्देश्यों की पूर्ति हेतु वित्तीय सहायता के लिए आवेदन करने के पात्र हैं ।"
(भ) पैश 17 में 'स्वैच्छिक संगठन शब्द 'स्वैच्छिक संगठनों, राज्य सरकारों, संघ राज्य क्षेत्र प्रशासनों, धर्मार्थ ग्वालों, स्थानीय निकायों तथा व्यक्तियाँ शब्दों से प्रतिस्थापित किया जाएगा ;
(८) पैरा 18 हटा दिया जाएगा ;
(ठ) पैरा 19 निम्नलिखित पैरा से प्रतिस्थापित किया जाएगा, अर्थात्
19. निधि से प्रदान की जाने वाली वित्तीय सहायता की कोई अधिकतम सीमा नहीं होगी, बशर्ते ऐसी सहायता तब तक पांच लाख रुपये से अधिक प्रदान नहीं की जाएगी, जब तक कि उसे बोर्ड का अनुमोदन प्राप्त न हो और उसका विवरण किसी राष्ट्रीय दैनिक समाचार- पत्र में प्रकाशित न किया गया हो ।
(ड) पैरा 20,21,22 और 23 हटा दिए जाएंगे ;
(ब) पैरा 24 और 25 को निम्नलिखित पैरा से प्रतिस्थापित किया जाएगा, अर्थात्
'24. अनुदान को रोकने की शक्ति बोर्ड के अध्यक्ष के पास यह शक्ति होगी कि वह सचिव- कोषपाल की सिफारिश पर निधि के अंतर्गत अनुमोदित, किन्तु संवितरित न किए गए अनुदान को रोक सकेगा अथवा उसे कम कर सकेगा, बशर्ते कि अनुदान रोके जाने की इस कार्रवाई के विषय में बोर्ड को सूचित किया जाए ।
25. वित्तीय सहातया की शर्तें वित्तीय सहायता की शर्तें , यथास्थिति, कार्यकारी समिति अथवा बोर्ड के द्वारा वित्तीय सहायता अनुदान के आवेदन को अनुमोदित करते समय निर्धारित की जाएंगी । (ण) पैरा 26, 27 एवं 28 हटा दिये जायेंगे । THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II-SEC.3 (ii) ] (त) पैरा 29, 30, 31 तथा 32 को निम्नलिखित पैरा से प्रतिस्थापित किया जाएगा, अर्थात्
'सदस्यता की अवधि-
(1 ) बोर्ड एवं कार्यकारी समिति के नामित सदस्य का कार्यकाल दो वर्ष होगा, परन्तु कोई भी सदस्य बोर्ड के सदस्य के कार्यकाल से अधिक समय तक कार्यकारी समिति का सदस्य नहीं रहेगा । (2) बोर्ड एवं कार्यकारी समिति के सदस्य की सदस्यता त्याग- पत्र देने घर, मृत्यु होने या पागल होने या दिवालिया होने या भ्रष्टता सहित दण्डनीय अपराधों के लिए न्यायालय द्वारा सजा देने पर समाप्त हो जाएगी ।
(3) सदस्य द्वारा त्याग - पत्र बोर्ड के अध्यक्ष को दिया जाएगा और त्याग- पत्र इसकी स्वीकृति की तारीख या त्याग-पत्र देने के 30 दिन की समाप्ति पर, जो भी पहले हो, प्रभावी माना जाएगा ।
30. बोर्ड के रिक्त पद बोर्ड के रिक्त पद उसी तरीके से भरे जाएंगे , जिस तरह से प्रारम्भ में इसका गठन हुआ था ।
31. बोर्ड की बैठक - बोर्ड निधि के लेन- देन के लिए आवश्यकतानुसार किन्तु वर्ष में कम से कम एक बैठक का आयोजन करेगा ।
32. सचिव - कोषपाल की शक्तियां एवं कार्य सचिव कोषपाल के कार्य इस प्रकार होंगे :
(क) वह बोर्ड के सभी रिकार्डों का अभिरक्षक होगा ।
(ख) वह बोर्ड की ओर से सभी सरकारी पत्राचार करेगा ।
(ग) वह बोर्ड की बैठक बुलाने के लिए नोटिस जारी करेगा ।
(ঘ) वह बोर्ड की सभी बैठकों के कार्यवृत्त रखेगा ।
(ड. ) वह खातों के रख- रखाव के लिए निधि की राशि तथा सम्पत्ति का प्रबन्धन करेगा और बोर्ड की ओर से सभी संविदाओं का निष्पादन करेगा ।
(च) वह बोर्ड द्वारा सौंपे गए सभी कर्तव्यों का निष्पादन करेगा और दी गई शक्तियों का वहन करेगा 1
(थ) पैरा 33 में उप-पैरा (2) को हटा दिया जाएगा । 5

(द) पैरा 34 को निम्नलिखित पैरा से प्रतिस्थापित किया जाएगा, अर्थात्
'34- राशि का आबंटन निधि वित्तीय वर्ष के दौरान अपने उद्देश्यों की पूर्ति करने वाली गतिविधियों के लिए वित्तीय सहायता प्रदान करने के लिए अपने निवेशों पर पिछले वित्तीय वर्ष के दौरान अर्जित ब्याज एवं प्राप्त दान का 50 प्रतिशत ही खर्च कर सकेगा ।
किन्तु जब निधि को प्राप्त दान में दानकर्ता द्वारा यह अपेक्षित हो कि यह पूरा दान निर्धारित समय सीमा में ही खर्च करना है, तब पिछले वित्तीय वर्ष के दौरान प्राप्त दान का 50 प्रतिशत खर्च करने का प्रतिबन्ध प्रभावी नहीं होगा ।
(घ) पैरा 35,36,37,38,39 एवं 40 को निम्नलिखित पैरा से प्रतिस्थापित किया जाएगा, अर्थात् '35-राशि को जमा करना निधि की सभी राशियां भारत सरकार द्वारा इस सम्बन्ध में अनुमोदित किसी भी अनुसूचित बैंक में खोले गए खाते में जमा की जाएंगी ।
36. राशि की निकासी निधि के खाते से राशियों की निकासी बोर्ड द्वारा निर्धारित विधि से ही संचालित की जाएगी । यदि निकाली जाने वाली राशि एक लाख रुपये ( 1,00,000/-रुपये) से अधिक हो , तो ऐसी निकासी सचिव- कोषपाल द्वारा हस्ताक्षरित चैक या मांग फार्म द्वारा की जाएगी । यदि निकाली जाने वाली राशि एक लाख रुपये से अधिक है, तो चैक या मांग फार्म सचिव-कोषपाल तथा बोर्ड द्वारा नामित बोर्ड के किसी अन्य सदस्य द्वारा हस्ताक्षरित होगा ।
37. प्रशासनिक व्यय : निम्नलिखित के सम्बन्ध में व्यय किसी भी वरिष्ठ प्राधिकारी के अनुमोदन के बिना सचिव- कोषपाल द्वारा निधि से किया जा सकेगा
(i ) प्राधिकृत वेतनमान में संस्वीकृत कर्मचारियों को वेतन का भुगतान (ii) लेखा परीक्षा शुल्क ( iii) निधि पर किसी भी प्रकार का कर या सांविधिक देय राशि (iv ) बोर्ड द्वारा अनुमोदित दरों एवं मान के अनुसार बोर्ड के कर्मचारियों अथवा सदस्यों को यात्रा भत्ता तथा महंगाई भत्ता और वार्षिक रिपोर्ट तैयार करने एवं छपाई से संबंधित व्यय (v) मुकद्दमों से संबंधित खर्च (vi) प्रशासनिक प्रकृति की अन्य मदों पर व्यय बोर्ड द्वारा अनुमोदित वार्षिक राशि या पिछले वित्तीय वर्ष के दौरान संवितरित राशि के 10 प्रतिशत तक सीमित होगा ।
38. कर्मचारियों की नियुक्ति (1 ) बोर्ड अपने कर्तव्यों के निर्वहन के लिए आवश्यकतानुसार कर्मचारियों की नियुक्ति कर सकेगा । (2) कर्मचारियों की सेवा की शर्तें बोर्ड द्वारा निर्धारित की जाएंगी । 6

[PART II-SEC.3 (ii)] 39 . बोर्ड के सदस्यों को पारिश्रमिक-
(1 ) बोर्ड के सदस्यों को बोर्ड द्वारा निर्धारित दरों पर यात्रा एवं दैनिक भत्तों के अलावा कोई अन्य पारिश्रमिक नहीं दिया जाएगा ।
(2) बोर्ड के शासकीय सदस्य उन्हें लागू दरों पर जहां से वह अपना वेतन लेते हैं, वहीं से यात्रा एवं दैनिक भत्ता लेंगे ।
(3) निधि के अधिकारी एवं कर्मचारी लागू नियमों के अंतर्गत उन्हें अधिकृत या बोर्ड द्वारा प्राधिकृत पारिश्रमिक एवं यात्रा तथा दैनिक भत्ते ले सकते हैं ।
40. वार्षिक रिपोर्ट बोर्ड के अनुमोदन से सचिव कोषपाल वार्षिक रिपोर्ट तैयार करेगा । इस रिपोर्ट में निधि के खातों को बोर्ड द्वारा नियुक्त सनदी लेखपालों की फर्म द्वारा लेखा परीक्षित किया जाएगा । यह फर्म इस आशय का प्रमाण - पत्र देगी कि निधि का व्यय निधि के उद्देश्यों के अनुसार किया गया है । यह रिपोर्ट भारत सरकार को प्रस्तुत की जाएगी ।
(न) पैरा 41 को हटा दिया जाएगा ।

NOTIFICATION
New Delhi, the 24th November , 2004
S.O.1311 (8)- In exercise of the powers conferred by Section 4 and 5 of the Charitable Endowments Act , 1890 (6 of 1890) and on the application made by the Secretary to the Government of India, Ministry of Human Resource Development, Department of Women and Child Development and with the concurrence of the said Secretary, the Central Government hereby makes the following further amendments in the notification of the Government of India in the erstwhile Department of Social Welfare number S.O. 120(E) dated the 2nd March, 1979 (hereafter referred to as the said notification) with effect from the date of publication of this notification in the Official Gazette , namely: -
In Schedule ' B ' to the said notification , -
(a) for paragraph 1 , the following paragraph shall be substituted, namely:-
" 1. The objects of the National Children's Fund (hereinafter referred to as the ' Fund' ) shall be:-
(i) to raise funds from individuals , institutions , corporate and others.
(ii) to promote and fund the various programmes for children who are affected by natural calamities , disasters , distress and in difficult circumstances through voluntary agencies and State Governments ; in unserved and underserved areas including tribal and remote areas in pursuance of the National Charter for Children, 2003 notified by the Government of India, Department of Women and Child THE GAZETTE OF INDIA : EXTRAORDINARY.
[PART II-SEC. 3 (ii) ) Development on 9th February , 2004 and children in difficult circumstances including children of prisoners , children affected by riots , aggression , children affected by trafficking and children of prostitutes ;
(iii) to implement various programmes;
(iv) to do all other things that are incidental and conducive to the above objects";
(b) for paragraph 3 , the following paragraph shall be substituted ; namely,
3. For the management and administration of funds of the Fund, a Board of Management (hereinafter referred to as the Board) shall be constituted consisting of the following members ; namely: -
a) Minister in -charge of Department of Chairperson Women and Child Development Ex-officio

(c) in paragraph 4 , for the words " seven members " , the words " five members " shall be substituted;
(d) in paragraph 8 , for sub - paragraph (i) , the following sub- paragraph shall be substituted, namely: -
"( 1 ) The Board shall constitute a Working Committee under the Chairpersonship of the Working Chairperson of the Fund with not more than four members from the Board including Secretary - Treasurer of the Fund to dispose of applications for financial assistance from the Fund upto a limit of five lakh rupees in each case" ;
(e) paragraph 9 shall be omitted.
(f) for paragraphs 10 and 11 , the following paragraphs shall be substituted ; namely;
" 10. The Board may subject to such conditions and limitations delegate any or all of its powers to the Working Committee or Working Chairperson of the Fund.
11. The Board may delegate such of its powers to the Working Chairperson as may , in the opinion of the Board, are merely day to day administrative work and involve no discretion . "
(g) for paragraph 13 , the following paragraph shall be substituted; namely: -
"13 . All contracts and other assurances shall be in the name of the Board and signed on its behalf by the Working Chairperson and the Secretary - Treasurer " ;
(h) paragraph 15 shall be omitted;

[PART II-SEC. 3 (ii)] (i) for paragraph 16, the following paragraph shall be substituted , namely; -
" 16. Non - profit institutions , voluntary organizations , charitable trusts , local bodies including Panchayats , individuals , State Governments and Union territory Administrations are eligible to apply for financial assistance in terms of the objects of the Fund";
(j ) in paragraph 17 , the words " voluntary organisation " shall substitute " voluntary organizations , State Governments , Union territory Administrations , charitable trusts , local bodies and individuals " shall be substituted ;
(k) paragraph 18 shall be omitted;
(1) for paragraph 19 , the following paragraph shall be substituted , namely: -
" 19. There shall be no upper limit for financial assistance from the Fund, provided that no assistance shall be given exceeding five lakh rupees unless it is approved by the Board and the particulars published in a national daily newspaper ."
(m) paragraph 20,21,22 and 23 shall be omitted ;
(n) for paragraphs 24 and 25 , the following paragraphs shall be substituted , namely: -
"24. Power to stop grant The Chairperson of the Board shall have the power to withhold or reduce any undisbursed grant made under the Fund on the recommendation of the Secretary - Treasurer , if such withholding of grant is. reported to the Board .
25. Conditions of financial assistance The conditions of financial assistance shall be determined by the Working Committee or Board , as the case may be , at the time of

approving the application for grant of financial assistance".
(o) paragraphs 26,27 and 28 shall be omitted.
(p) for paragraphs 29,30,31 and 32, the following paragraphs shall be substituted, namely:-
"Duration ofmembership-
(1) A nominated member of the Board and the Working Committee shall hold office for a period of two years provided that no member shall continue as a member of the Working Committee beyond his term of office as a inember of Board.
(2) A member of the Board and the Working Committee shall cease to be a member on resignation , death or on becoming of unsound mind or an insolvent or on conviction by a court for committing a criminal offence involving moral turpitude.
(3) The resignation of membership shall be tendered to the Chairperson of the Board of and shall become effective from the date of its acceptance or on the expiry of thirty days from the date of resignation , whichever is earlier" .
30. Vacancies in the Board- Vacancies in the Board shall be filled in the manner in which the Board was originally constituted.
31.Meeting of the Board - The Board may meet as often as it is necessary to do so for the transaction of the business of the Fund and in any case at least once in a year.
32. Powers and Functions of the Secretary- Treasurer - It shall be the duty of the Secretary - Treasurer -

[PART II-SEC. 3 (ii)] (a) to be the custodian of all records of the Board;
(b) to conduct all official correspondence on behalf of the Board;
(c) to issue all notices for convening the meetings of the Board;
(d) to keep minutes of all meetings of the Board;
(e) to manage the properties and funds of the Fund to maintain accounts and execute all contracts on behalf ofthe Board;
(f) to exercise all other powers and execute such other functions as may be assigned to him by the Board" .
(q) in paragraph 33 , sub -para (2) shall be omitted;
(r) for paragraph 34, the following paragraph shall be substituted , namely: -
٢٠٢ "34. Allocation of funds- The Fund may spend during a financial year only the interest income on its investments and 50% of the donation received in the preceding financial year on providing financial assistance to activities taken up in furtherance of the objects of the Fund.
Provided that where the Fund receives a donation requiring that the entirety of it should be expended within the time stipulated by the donor , the restriction of utilizing only 50% of the donation received in the preceding year will not apply".
(s) for paragraph 35,36,37,38,39 and 40, the following paragraphs shall be substituted, namely: -
"35. Deposit of funds: - All moneys of the Fund shall be credited to accounts opened in any scheduled bank approved in this behalf by the Government of India" .

36. Withdrawal of funds to Withdrawal of funds from the accounts of the Fund shall be regulated in a manner to be determined by the Board. Such withdrawals shall be made by cheques or requisitions , as the case may be , signed by the Secretary - Treasurer if the amount does not exceed rupees one lakh (Rs . 1,00,000/- ) and signed by Secretary -Treasurer and another member of the Board to be nominated by the Board for amounts exceeding one lakh rupees.
37. Administrative Expenses: The following items of expenditure: (i ) payment of salary to sanctioned staff at authorized pay scales ( ii ) audit fee (iii) any tax or statutory dues of the fund (iv) Travelling Allowance and Dearness Allowance to staff or members of the Board at rates and scale approved by the Board and expenses related to preparation and printing of Annual Report (v) litigation will be legitimate charge on the Fund and may be incurred by Secretary - Treasurer without reference to any superior authority . (vi) The expenditure on other items of administrative nature may be restricted to an annual amount approved by the Board or fixed as 10% of the Fund disbursed during the previous financial year ,
38. Appointment of Staff ( 1 ) The Board may appoint such staff as it may consider necessary for the discharge of its function . (2) The terms and conditions of service of the staff may be determined by the Board.
39. Remuneration to members of the Board -
(1) No remuneration shall be paid to any of the members of the Board except traveling and daily allowance at rates to be determined by the Board .

[PART II-SEC. 3 ( ii)] (2) Official members of the Board will draw travelling and daily allowance at rates admissible to them from the source from which they draw their salaries .
(3) Officers and staff of the Fund may draw such remuneration and travelling and daily allowance to which they may be entitled under rules applicable to them or as authorized by the Board.
40. Annual Report An annual report including accounts of the Fund , audited by a firm of Chartered Accountants , appointed by the Board and certified by them that the expenditure from the funds of the Fund has been correctly incurred in accordance with the objects of the Fund, shall be prepared by the Secretary- Treasurer , after approval of the Board, be presented to the Government of India . "
(t) paragraph 41 shall be omitted.
