प्रतिभूति संविदा ( विनियमन ) अधिनियम , 1956 11 ( 3) के अधीन कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड की समितिके अधिक्रमण की कालावधि को बढ़ाने के लिए अधिसूचना
का.आ. 1313(अ). - तारीख 4 दिसम्बर, 2003 की अधिसूचना सं. का.आ. 199 ( अ ) ( इसमें इसके पश्चात् " उक्त अधिसूचना " के रूप में निर्दिष्ट ) द्वारा कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड की समिति को भारतीय प्रतिभूति और विनिमय बोर्ड द्वारा 4 दिसम्बर, 2003 से प्रभावी एक वर्ष की कालावधि के लिए अतिष्ठित किया गया था और श्री तुषार कांति दास , आई.ए.एस. ( सेवानिवृत्त ) को कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड की समिति की समस्त शक्तियों और कर्तव्यों का प्रयोग करने और पालन करने के लिए प्रशासक के तौर पर नियुक्त किया गया था । उक्त अधिसूचना के अनुसार अधिक्रमण की अवधि 3 दिसम्बर, 2004 को समाप्त हो रही है ।
प्रशासक द्वारा किए गए विभिन्न सुधारात्मक उपायों को ध्यान में रखते हुए जिनमें से कुछ पर अविरत अनुवर्ती कार्रवाई अपेक्षित होगी , आगे विनिधानकर्ताओं के हित में एक्सचेंज की कार्यप्रणाली को सुचारू बनाने के लिए, नई समिति के निर्वाचन तथा गठन की प्रक्रिया को पूरा करने के लिए अपेक्षित समय, और आगे अपरस्परीकरण (डीम्युचुअलोइजेशन ) तथा निगमीकरण ( कॉर्पोरेटाइजेशन ) की प्रक्रिया को पूरा करने के लिए, कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड की समिति के अधिक्रमण की कालावधि को 30 जून, 2005 तक की अतिरिक्त कालावधि के लिए बढ़ाया जाना अपेक्षित है । पूर्वोक्त कारणों को ध्यान में रखते हुए, प्रतिभूति संविदा (विनियमन ) अधिनियम , 1956 की धारा 11 और केंन्द्रीय सरकार द्वारा जारी तारीख 30 जुलाई, 1992 की अधिसूचना सं. का.आ. 573 के साथ पठित भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम, 1992 की धारा 4(3 ) के अधीन मुझे प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिसूचना में यथा आदिष्ट कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड की समिति के अधिक्रमण को एतद्वारा 4 दिसम्बर, 2004 से प्रभावी 30 जून , 2005 तक की अतिरिक्त कालावधि के लिए बढ़ा दिया जाए और श्री बुषार कांति दास, आई.ए.एस. (सेवानिवृत्त) प्रशासक के तौर पर बने रहेंगे , कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड की समिति की समस्त शक्तियों और कर्त्तव्यों का प्रयोग करने और पालन करने के प्रयोजन के लिए, बढ़ाई गई कालावधि के दौरान ।

NOTIFICATION
Mumbai , the 30th November, 2004
Notification under Section 11 (3) of the Securities Contracts (Regulation) Act, 1956 for Extending the period of Supersession of the Committee of the Calcutta Stock Exchange Association Ltd.
S.O. 1313 (E) .-Vide notification No. S.O. 199(E) dated December 4, 2003 (referred hereinafter to as " the said notification" ) the Committee of the Calcutta Stock Exchange Association Ltd. was superseded by the Securities and Exchange Board of India for a period of one year with effect from December 4 , 2003 and Shri Tushar Kanti Das , IAS (Retd. ) was appointed as the Administrator to exercise and perform all the powers and duties of the Committee ofthe Calcutta Stock Exchange Association Ltd. The term of supersession vide the said notification is expiring on the December 3 , 2004.
In view of the various corrective measures taken by the Administrator some of which would require sustained follow up action, to further streamline the functioning of the Exchange in the interest of investors , time required to complete the process of election and constitution of the new Committee , and further to complete the process of demutualization and corporatisation, the period of supersession of the Committee of Calcutta Stock Exchange Association Ltd. is requiredto be extended for a further period upto June 30 , 2005.
Inview of the aforesaid reasons , in exercise ofthe powers conferred upon me under Section 4(3 ) of Securities and Exchange Board of India, Act, 1992 read with Section 11 of the Securities Contracts (Regulation) Act, 1956 and the Notification No. S.O. 573 dated July 30 , 1992 issued by Central Government , the supersession of the Committee of the Calcutta Stock Exchange Association Ltd. as ordered in the said notification be hereby extended for a further period upto June 30, 2005 with effect from December 4, 2004 and Shri Tushar Kanti Das, IAS (Retd. ) shall continue as the Administrator, for the purpose of exercising and performing all the powers and duties of the Committee of the Calcutta Stock Exchange Association Ltd. , during the extended period.
