NOTIFICATION
New Delhi, the 21st September, 2010
G.S.R. 775(E).—In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules to amend the Directorate of Plant Protection, Quarantine and Storage, Assistant Director (Entomology) Recruitment Rules, 2008, namely :-
(1) These rules may be called the Directorate of Plant Protection, Quarantine and Storage, Assistant Director (Entomology) Recruitment Amendment Rules, 2010.
Directorate of Plant Protection, Quarantine and Storage, Assistant Director (Entomology) Recruitment Rules, 2008, published in the Gazette of India, Part II, Section 3, Sub-section (i) vide number G.S.R. 73, dated the 2nd April, 2008, for promotion to the post of Assistant Director (Entomology), the Department Plant Protection Officer (Entomology) must possess B. Sc. (Agriculture) with Botany or Zoology as one of the subject from a recognized University or Institute of equivalent. However, only one incumbent presently fulfils the required qualification of B. Sc. (Agriculture) with Botany as a subject and the remaining incumbents holding the feeder post of Plant Protection Officer (Entomology) are having the qualification of B. Sc. (Botany or Zoology). Therefore, prescription of the educational qualification of B. Sc. (Agriculture) with Botany or Zoology has adversely affected the interest of the incumbents of the feeder posts of Assistant Director (Entomology) who, despite having completed the qualifying service prescribed in the recruitment rules, are not eligible for promotion to the post of Assistant Director (Entomology). Therefore, it has been found desirable to amend the recruitment rules of Assistant Director (Entomology) by allowing promotion of incumbents holding the feeder post of Plant Protection Officer (Enotomology) with B. Sc. in Agriculture or B. Sc. in Botany or Zoology. Retrospective amendment to the said rules notified on 2nd April, 2008 is necessary as a number of vacancies in the post of Assistant Director (Entomology) have arisen in 2009 and the incumbent holding the feeder post of Plant Protection Officer (Entomology) had become eligible for promotion.
(2) They shall be deemed to have come into force
with effect from 2nd April, 2008.
In the Directorate of Plant Protection, Quarantine and Storage, Assistant Director (Entomology) Recruitment Rules, 2008, in the Schedule in column 9,-
Accordingly, it has been decided to amend the provision in column 9 to the Schedule to the said rules and to give retrospective effect to the aforesaid amendments with effect from 2nd April, 2008. As such insertion of the proposed entry in the said rules will have retrospective application from 2nd April, 2008 (the date on which the existing recruitment rules were notified in the Gazette of India, Part II, Section 3, Sub-section (i). It is certified that none will be adversely affected by the retrospective effect being given to the proposed amendment to the recruitment rules being notified".
[F. No. 13-4/99-P.P. II] for the brackets, words and letters "[But must posses B. Sc. (Agriculture) with Botany or Zoology as one of the subjects from a recognized University or Institute or equivalent]", the brackets, words and letters "[But must possess B. Sc. (Agriculture) or B. Sc. with Botany or Zoology as one of the subjects from a recognized University or Institute or equivalent]" shall be substituted.
