सा.का.नि. 786( अ) .-अंदमान और निकोबार द्वीप समूह ( उतराई, घाटों, घाटियों, भांडागारों, शेडों का प्रयोग और अन्य प्रकीर्ण सेवाओं के लिए दरों का नियत करना ) नियम, 1991 का और संशोधन करने के लिए कतिपय नियमों का भारत सरकार, भारतीय पत्तन अधिनियम, 1908 ( 1908 का 15 ) की धारा 6 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करती है, इसे उक्त अधिनियम की धारा 6 की उपधारा ( 2 ) की अपेक्षानुसार, भारत सरकार के पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय, पोत परिवहन विभाग के पत्तन पक्ष की अधिसूचना सं. सा.का.नि. 483( अ ) तारीख 27-7-2004 के अधीन भारत के राजपत्र , भाग II , खण्ड 3 , उप- खण्ड ( i ) में प्रकाशित किए गए थे जिसमें ऐसे सभी व्यक्तियों से, जिनके उससे प्रभावित होने की संभावना थी, उस तारीख, जिसको भारत के उस राजपत्र की प्रतियां जिसमें उपरोक्त प्रकाशित अधिसूचना जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की समाप्ति से पूर्व आपत्तियां और सुझाव माँगे गऐ थे;
और उक्त अधिसूचना को 27 जुलाई , 2004 को प्रकाशित कर जनता के लिए उपलब्ध करा दिया गया था; और उपरोक्त अवधि की समाप्ति के पूर्व जनता से किसी प्रकार के सुझाव, आपत्तियाँ प्राप्त नहीं हुए हैं;
अतः अब भारत सरकार, उक्त अधिनियम की धारा 6 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाती है, अर्थात्: -
नियम
1. ( 1 ) नियमों का संक्षिप्त नाम अंदमान और निकोबार द्वीप समूह ( उतराई , घाटों, घाटियों, भांडागारों, शेडों का प्रयोग और अन्य प्रकीर्ण सेवाओं के लिए दरों का नियत करना ) संशोधन नियम, 2004 है ।
( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. अंदमान और निकोबार द्वीप समूह ( उतराई, घाटों, घाटियों , भांडागारों, शेडों का प्रयोग और अन्य प्रकीर्ण सेवाओं के लिए दरों का नियत करना) नियम, 1991 में,-

(क) निम्नलिखित मदों पर घाट शुल्क के अतिरिक्त अधिभार के रूप में घाट शुल्क का 10 % प्रति टन / क्यूबिक मीटर उद्गृहीत किया जाएगा ।

(ख) उन सभी मदों पर जिन्हें अन्तराष्ट्रीय समुद्रीय संगठन द्वारा अन्तर्राष्ट्रीय समुद्रीय खतरनाक माल कोड के अधीन खतरनाक माल के रूप में वर्गीकत किया गया है, घाटशुल्क के रूप में घाट शुल्क का 20 % प्रति टन/ क्यूबिक मीटर / किलो लीटर उद्गृहीत किया जाएगा ।
(ग) पक्षकार का यह प्रथम दायित्व होगा कि वह पत्तन द्वारा सत्यापन के अध्याधीन विनिर्दिष्ट प्रसाक्ष्य दस्तावेजों के आधार पर आयात / निर्यात आवेदनों को फाइल करते समय माल का सही मूल्य घोषित करे । पत्तन द्वारा स्थौरा आदि के मूल्य / प्रकृति की किसी घोषणा के अधीन उक्त विनिर्दिष्ट दस्तावेजों के सत्यापन के समय यदि यह पाया जाता है कि माल का मूल्य, प्रकृति कम करके दर्शायी गई है तो पक्षकार नियम (10)4 के अधीन पक्षकार शास्ति का दायी होगा । शास्ति न्यूनतम 1000 रु० के अधीन रहते हुए देय घाट शुल्क की दस गुने तक हो सकेगी ।
(घ) मूल्यानुसार घाट शुल्क आयात पर सी आई एफ मूल्य पर निर्यात पर एफ ओ बी मूल्य पर तथा तटीय स्थौरा पर तटीय माल के बिल में विनिर्दिष्ट मूल्य पर संगणित किया जाएगा । सीमाशुल्क प्रवेश बिल/ नौवहन बिल / तटीय माल बिल घाटशुल्क प्रयोजन के लिए माल के मूल्य का निर्धारण करने के लिए मुख्य भारत का राजपत्र असाधारण
[भाग II- खण्ड 3 (i) 」
दस्तावेज होगा और जहां यह उपलब्ध नहीं है वहां मूल्य अवधारण अवतरण बिल बीजक आदि पर किया जाएगा ।
(ङ) जहां माप, परिमाण और वजन दोनों का विवरण दिया गया है, पत्तन को सबसे अधिक उपयोगी यूनिट लागू होगी ।";
(ii) भाग ख में, मद संख्या 15 के सामने स्तंभ 3 में , विद्यमान प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात् :-
"बंदरगाह में प्रवेश करने पर मापमान ' क ' के अनुसार घाट शुल्क के पिचहत्तर प्रतिशत पर ।";
(ख) अनुसूची 2 में,-
(i) भाग ' ख ' के स्थान पर निम्नलिखित भाग रखा जाएगा, अर्थात् : -
"भाग ' ख ' जलयानों के मास्टरों, स्वामियों या अभिकर्ताओं को क्रेनों को भाड़े पर देनाः-
जलयानों से माल उतारने चढ़ानें के लिए बार्जों तथा लाइटरों सहित स्थौरा हैंडलिंग उपस्करों की बाबत जलयानों के मास्टर स्वामियों या अभिकर्ताओं द्वारा अध्गपेक्षा करने और प्रदाग किए जाने के संबंध में प्रभार निम्नानुसार हैं"

टिप्पण:-
(क) जब कभी पैकेजों/ आधानों को पत्तन तट क्रेन के उपयोग के बिना पोत के ही डेरिक द्वारा उतारा या चढ़ाया जाता है तो प्रभारों की 50 % वसूली की जाएगी यदि स्वामी / अभिकर्ता द्वारा पूर्व अनुमति अभिप्राप्त नहीं की गई है । जब पत्तन तट की क्रेन निष्क्रिय हो तो पत्तन अनुज्ञा नहीं देगा ।
(ख) मापमान के अंतर्गत विद्युत चालित क्रेनों पर विद्युत या विद्युत आपूर्ति के लिए पोर्ट के जेनरेटर का उपयोग करने पर प्रभार में 30 प्रतिशत की वृद्धि की जाएगी ।
( ग) समय - समय पर पेट्रोल की कीमत बढ़ाने पर पत्तन द्वारा अवधारित अधिभार उद्गृहीत किया जाएगा । (घ) यदि कोई नया हैंडलिंग उपस्कर को सम्मिलित किया जाता है तो अतिरिक्त अधिभार या नई दर पत्तन प्रबंध बोर्ड द्वारा नियत की जाएगी ।
(ii) भाग ' ग' के स्थान पर निम्नलिखित भाग रखा जाएगा, अर्थात्: -
"भाग ' ग' - " लदान, नौभरण और परिदान के साधारण नियमित कार्य के बाहरी प्रयोजनों के लिए क्रेनों और फोर्कलिफ्ट ट्रकों का भाड़ा"

टिप्पण:-
(क) पत्तन के मुख्य द्वार से प्रस्थान पत्तन के मुख्य द्वार तक आगमन का वास्तविक समय प्रभारों के निर्धारण के लिए संगणित किया जाएगा ।
(ख) स्थल पर कार्य करने के लिए स्थौरा हैंडलिंग उपस्कर की सुरक्षा और पूरक व्यय को अनुमोदन से पूर्व सुनिश्चित किया जाना है । यात्रा या संक्रियाओं के दौरान यदि हैंडलिंग उपस्कर को कोई नुकसान होता है तो इसे भाड़े पर उपस्कर लेने वाले पक्षकार द्वारा वहन किया जाएगा ।";
(ग) "आयात मुक्त दिवस " से संबंधित भाग ' क ' की अनुसूची 3 में, -
(i) मद 1 के स्थान पर निम्नलिखित मद रखी जाएगी , अर्थात्:-
1. (क) साधारण स्थौराः रविवार और अवकाश दिनों को अपवर्जित करते हुए , तटीय स्थौरा की दशा में दो कार्य दिवस और विदेशी स्थौरा की दशा में तीन कार्य दिवस तथा जलयान स्थौरा के पूरा होने या वह तारीख और समय जब आखिरी पैकेज जहाज की ओर रखा गया है, के बाद निःशुल्क ।
स्पष्टीकरणः साधारण स्थौरा से मापमान के इस भाग में विशिष्ट रूप से उल्लिखित न किया गया स्थौरा अभिप्रेत है ।
(ख) कंटेनर युक्त स्थौराः
I कन्टेनरों पर कोई निःशुल्क दिवस अनुज्ञात नहीं किया जाएगा चाहे वे अवतरित / पोत पर लदे या खाली या भरे हुए हो ।
II कन्टेनरों से निकाले गए स्थौरा तथा कन्टेनरों मे भरने के लिए पट्टा क्षेत्र से भिन्न अन्य विकसित / अविकसित क्षेत्र में उक्त स्थौरा को जमा करके रखने पर निम्नलिखित मापमान में विनिर्दिष्ट अनुसार अन्य स्थौरा डेमरेज के लिए दायी होगा ।
(i ) कंटेनरयुक्त आयात स्थौरा :- डेमरेज के प्रयोजन के लिए, कंटेनर से निकासी किए गए ऐसे आयातित स्थौरा की कंटेनर से निकासी की तारीख और समय से निःशुल्क दिवस की गणना की जाएगी । (ii) कंटेनरयुक्त निर्यात स्थौरा : डेमरेज के प्रयोजन के लिए, ऐसे निःशुल्क दिवस की गणना ऐसे निर्यात किए जाने वाले स्थौरा को पट्टा क्षेत्र को छोड़कर अन्य विकसित/ अविकसित क्षेत्र में लाए जाने की 8

[PART II SEC. 3 (i ) ) तारीख से की जाएगी और उद्ग्रहणीय डेमरेज, यदि कोई हो, की गणना निःशुल्क दिवस के पूरा होने के पश्चात् उसे कंटेनर में भरने तक की अवधि के लिए की जाएगी ।
टिप्पणः यदि पत्तन प्रबन्ध बोर्ड, कन्टेनर यार्ड या डॉक क्षेत्र को संकुलित घोषित करता है तो कोई निःशुल्क दिवस अनुज्ञात नहीं होगा ।
(ii) मद 11 के स्थान पर निम्नलिखित मद रखी जाएगी, अर्थात्-
" 11. संकुलन के दौरान पत्तन यदि किसी समय उसके अभिवहन क्षेत्रों और संकुलन की आशंका करता है जो पत्तन के मार्फत माल के अभिवहन के लिए अपायकर है तो वह किसी विनिर्दिष्ट माल के स्वामी या परेषिती को नियत समय के भीतर उक्त माल को बंदरगाह परिसरों से हटाने का निदेश दे सकेगा और यदि माल इस प्रकार नहीं हटाया जाता हे तो जब तक बंदरगाह परिसरों से माल नहीं हटा दिया जाता है, तब तक पत्तन उस पर प्रति यूनिट प्रति दिन घाटा शुल्क 150 प्रतिशत तक डेमरेज प्रभार्य कर सकेगा । पत्तन स्वयं भी स्वामी के खर्चे पर अभिवहन क्षेत्रों से उसे हटा सकेगा और उसके परिसरों के भीतर किसी जगह पर स्वामी की जोखिम पर चट्टा लगा सकेगा ";
(घ) अनुसूची IV में भाग ' क ' और भाग ' ख ' के स्थान पर निम्नलिखित भाग रखे जाएंगे, अर्थात् : -

प्रत्येक आवेदक से 150/ -रु० प्रति पारी या उसका भाग ।
रविवार तथा पत्तन के साधारण अवकाश के दौरान I , II , III पारियां
भाग 'घ' -घाट/जेट्टी तोलन ब्रिज को मार तोलने के लिए खुला रखना :-

(क) जब भी मजदूरी, प्रोत्साहन आदि में वृद्धि के कारण पी ओ एल और प्रचालकों की स्थापना लागत में वृद्धि होती है तो 20 % का अधिभार उद्गृहीत किया जाएगा ।
(ख) माल को जहाज पर लादे जाने वाले पत्तन पर कन्टेनरों में मूल रूप से अभिव्यक्ति माल यदि नौकातंरण हेतु धाट पर उतारा जाता है तो माल को चढ़ाने और उतारने के लिए अलग अलग पूरा घाट भाड़ा दर के मापमान के अनुसार लिया जाएगा ।
(ग) सामान्य माल सूची नौकांतरण के लिए कन्टेनर मे भर कर लाए गए माल की चेक परीक्षण द्वारा सत्यापन के लिए प्रबंधक (स्थौरा ) को तुरंत प्रस्तुत करना चाहिए ।
(घ) पत्तन में आने तथा पहुंचने वाले कन्टेनर यान के विवरण की सूचना एक सप्ताह पूर्व प्रबंधक (स्थौरा) को दी जानी चाहिए ।
(ङ) कन्टेनर के भण्डारण के लिए विकसित क्षेत्र के आबंटन के लिए आवेदन प्रबन्धक (स्थौरा ) के पास सात दिन पहले पहुँचाना होगा ।
(च) इस प्रकार आबंटित किए गए किराए पर लिए स्थान पर रखे गए माल के लिए दायित्व और सभी जोखिम की जिम्मेदारी आवेदक की होगी तथा उसकी सुरक्षा की व्यवस्था वह स्वयं करेगा । 16

[PART II -SEC . 3 (i ) ] (छ) घाट डॉक क्षेत्र में कोई भी कन्टेनर नहीं पड़ा रहेगा जिससे कि पत्तन संचालन में अवरोध उत्पन्न हो ।
(ज) कन्टेनरों को एक ही सीध में कन्टेनर यार्ड योजना के अनुसार , सदैव उचित रूप में रखना होगा तथा यदि अपेक्षित हो तो एक के ऊपर दूसरे को रखना होगा , अधिकतम तीन की ऊँचाई अनुज्ञेय है ।
(झ) कन्टेनर यार्ड से भाड़ा स्टेशन या अन्य विकसित क्षेत्रों में कन्टेनरों को ले जाने के लिए माल भेजने वाले से अनुसूची 2 के भाग ख के अधीन दर के मापमान के अनुसार प्रभार लिया जाएगा ।
(গ) इस भाग के अधीन प्रभार , कन्टेनर तथा कन्टेनरीकृत माल पर घाट भाड़ा तथा प्रदान की गई कई सेवाओं के लिए जाने वाले अन्य प्रभारों के अतिरिक्त होगा जैसा इस अधिसूचना के विभिन्न खंडों के अधीन उल्लिखित है ।

G.S.R. 786( E). Whereas draft of the certain rules further to amend the Andaman and Nicobar Islands (Fixation of Rates for the Use of Landing Places, Wharves , Quays . Warehouses , Sheds and other Miscellaneous Services ) Rules , 1991 , were published as required by sub - section (2 ) of section 6 of the Indian Ports Act, 1908 ( 15 of 1908 ) in the Gazette of India Extraordinary Part II , Section ( 3 ) , sub - section ( 1 ) under notification of the Government of India in the Ministry of Shipping, Road Transport & Highways , Department of Shipping ( Ports Wing) vide G.S.R.483 ( E ) dated the 27th July, 2004 for information of and inviting objections and suggestions from all concerned likely tobe affected thereby and giving notice that the draft rules shall be taken into consideration on or after expiry of forty five days from the publication of the notification alongwith the objections and suggestions made within the said period;
2004; And whereas the said notification was published and made available to the public on the 27th July , And whereas no suggestions and objections have been received from the public before the expiry of the aforesaid period ;
Now, therefore , in exercise of the powers conferred by sub -section( 1 ) of section (6) of the said Act , the Central Government hereby makes the following rules , namely: -

10% of the wharfage per ton/Cbm shall be levied in addition to wharfage on following items as surcharge:
1. Cement, 2. Stone chips/dust , 3. Sand 4 .. Asphalt , 5. M.S.Steel rod/sheets , 6. Metal Scraps , 7. Coal/Coke , and 8. Fertilizers (B) 20% of the wharfage per ton/Cbm/KL shall be levied as surcharge in addition to wharfage on all items classified as dangerous goods under International Maritime dangerous goods code issued by the International Maritime organization.
(C) It shall be the primary responsibility of the party to declare the correct value of the cargo at the time of filing the import/export applications based on the documents specified supra subject to verification by the Port . Any under declaration of value/nature of cargo , etc. found by the Port at the time of verification of the documents specified above with regard to the value , nature of cargo , etc. shall involve the party liable for penalty under rule 10 (4) . The penalty shall be levied upto Ten times of the wharfage amount so due subject to a minimum of Rs . 1000/- .

(D) Advalorem wharfage on imports shall be calculated on C.I.F. value on the exports on F.O.B. value and Coastal Cargo on value specified in Bill of Coastal Goods . Customs Bill of entry /Shipping bill/Bill of coastal goods shall be the main documents for assessing the value of cargo for wharfage purpose and where it is not available the value will be determined on Bill of lading/Invoice , etc.
(E) Wherever both measurement, volume and weight are given, the unit more favourable to the Port will apply." ;
(ii) in PART B , against item number 15 , in column 3 , for the existing entry , the following entry shall be substituted, namely: -
"Wharfage at seventy per cent of the wharfage as per Scale ' A' in entering the harbour. " ;
(b) in Schedule II , -

NOTE .
(A) Whenever packages /containers are unloaded or shipped by ship's own derrick without the use of Port's shore crane , 50% of the charges shall be recovered if the owner /agent has not obtained prior permission. Port shall not grant permission when Port's shore Crane isidle .
(B) All charges on electrically operated cranes covered by the scale shall be increased thirty percent during power cut or whenever the Port generator is used for power supply.

( A) Actual time of departure from the port main gate and arrival to port main gate shall be calculated for assessing the charges .
(B) Safety of cargo handling equipment to work on site and overhead clearance are to be ascertained before approval . Damages , if any, to the handling equipment during the travel or operations shall be borne by the party hired such equipment. " ;
In Schedule III , in PART ' A ' relating to " Imports - Free days " , -
(C)
(i) for item 1 , the following item shall be substituted , namely: -
1. (a ) GENERAL CARGO : - Two working days in the case of coastal cargo and three working "
in the case of foreign cargo excluding Sunday and holidays are free after completion of a vessel particular cargo at a berth or the time and date when the last package of a particular cargo put over side .
Explanation . General cargo means all cargo not specifically mentioned in this part of scale .
(b ) CONTAINERISED CARGO :
I. No free days shall be allowed on containers whether landed/ shipped either empty or stuffed.
II . Stuffed cargo removed from the container and cargo meant for stuffing in the container stacked in developed/undeveloped area other than the lease area will be liable for demurrage as applicable to other cargo specified in the scale of rates as below:
(i) Containerised Import Cargo : For purpose of demurrage , the free days for such import cargo released from the container shall count from the time and date of release of the import cargo from containers .
( ii) Containerised Export Cargo : For purpose of demurrage , the free days for such export cargo shall be reckoned from the date on which cargo is admitted in the developed/undeveloped area and demurrage leviable, if any, shall be computed from the day following the completion of free days till such cargo has been stuffed into containers .

If the Port Management Board declares the container yard or dock area as congested, no free days shall be admissible ." ;

During Congestion: - If at any time port should apprehend serious congestion in the dock area/container yards or in transit area as to the detriment to the rapid transit of goods through the port, it may direct the owners or consignees of any specified goods to remove such goods from the port premises within a given time and should the goods not be so removed, the port may charge them demurrage thereon upto 150% of the wharfage per day until the goods shall have been removed from the port premises. Also the port may itself remove them from the dock area/ container yard or the transit area at the expenses of the owners and stack them in any space within its premises at the risk of the owner . "

(A) A surcharge of 20% will be levied as and when there is increase in POL and establishment cost of operators due to increase in wages , incentives , etc.
(B) Cargo in containers originally manifested at the port of shipment landed at wharf for transshipment shall be charged full wharfage dues as per the scale of rate i.e. loading separately and unloading separately.
(C) General manifest must be produced immediately to the Manager ( Cargo ) for verification by a test check of stuffed cargo in container brought for transshipment
(D) Information about the arrival and details of container vessels expected to call at the port , should be furnished to the Manager ( Cargo ) one week in advance.
( E) Application for allotment of developed area for storage of container should reach to Manager ( Cargo ) in seven days advance .
(F) The applicant shall accept all risk and responsibilities for goods stored at the rental space so allotted and make his own security arrangements .
((j) No container should be left over on the wharf/dock area so as to pose a hindrance to the portoperations .
(H) Containers shall always be stacked properly in a row as per the container yard plan and if required, to be stacked one over the other , a maximum of three in height will be permitted.
(1) For shifting the container from container yard to freight station or other developed areas , the shipper will be charged according to the scale of rates under Schedule - II Part -B .
(3) The charges under this part shall be in addition to the wharfage on the container and on the containerised cargo and other charges for the various services rendered as provided under different parts of this notification."
