सा.का.नि. 792(अ).- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वित्त मंत्रालय, राजस्व विभाग, केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड में भारत सरकार द्वारा जारी किए गए मंजूरी आदेश सं. ए-11019/72/99 प्रशा . IV , तारीख 19 जुलाई , 2001 के साथ पठित केन्द्रीय उत्पाद शुल्क और भूमि सीमा शुल्क विभाग समूह ' घ ' पद भर्ती नियम, 1979 और सीमा शुल्क विभाग समूह ' घ ' पद भर्ती नियम 1979 को, जहां तक उनका संबंध गेस्टेटनर आपरेटर ( साधारण श्रेणी ) , दफ्तरी , ज्येष्ठ श्रेणी माली , फराश , झाडुकश के पदों से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है अथवा जिनका लोप किया गया है केन्द्रीय उत्पाद शुल्क और सीमा शुल्क विभाग में गेस्टेटनर आपरेटर ( साधारण श्रेणी ) , दफ्तरी , माली, चौकीदार, फराश , सफाईवाला के समूह ' घ ' पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते है , अर्थात्: -
1. संक्षिप्त नाम और प्रारंभ.-( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय उत्पाद शुल्क और सीमा शुल्क विभाग गेस्टेटनर आपरेटर ( साधारण श्रेणी ) , दफ्तरी , माली , चौकीदार , फराश, सफाई वाला समूह ' घ ' भर्ती नियम, 2004 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।
3. आरंभिक गठन: इन नियमों के प्रारम्भ से पूर्व दफ्तरी ( ज्येष्ठ श्रेणी ) और सफाई वाला के पद धारण करने वाले व्यक्तियों को इन नियमों के अधीन क्रमशः दफ्तरी और सफाई वाला के रूप में नियुक्त किया गया समझा जाएगा और उनके द्वारा की गई सेवा उनके अपने अपने पदों पर प्रोन्नति, ज्येष्ठता और सेवा के अन्य निबंधनों और सेवा शर्तों के लिए गणना में ली जाएगी ।
4. विशेष उपबंध : जब तक केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड द्वारा अन्यथा विहित न किया जाए, प्रत्येक आयुक्तालाय का अपना पृथक काडर होगा ।
5. भर्ती की पद्धति , आयु सीमा और अर्हताएं, आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, और अन्य अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

6. निर्रहता.- वह व्यक्ति-
(क) जिसने ऐसे व्यक्ति से , जिसका पति या पत्नी जीवित है, से विवाह किया है, या
(ख ) जिसने अपने पति या पत्नी के जीवित रहते हुए, किसी व्यक्ति से विवाह किया है,
उक्त पदों पर नियुक्तिका पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 7. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 8. व्यावृत्ति.- इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( न कि वह अंतिम तारीख जो असम, मेघालय , अरूणाचल प्रदेश, मिजोरम , मणिपुर, नागालैंड, त्रिपुरा , सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्ष- द्वीप के अभ्यर्थियों के लिए विहित की गई है ।)
टिप्पण 2 : रोजगार कार्यालयों के माध्यम से की जाने वाली भर्ती की दशा में आयु सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालयों को नाम भेजने के लिए कहा गया है ।

फाश, चौकीदार, सफाईवाला, माली , और अन्य समूह " घ " पदों में से बशर्ते समूह " घ " कर्मचारियों द्वारा धारित पदों के वेतनमान वही हों, जो फराश , चौकीदार, सफाईवाला या माली के पद के हैं, निम्नलिखित शर्तों के अधीन रहते हुए:
(ii ) केन्द्रीय उत्पाद शुल्क या सीमा शुल्क के दो अधीक्षक
( i ) फराश, चौकीदार, सफाईवाला, माली की श्रेणी में और ऐसे अन्य समूह घ पदों पर कम से कम 4 वर्ष नियमित सेवा की हो, जिनका वेतनमान फराश, चौकीदार, सफाईवाला, माली के समान हो ।
( ii ) साइक्लोस्टाइलिंग मशीन को संभालने और प्रचालन में प्रवीणता रखता हो ।
-सदस्य (iii ) आयकर अधिकारी टिप्पण: जहां संबंधित अधिकारियों में से कोई भी अनुसूचित जाति या अनुसूचित जनजाति समुदाय का सदस्य नहीं है, वहां विभाग के बाहर से अनुसूचित जाति या अनुसूचित जनजाति के किसी अधिकारी को भी विभागीय प्रोन्नति समिति के सदस्य के रूप में सहयुक्त किया जाएगा ।

New Delhi , the 6th December , 2004
G.S.R. 792 ( E ) .--In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Excise and Land Customs Department Group " D " posts Recruitment Rules , 1979 , and the Customs Department Group "D " posts recruitment Rules , 1979 , read with the sanction order No. A- 11019/ 72 / 99- Ad.JV , dated the 19th July , 2001 , issuedby Government of India, in the Ministry of Finance , Department of Revenue , Central Board of Excise and Customs , in so far as they relate to the posts of Gestetner Operator ( Ordinary Grade ) , Daftry (Senior Grade ) , Mali , Farash , Sweeper , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to Group " D " posts of Gestetner Operator (Ordinary Grade) , Daftry, Mali , Chowkidar , Farash , Safaiwala in the Central Excise and Customs Department , namely:
1. Short title and commencement .---( 1 ) These rules may be called the Central Excise and Customs Department Gestetner Operator (Ordinary Grade ) Daftry , Mali , Chowkidar, Farash , Safaiwala (Group ' D ' posts ) Recruitment Rules, 2004.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of posts , classification and scale of pay. The number of said posts , their classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .
3. Initial Constitution . The persons holding the post of Daftry (Senior Grade ) and Sweeper, before the commencement of these rules , shallbe deemed to have been appointed as Daftry and Safaiwala respectively under these rules and the services rendered by them shallbe counted for promotion , seniority and other terms and conditions of service in their respective posts .
4. Special Provision . Each Commissionerate shall have its own separate cadre unless otherwise prescribed by the Central Board of Excise and Customs .
5. Method of recruitment , age limit and qualifications , etc. The method of recruitment, age limit, qualification and other matters relating to the said posts shall be as specified in columns (5) to ( 14) of the said Schedule .
6. Disqualification . No person ,-
( a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living has entered into or contracted a marriage with any person ,
shall be eligible for appointment to any of the said posts :
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing , so exempt any person from the operation of this rule .
7. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .
8. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
