का.आ. 1334(अ).- केन्द्रीय प्रत्यक्ष कर बोर्ड, आयकर अधिनियम, 1961 ( 1961 का 43 ) की धारा 17 की उपधारा (2 ) के खंड ( vi ) के परंतुक के खंड ( 2) ' के उपखंड (ख ) के साथ पठित धारा 295 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , आयकर अधिनियम, 1962 का और संशोधन करने के लिए निम्नलिखित नियम बनाता है, अर्थात् : -
1. (1) इन नियमों का संक्षिप्त नाम आयकर अधिनियम ( उनीसवाँ संशोधन) नियम, 2004 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. आयकर नियम, 1962 के नियम 3 क में, -
(क) " धारा 17 के खंड ( 2) के परंतुक के खंड ( ii ) के उपखंड ( ख ) के प्रयोजनों के लिए किसी अस्पताल को अनुमोदित करने में " शब्दों, कोष्ठकों, अक्षरों और अंकों के स्थान पर निम्नलिखित शब्द, कोष्ठक, अक्षर और अंक रखे जाएंगे , अर्थात् : -
८८ धारा 17 के खंड (2) के उपखंड ( vi) के परंतुक के खंड (ii ) के उपखंड (ख) के प्रयोजनों के लिए भारतीय चिकित्सा पद्धति और होम्योपैथिक चिकित्सा से भिन्न किसी अन्य अस्पताल को अनुमोदन करने में" ;

[PART I-SEC . 3 ( ii)] अर्थात् : - (ख) उपनियम (1 ) के पश्चात् निम्नलिखित उपनियम अंतःस्थापित किया जाएगा, " ( 1 क) धारा 17 के खंउ 2 के उपखंड ( vi ) के परंतुक के खंड ( ii ) के उपखंड (ख) के प्रयोजनों के लिए भारतीय चिकित्सा पद्धति और होम्योपैथिक चिकित्सा के लिए किसी अस्पताल के अनुमोदन करने में मुख्य आयुक्त अपने को संतुष्ट करेगा कि केन्द्रीय सरकार स्वास्थ्य स्कीम हिताधिकारियों और केन्द्रीय सरकार के कर्मचारियों को भारतीय चिकित्सा पद्धति और होम्योपैथिक चिकित्सा के लिए निजी अस्पतालों के अनुमोदन के लिए स्वास्थ्य और परिवार कल्याण मंत्रालय के भारतीय चिकित्सा पद्धति और होम्योपैथिक विभाग द्वारा तारीख 6 जून, 2002 के कार्यालय ज्ञापन में विनिर्दिष्ट शर्तों को अस्पताल पूरा करता है ।" ;
(ग) "उपनियम ( 2 ) में धारा 17 के खंड (2 ) के परंतुक के खंड (ii ) के उपखंड (ख ) के प्रयोजन के लिए " शब्दों, कोष्ठकों, अक्षरों और अंकों के स्थान पर निम्नलिखित शब्दों, कोष्ठक, अक्षर और अंक रखे जाएंगे ।
" धारा 17 के खंड ( 2) के उपखंड ( vi ) के परंतुक के खंड (ii) के उपखंड ( ख ) के प्रयोजनों के लिए"

चंद्रजीत सिंह, अवर सचिव टिप्पण: मूल नियम भारत के राजपत्र , असाधारण, भाग-2, खंड 3 (ii ) अधिसूचना सं. का.आ. 969 (अ) , तारीख 26 मार्च , 1962, द्वारा प्रकाशित किए गए थे जो समय - समय पर संशोधित किए गए थे और ऐसा अंतिम संशोधन, आयकर (अठारहवाँ संशोधन) नियम, 2004 अधिसूचना सं. का.आ. 1321 (अ) , तारीख 02.12.2004 द्वारा किया गया था ।

S.O. 1334 (E ). In exercise of the powers conferred by section 295 read with sub - clause (b ) of clause ( ii ) of the proviso to sub - clause (vi) of clause (2 ) of section [ भाग II- खण्ड 3 ( ii) ]

3 17 of the Income- tax Act, 1961 ( 43 of 1961 ) , the Central Board of Direct Taxes hereby makes the following rules further to amend the Income - tax Rules , 1962 , namely: -
1. (1) These rules may be called the Income - tax ( 19th Amendment ) Rules , 2004.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Income-tax Rules , 1962, in Rule 3A, -
(a) in sub - rule ( 1 ) , for the words , brackets , letter and figures " In granting approval to any hospital for the purposes of sub- clause (b ) of clause ( ii ) of the proviso to clause (2) of section 17 " , the following words , brackets , letter and figures shall be substituted, namely: -
" In granting approval to any hospital other than a hospital for Indian system of medicine and homoeopathic treatment for the purposes of sub - clause (b) of clause (ii) of the proviso to sub - clause (vi) of clause (2) of section 17" ;
(b) after sub - rule ( 1 ) , the following sub - rule shall be inserted , namely: - !
"( 1A) ' In granting approval to any hospital for Indian system of medicine and homoeopathic treatment for the purposes of sub-clause (b) of clause ( ii ) of the proviso to sub - clause (vi ) of clause 2 of section 17, the Chief Commissioner shall satisfy himself that the hospital fulfils the conditions specified vide Office Memorandum dated the 6th June , 2002, by the Department of Indian Systems of Medicine and Homoeopathy , Ministry of Health and Family Welfare for approval of private hospitals for Indian system of medicine and homoeopathic treatment to Central Government Health Scheme beneficiaries and Central Government employees ." ;
(c) in sub - rule (2), for the words , brackets , letter and figures " For the purpose of sub - clause ( b ) of clause (ii) of the proviso to clause (2) of section 17 " , the words , brackets , letter and figures shall be substituted, namely : -
"For the purpose of sub - clause (b ) of clause (ii ) of the proviso to sub- clause (vi) of clause (2) of section 17" .

Note :- The principal rules were published in the Gazette of India , Extraordinary Part- II , section 3 ( ii ) , dated the 26th March , 1962 Vide S.O. 969 (E) which was amended from time to time and last amended by Income - tax ( 18th Amendment) Rules , 2004 Vide Notification S.O. No. 1321 (E) dated 02.12.04 .
