का.आ. 1354(अ).-भारतीय प्रतिभूति और विनिमय बोर्ड, मगध स्टॉक एक्सचेंज एसोसिएशन जिसका अपना रजिस्ट्रीकृत कार्यालय १वीं मंजिल, आशियाना प्लाजा, बुध मार्ग, पटना-800001 में स्थित है द्वारा प्रतिभूति संविदा ( विनियमन ) अधिनियम, 1956 की धारा 3 के अधीन किए गए मान्यता के नवीकरण के लिए आवेदन पर विचार करते हुए, और यह समाधान हो जाने पर कि यह व्यापार के हित में होगा और ऐसाकरना लोक हित में भी होगा, एतद्वारा , प्रतिभूति संविदा (विनियमन) अधिनियम, 1956 की धारा 4 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त एक्सचेंज को मान्यता का नवीकरण उक्त अधिनियम की धारा 4 के अधीन 11 दिसम्बर, 2004 को प्रारम्भ होने वाली और 10 दिसम्बर, 2005 को समाप्त होने वाली एक वर्ष की कालावधि के लिए प्रतिभूतियों में संविदाओं की बाबत इसमें इसके नीचे कथित शर्तों अथवा जो इसके पश्चात् विहित या अधिरोपित की जायें के अध्यधीन प्रदान करता है: -
S.O. 1354 (E) . The Securities and Exchange Board of India, having considered the application for renewal of recognition, made under Section 3 of the Securities Contracts (Regulation) Act , 1956 by The Magadh Stock Exchange Association having its registered office at 9th Floor, Ashiana Plaza, Budh Marg , Patna- 800001, and being satisfied that it would be in the interest of the trade and also in the public interest so to do, hereby grants , in exercise of the powers conferred by Section 4 of the Securities Contracts (Regulation) Act, 1956 renewal of recognition to the said Exchange under Section 4ofthe said Act for a period of one year commencing on the 11th day of December 2004 and ending on the 10th day ofDecember 2005 in respect of contracts in securities subject to the conditions stated herein below or as may be prescribed or imposed hereafter: -
* The Exchange shall set up Settlement Guarantee Fund in compliance with SEBI circular SMD/POLICY/ SUB BROKER/Cir- 12/ 97 dated June 9, 1997, after final approval by SEBI.
* एक्सचेंज भाप्रविबो ( सेबी ) के तारीख 9 जून, 1997 के परिपत्र एसएमडी/पॉलिसी/सब-ब्रोकर/सीआईआर- 12/97 के अनुपालन में निपटान गारंटी निधि की स्थापना 'करेगा , भाप्रविबो द्वारा अंतिम अनुमोदन के पश्चात् ।
* Trading shall commence only after setting up of Settlement Guarantee Fund, duly approved by SEBI .
* व्यापार केवल निपटान गारंटी निधि, भाप्रविबो द्वारा सम्यक् रूप से अनुमोदित , की स्थापना करने के पश्चात् ही प्रारम्भहोगा।
* The Exchange shall repay the balance amount ofRs . 7,50,000 (Seven Lakhs fifty thousand only) towards refundable financial support extendedby SEBI to the Exchange .
* एक्सचेंज भाप्रविबो द्वारा एक्सचेंज को दिये गये प्रतिदेय वित्तीय समर्थन हेतु 7,50,000 रुपये ( केवल सात लाख पचास हजार रुपये ) की अतिशेष रकम प्रतिसंदत्त करेगा ।
