का.आ. 1372(अ).- केन्द्रीय सरकार ने भारत सरकार के पर्यावरण और वन मंत्रालय की अधिसूचना संख्यांक का.आ. 230 (अ) तारीख 25 फरवरी , 2003 द्वारा राष्ट्रीय तटीय जोन प्रबंध प्राधिकरण का दो वर्ष की अवधि के लिए गठन किया था और उक्त प्राधिकरण की अवधि का अवसान हो गया है;
और केन्दीय सरकार की यह राय है कि ऐसे प्राधिकरण का पुनर्गठन किया जाना चाहिए ;
अतः अब केन्द्रीय सरकार, पर्यावरण (संरक्षण) अधिनियम, 1986 (1986 का 29) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 3 की उपधारा (1 ) और उपधारा (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , राष्ट्रीय तटीय जोन प्रबंध प्राधिकरण (जिसे इसमें इसके पश्चात् प्राधिकरण कहा गया है) का इस आदेश के राजपत्र में प्रकाशन की तारीख से 31 जनवरी , 2005 अथवा नए प्राधिकरण के पुनर्गठन तक, जो पहले हो, अवधि के लिए पुनर्गठन करती है, प्राधिकरण में निम्नलिखित व्यक्ति होंगे, अर्थातः-

II प्राधिकरण को, तटीय पर्यावरण की क्वालिटी के संरक्षण करने और उसमें सुधार करने तथा तटीय क्षेत्रों में पर्यावरण प्रदूषण के निवारण, उपशमन और नियंत्रण के लिए निम्नलिखित उपाय करने की शक्ति होगी, अर्थातः-
(i) उक्त अधिनियम और तद्धीन बनाए गए नियमों या किसी अन्य विधि के अधीन जो उक्त अधिनियम के उद्देश्यों से संबंधित हों, क्षेत्र तटीय जोन प्रबंध प्राधिकरणों द्वारा की जाने वाली कार्रवाईयों का समन्वय । 3 [ भाग II- खण्ड 3 (ii) ]

(ii) राज्य तटीय जोन प्राधिकरणों और संघ राज्यक्षेत्र तटीय जोन प्रबंध प्राधिकरणों से प्राप्त तटीय जोन प्रबंधन योजनाओं में तटीय विनियमन जोन क्षेत्रों के वर्गीकरण में परिवर्तन अथवा उपांतरणों के प्रस्तावों की परीक्षा करना और उसके लिए केन्द्र सरकार को विनिर्दिष्ट सिफारिशें करना।
(iv) (क) उक्त अधिनियम और तदधीन बनाए गए नियमों या किसी अन्य विधि के अधीन जो उक्त अधिनियम के उद्देश्यों से संबंधित हों, उपबंधों को उल्लंघन करने वाले मामलों का पुनर्विलोकन करना और यदि आवश्यक समझा जाए तो उक्त अधिनियम की धारा 5 के अधीन निदेश जारी करना ।
(ख) ( iii ) (क) मामलों का स्वप्रेरणा से या किसी व्यष्टि या पर्यावरण के क्षेत्र में कार्य कर रहे किसी प्रतिनिधि निकाय या किसी संगठन द्वारा की गई शिकायत के आधार पर पुनर्विलोकन करना ।
(v) इस आदेश के पैरा ।। के उप पैरा ( iii ) (क) के अधीन जारी किए गए निदेश के अनुपालन की दशा में उक्त अधिनियम की धारा 19 के अधीन शिकायत फाइल करना; और (vi ) इस आदेश के पैरा 2 के उप पैरा (i) , (ii) और (iii) से उद्भुत मुद्दों से संबंधित तथ्यों को सत्यापित करने के लिए उक्त अधिनियम की धारा 10 के अधीन कार्रवाई करना ।
III . प्राधिकरण , संबंधित राज्य सरकार, संघ राज्यक्षेत्र सरकार/ प्रशासन, राज्य तटीय जोन प्रबंध प्राधिकरणों, संघ राज्यक्षेत्र तटीय जोन प्रबंध प्राधिकरणों, और अन्य संस्थाओं को तकनीकी सहायता देगा और उनका मार्गदर्शन करेगा यदि तटीय पर्यावरण के संरक्षण और उसमें सुधार से संबंधित विषय में यह आवश्यक हो। 4
IV . प्राधिकरण , राज्य तटीय जोन प्रबंध प्राधिकरणों और संघ राज्यक्षेत्र तटीय जोन प्रबंध प्राधिकरणों द्वारा प्रस्तुत की गई आवश्यक क्षेत्र विनिर्दिष्ट प्रबंध जोन , एकीकृत तटीय जोन प्रबंध योजनाओं और उनमें उपांतरणों की परीक्षा करेगा और उनका अनुमोदन करेगा ।
V. प्राधिकरण , तटीय विनियमन जोन प्रबंध से संबंधित विषयों में केन्द्र सरकार को नीति, नियोजन, अनुसंधान और विकास, उत्कर्ष केन्द्र स्थापित करना और उन्हें धन उपलब्ध कराने में सलाह दे सकेगा ।
VI . प्राधिकरण, तटीय विनियमन जोन से संबंधित स्थापित पर्यावरणीय मुद्दों का निपटान करेगा जो केन्द्रीय सरकार द्वारा उसे निर्दिष्ट किया जाए।
VII. प्राधिकरण, अपने क्रियाकलापों और राज्य तटीय जोन प्रबंध प्राधिकरणों तथा संघ राज्यक्षेत्र तटीय जोन प्रबंध प्राधिकरणों के क्रियाकलापों की रिपोर्ट छः मास में कम से कम एक बार केन्द्रीय सरकार को प्रस्तुत करेगा ।
VIII . प्राधिकरण की पूर्वगामी शक्तियाँ और कृत्य केन्द्रीय सरकार के पर्यवेक्षण और नियंत्रणाध के अधीन होंगे ।
IX. प्राधिकरण का मुख्यालय नई दिल्ली में होगा ।
X. इस प्रकार पुनर्गठित प्राधिकरण के विस्तार और अधिकारिता के अंतर्गत न आनेवाले विनिर्दिष्ट किसी विषयों का संबंधित कानूनी प्राधिकरण द्वारा निपटान किया जाएगा।

ORDER
NewDelhi , the 14th December, 2004
S.O. 1372 (E ) . Whereas , by an Order of the Government of India in the Ministry of Environment and Forests number S.O. 230 (E) dated 25th February , 2003 , the Central Government constituted the National Coastal Zone Management Authority for a period of one year;
And whereas, the Central Government is of the view that such an Authority must be re-constituted;
Now, therefore, in exercise of the powers conferred by sub -sections ( 1 ) and (3 ) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986 ) ( hereinafter referred to as the said Act ) , the Central Government hereby re-constitutes the National Coastal Zone Management Authority ( hereinafter referred to as the said Authority) consisting of the following persons with effect from the date of publication of this Order to 31st January , 2005 or till the new Authority is re-constituted , whichever is later . The composition of the Authority is as under :

II . The Authority shall have the power to take the following measures for protecting and improving the quality of the coastal environment and preventing, abating and controlling environmental pollution in the coastal areas , namely: -
(i) Co-ordination of actions by the State Coastal Zone Management Authorities and the Union territory Coastal Zone Management Authorities under the said Act and the rules made thereunder ,or under any other law which is relatable to the objects of the said Act;
(ii) examination of proposals for changes and modifications in classification of Coastal Regulation Zone areas and in the Coastal Zone Management Plan (CZMP ) received from the State Coastal Zone Management Authorities and the Union territory Coastal Zone Management Authorities and making specific recommendations to the Central Government therefor;
(iii ) (a) review of cases involving violations of the provisions of the said Act and the rules made thereunder, or under any other law which is relatable to the objects of the said Act and , if found necessary , issue directions under section 5 of the said Act ;
(b) review cases under ( iii ) ( a) either suo - moto , or on the basis of complaint made by an individual or representative body, or an organization functioning in the field of environment;

[PART II -SEC . 3 (ii)] (iv) file complaints , under section 19 of the said Act in cases of non-compliance of the directions issued by it under sub - paragraphs ( iii) ( a) of paragraph II of this Order;
(v) to take action under section 10 of the said Act to verify the facts conceming the issues arising from sub - paragraphs (i) ( ii ) and ( iii ) of paragraph II of this Order .
III The Authority shall provide technical assistance and guidance to the concemed State Govemment , Union territory Govemments or Administrations , the State Coastal Zone Management Authorities , the Union territory Coastal Zone Management Authorities , and other institutions or organizations as may be found necessary , in matters relating to the protection and improvement of the coastal environment .
IV The Authority shall examine and accord its approval to area specific management plans , integrated coastal zone management plans and modifications thereof submitted by the State Coastal Zone Management Authorities and Union territory Coastal Zone Management Authorities .
V The Authority may advise the Central Govemment on policy, planning , research and development , setting up of centres of excellence and funding, in matters relating to coastal regulation zone management.
VI The Authority shall deal with all environmental issues relating to coastal regulation zone which may be referred to it by the Central Govemment .
VII The Authority shall fumish report of its activities and the activities of the State Coastal Zone Management Authorities and Union territory Coastal Zone Management Authorities at least once in six months to the Central Govemment
VIII The foregoing powers and functions of the Authority shall be subject to the supervision and control of the Central Govemment .
IX. The Authority shall have its headquarters at New Delhi .
Χ. Any matter specifically not falling within the scope and jurisdiction of the Authority as so re -constituted shall be dealt with by the statutory authorities concemed
