सा.का.नि. 807 (अ). औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप , जिसे केन्द्रीय सरकार, औषधि और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, औषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात् बनाना चाहती है, उक्त धाराओं की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए, जिससे उनके प्रभावित होने की संभावना है , प्रकाशित करती है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से, जिसे उस राजपत्र की प्रतियां जिसमें यह अधिसूचना प्रकाशित की जाती है , जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि के पश्चात् विचार किया जाएगा;
2. आक्षेप या सुझाव , यदि कोई हों, भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय , निर्माण भवन, नई दिल्ली -110011 को भेजे जासकेंगे । आक्षेप या सुझाव जो उक्त नियमों की बाबत किसी व्यक्ति से ऊपर यथा विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त हो सकेंगे , उन पर केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
प्रारूप नियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन ( संशोधन ) नियम, 2004 है ।
(2) ये राजपत्र में उनके प्रकाशन की अंतिम तारीख को प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री नियम, 1945 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ):-
(i ) नियम 122च के उप - नियम ( 1 ) में, " स्पष्टीकरण " का लोप किया जाएगा;
( ii) नियम 122 छ में खंड ( v ) के पश्चात् निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात् -
" ( vi ) रक्त बैंक के प्रचालन/ मानव रक्त संघटकों के प्रसंस्करण के लिए अनुज्ञप्ति देने या नवीकरण करने के लिए आवेदन केवल रेडक्रास सोसाइटी अस्पताल, राज्य/संघ राज्यक्षेत्र रक्त संचरण परिषद् द्वारा अनुमोदित दातव्य न्यास या स्वैच्छिक संगठन द्वारा चलाए जा रहे रक्त बैंक द्वारा ही किया जाएगा:
परन्तु पूर्वोक्त उपबंध ऐसे विद्यमान रक्त बैंकों को लागू नहीं होगा जो इन नियमों के प्रारंभ से पूर्व विधिमान्य अनुज्ञप्ति रखते हैं और उस अनुज्ञप्ति की शर्तों का अनुपालन करते हैं । "

[PART II-SEC. 3(1)] (iii) उक्त नियमों की अनुसूची (च ) में भाग XII ख, में ' ज. विशेष रीजेंटस ' शीर्ष के अधीन क्रम संख्यांक 5 पर प्रविष्टि के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: --
" ( 5 ) हैपेटाइटिस और एच.आई.वी. 1 और 2 के लिए एलिसा या रैपिड या आर पी एच ए से परीक्षण किटें । "

रीता तेवतिया, संयुक्त सचिव टिप्पण: पूल नियम भारत के राजपत्र अधिसूचना सं. एफ. 28-10/45 - एच( 1 ) तारीख 21-12-1945 द्वारा प्रकाशित किए गए थे और अन्तिम संशोधन सा.का.नि. 738 ( अ ) तारीख 8-11-2004 द्वारा किया गया था ।

NOTIFICATION
New Delhi , the 13th December, 2004
G.S.R. 807 (E ) .-The following draft of certain rules further to amend the Drugs and Cosmetics Rules, 1945, which the Central Government proposes to make , after consultation with the Drugs Technical Advisory Board, in exercise of the powers conferred by Section 12 and Section 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940 ), is hereby published as required by the said sections for the information of all persons likely to be affected thereby and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period offorty -five days from the date on which the copies of the Official Gazette in which this notification is published, are made available to the public ;
2. Objections or suggestions if any, may be addressed to the Secretary, Ministry of Health & Family Welfare, Government of India , Nirman Bhawan , New Delhi - 110011 . Any objection or suggestion which may be received from any person with respect to the said rules before the expiry of the period as specified above will be taken into consideration by the Central Government.
DRAFT RULES
1. (1) These rules may be called the Drugs and Cosmetics (Amendment ) Rules , 2004.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Drugs and Cosmetics Rules , 1945 ( hereinafter referred to as the said rules ) :-
(i) in rule 122F, in sub - rule ( 1 ) , ' Explanation ' shall be omitted;
(ii) in rule 122G, after clause (v) , the following clause shall be inserted, namely:--
" (vi ) Application for grant or renewal of licence for operation ofBlood Bank/processing of human blood components shall be made by the Blood Bank run by Indian Red Cross Society, hospital, charitable trust or voluntary organization approved by the State /Union Territory Blood Transfusion Council only:
Provided that the aforesaid provision shall not apply to the existing blood banks holding valid licences, and complying with the conditions of the licence , before the commencement of these rules . " (iii) In schedule F to the said rules , in Part XII B, under the heading ' J. SPECIAL REAGENTS ' , for the entry at serial number (5) , the following shall be substituted, namely:-
"( 5) ELISA or Rapid or RPHA test kits for Hepatitis and HIV I and II . "
