का.आ. 1382 (अ).- राष्ट्रपति, संविधान के अनुच्छेद 77 के खण्ड ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार ( कार्य-आबंटन ) नियम, 1961 का और संशोधन करने के लिए निम्नलिखित नियम बनाते है, अर्थात्ः-
1. (1 ) इन नियमों का संक्षिप्त नाम भारत सरकार (कार्य- आबंटन ) ( दो सौ अठहत्तरवां संशोधन ) नियम , 2004 है ।
(2) ये तुरंत प्रवृत्त होंगे ।
2. भारत सरकार ( कार्य- आबंटन ) नियम , 1961 में, द्वितीय अनुसूची में, -
(क) " वाणिज्य और उद्योग मंत्रालय " शीर्षक के अधीन , " ख. औद्योगिक नीति और संवर्धन विभाग " उपशीर्षक के अधीन , प्रविष्टि 21 के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-
" 21. औद्योगिक और सेवा परियोजनाओं में प्रत्यक्ष विदेशी और अनिवासी विनिधान , जिसमें प्रवासी भारतीय कार्य मंत्रालय को सौंपे गए कृत्य सम्मिलित नहीं है । ";
(ख) " उत्तर पूर्वी क्षेत्र विकास मंत्रालय " शीर्षक के अधीन , प्रविष्टि 10 के पश्चात्, निम्नलिखित ' टिप्पण ' जोड़ा जाएगा , अर्थात्ः-
" टिप्पणः उत्तर पूर्वी क्षेत्र विकास मंत्रालय उत्तर पूर्व क्षेत्र में मुख्यतः विकास तथा कल्याण कार्य से जुड़े विभिन्न मंत्रालयों/विभागों से समन्वय स्थापित करेगा , जबकि संबंधित मंत्रालय/विभाग उनको आबंटित विषयों के संबंध में स्वयं उत्तरदायी होंगे । ";

[PART II-SEC. 3 (ii)] (ग) " विदेश मंत्रालय " शीर्षक के अधीन, -
(i) प्रविष्टि 12 के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्ः-
" 12. भारत में विभिन्न स्कीमों के अधीन अध्ययन के लिए विदेशी छात्रों को छात्रवृत्ति जिसमें अनिवासी भारतीय/ भारतीय मूल के छात्रों को दी जाने वाली छात्रवृत्ति नहीं है । " ; और
(ii) प्रविष्टि 22 के स्थान पर, निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्ः-
" 22. देश बाह्य प्रचार जिसमें प्रवासी भारतीय कार्य से संबंधित ऐसा प्रचार सम्मिलित नहीं है । ";
(घ) " वित्त मंत्रालय " शीर्षक के अधीन , " क. आर्थिक कार्य विभाग " उपशीर्षक के अधीन ,- (i) प्रविष्टि 4 के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-
"4. विदेशी और अनिवासी भारतीय विनिधान जिसमें प्रवासी भारतीय कार्य मंत्रालय को सौंपे गए कृत्य और औद्योगिक और सेवा परियोजनाओं में प्रत्यक्ष विदेशी और अनिवासी भारतीय निवेश सम्मिलित नहीं है । ";
(ii) प्रविष्टि 19 के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्ः-
" 19. देश में आने वाले संयुक्त राष्ट्र के स्वयंसेवकों सहित भारत में विदेशी स्वयंसेवक कार्यकमों से संबंधित सभी मामले किन्तु इसमें संयुक्त राष्ट्र के स्वयंसेवकों के अंतर्गत प्रवासी भारतीय स्वयंसेवक तथा बहिर्गामी स्वयंसेवकों के लिए भारत में किये जाने वाले कार्यक्रम सम्मिलित नहीं है । " ;
(ङ) " श्रम और रोजगार मंत्रालय " शीर्षक के अधीन , प्रविष्टि 22 का लोप किया जाएगा;
(च) " प्रवासी भारतीय कार्य मंत्रालय " शीर्षक के अधीन , विद्यमान प्रविष्टि 1 के स्थान पर, निम्निलिखित प्रविष्टियां रखी जाएंगी , अर्थात्ः-
"1 . प्रवासी भारतीयों से संबंधित सभी मामले जिनमें भारतीय मूल के व्यक्ति तथा अनिवासी भारतीय समाविष्ट है, उन प्रविष्टियों को छोड़कर जो विनिर्दिष्टतः अन्य विभागों को आबंटित की गई है ।
2. समग्न सरकारी नीतियों के अनुकर नवाचारी विनिधानों और नीतिगत पहलों को शामिल करते हुए भारत में विशेषतया प्रवासी भारतीयों के लिए अनन्य विशेष आर्थिक जोनों जैसे क्षेत्रों में , प्रवासी भारतीयों द्वारा विनिषा संवर्धन । 3

3. विदेशी विनिधान संवर्धन बोर्ड और विदेशी विनिधान कार्यान्वयन प्राधिकरण में प्रतिनिधित्व होना।
4. विनिधान आयोग से अंतःकिया करना तथा उक्त आयोग द्वारा इस मंत्रालय से परामर्श लिया जाना तथा प्रवासी भारतीयों के विदेशी प्रत्यक्ष विनिधान से संबंधित सभी मामलों के बारे में इस मंत्रालय को सूचित करते रहना ।
5. उत्प्रवास अधिनियम , 1983 (1983 का 31 ) के अधीन भारत से प्रवासी देशों को होने वाला संपूर्ण उत्प्रवास और उत्प्रवासियों की वापसी ।
6. प्रवासी भारतीय दिवस , प्रवासी भारतीय सम्मान पुरस्कारों और प्रवासी भारतीय केन्द्र से संबंधित मामले ।
7. भारत में प्रवासी भारतीय स्वयंसेवकों के लिए कार्यक्रमों से संबंधित मामले ।
8. विदेश मंत्रालय से परामर्श और समन्वय करते हुए ऐसे देशों , जहां प्रवासी भारतीयों की गहन आबादी है , में प्रवासी भारतीय कार्य केन्द्रों की स्थापना और उनका प्रशासन ।
9. भारतीय मूल के व्यक्तियों/ अनिवासी भारतीयों को रोजगार सहायता संबंधी नीति , जिसमें सरकारी सेवा में आरक्षण सम्मिलित नहीं है ।
10. मानव संसाधन विकास मंत्रालय और संस्कृति मंत्रालय से परामर्श करके , भारत में ऐसी विभिन्न शैक्षिक , तकनीकी और साँस्कृतिक संस्थाओं , जहां अनिवासी भारतीय/ भारतीय मूल के छात्रों के लिए विवेकाधीन कोटा विद्यमान है, में अनिवासी भारतीय/ भारतीय मूल के छात्रों के प्रवेश से संबंधित सूचना एकत्र करना और उसका प्रचार - प्रसार करना ।
11. विदेश मंत्रालय से परामर्श करके विभिन्न स्कीमों के अधीन भारत में अध्ययन के लिए अनिवासी भारतीय/ भारतीय मूल के छात्रों को छात्रवृत्ति ।
12. प्रवासी भारतीय समुदाय और भारत के मध्य सुदृढ़ संबंधों को सुनिश्चित करने के लिए विपणन और संचार कार्यनीतियों का विकास ।
13. आर्थिक कार्य विभाग से परामर्श करके सरकारी और मूल संगठनों को अनिवासी भारतीयों/ भारतीय मूल के व्यक्तियों के योगदान संबंधी मामले ।
14. प्रवासी भारतीयों से संबंधित मामलों पर राज्य सरकारों को दिशा- निर्देश तथा उनसे सहयोग और समन्वय । THE GAZETTE OF INDIA: EXTRAORDINARY
[PART II-SEC. 3 (ii)) 15. भारतीय सांस्कृतिक संबंध परिषद में प्रतिनिधित्व होना ।
16. श्रम और रोजगार मंत्रालय की सहमति से विदेशों में कुशल जनशक्ति की आवश्यकताओं को पूरा करने के लिए व्यावसायिक और तकनीकी प्रशिक्षण प्रदान करने हेतु संस्थाओं की स्थापना ।
17. विदेश मंत्रालय के परामर्श से और विदेश नीति के उद्देश्यों के अनुरूप प्रवासी भारतीय मामलों के संबंध में देश बाह्य प्रचार ।
18. व्यापार , संस्कृति , पर्यटन , मीडिया , युवा मामले , स्वास्थ्य, शिक्षा, विज्ञान और प्रौद्योगिकी जैसे क्षेत्रों में संबंधित मंत्रालयों से परामर्श करके भारत के साथ प्रवासी भारतीयों की अंतःकिया के लिए नई पहलें ।
टिप्पणः सभी संबंधित मंत्रालयों को , उनके द्वारा किए जाने वाले प्रवासी भारतीयों संबंधी सभी कार्यों, जैसे पीआईओ कार्ड स्कीम , दोहरी नागरिकता संबंधी मुद्दे, प्रवासी भारतीयों के गैर सरकारी संगठनों के एफसीआरए संबंधी मामलों , में प्रवासी भारतीय कार्य मंत्रालय से परामर्श करना होगा । इसी प्रकार भारतीय रिजर्व बैंक प्रवासी भारतीयों के निक्षेपों को नियंत्रित करने वाली नीतियां और स्कीमें तैयार करने के दौरान प्रवासी भारतीय कार्य मंत्रालय से परामर्श करेगा । ";
(छ ) " कार्मिक, लोक शिकायत और पेंशन मंत्रालय " शीर्षक के अधीन , " क. कार्मिक और प्रशिक्षण विभाग " उपशीर्षक के अधीन , प्रविष्टि 7 का लोप किया जाएगा । "।

NOTIFICATION
New Delhi , the 15th December, 2004
15thDecember , 2004 S.O. 1382(E). In exercise of the powers conferred by clause ( 3 ) of article 77 of the Constitution , the President hereby makes the following rules further to amend the Government of India (Allocation of Business) Rules, 1961 , namely: -
eighth 1. (1) These rules may be called the Government of India (Two hundred and seventy (Allocation of Business ) Amendment) Rules , 2004 .
(2) They shall come into force at once .
2. In the Government of India (Allocation of Business ) Rules , 1961 , in the Second Schedule , -
(A) under the heading " MINISTRY OF COMMERCE AND INDUSTRY ( VANIJYA AUR UDYOG MANTRALAYA) " , under the sub -heading "B. DEPARTMENT OF INDUSTRIAL POLICY AND PROMOTION ( AUDYOGIK NITI AUR SAMVARDHAN VIBHAG ) " , for entry 21 , the following entry shall be substituted , namely: -
"21. Direct foreign and non - resident investment in industrial and service projects excluding functions entrusted to the Ministry of Overseas Indian Affairs . " ;

[PART II-SEC . 3(ii ) ] (B) under the heading " MINISTRY OF DEVELOPMENT OF NORTH EASTERN REGION ( UTTAR POORVI KSHETRA VIKAS MANTRALAYA ) " , after entry 10 , the following 'Note' shall be added , namely: -
"Note: While the Ministry of Development of North Eastern Region would coordinate with various Ministries/Departments primarily concerned with development and welfare activities in North Eastern Region , respective Ministries /Departments would be responsible in respect of subjects allocated to them." ;
(C) under the heading " MINISTRY OF EXTERNAL AFFAIRS (VIDESH MANTRALAYA ) " , -
(i) for entry 12 , the following entry shall be substituted , namely: -
"12. Scholarship to foreign students excluding scholarship to Non-Resident Indians (NRIs) / Persons of Indian Origin ( PIO ) students for study in India under different schemes . " ; and
( ii) for entry 22, the following entry shall be substituted , namely:-
" 22. External publicity excluding such publicity concerning overseas Indians ' affairs . " ;
( D) under the heading " MINISTRY OF FINANCE ( VITTA MANTRALAYA ) " , under the sub - heading " A. DEPARTMENT OF ECONOMIC AFFAIRS ( ARTHIK KARYA VIBHAG ) " , -
( i ) for entry 4, the following entry shall be substituted, namely: -
"4. Foreign and Non- Resident Indian Investment excluding functions entrusted to the Ministry of Overseas Indian Affairs and Direct Foreign and Non-Resident Indian Investment in Industrial and Service projects . " ;

(ii) for entry 19 , the following entry shall be substituted , namely: -
"19. All matters relating to the Foreign Volunteers Programmes in India including the incoming United Nations Volunteers ( UNV) but excluding programmes in India for overseas Indian Volunteers and outgoing volunteers under UNV . " ;
(E) under the heading " MINISTRY OF LABOUR AND EMPLOYMENT ( SHRAM AUR ROZGAR MANTRALAYA) " , entry 22 shall be omitted;
( F) under the heading " MINISTRY OF OVERSEAS INDIAN AFFAIRS ( PRAVASI BHARTIYA KARYA MANTRALAYA) " , for the existing entry 1 , the following entries shall be substituted , namely: -
" 1. All matters relating to Overseas Indians comprising Persons of Indian Origin ( PIO) and Non - Resident Indians ( NRIs) excluding entries specifically allotted to other Departments .
2. Promotion of investment by Overseas Indians in India including innovative investments and policy initiatives consistent with the overall Government policies particularly in areas such as exclusive Special Economic Zones ( SEZs ) for Overseas Indians .
3. To be represented in the Foreign Investment Promotion Board and the Foreign Investment Implementation Authority .
4. To interact with the Investment Commission and to be consulted by the said Commission and to be kept informed of all matters relating to Foreign Direct Investment ( FDI ) by Overseas Indians.
5. All emigration under the Emigration Act , 1983 ( 31 of 1983 ) from India to overseas countries and the return of emigrants .
6. Matters relating to Pravasi Bharatiya Divas , Pravasi Bharatiya Samman Awards and Pravasi Bharatiya Kendra .
7. Matters relating to programmes in India for overseas Indian Volunteers.
8. Setting up and administration of Centres for Overseas Indians ' Affairs in countries having major concentration of Overseas Indians in consultation and coordination with the Ministry of External Affairs .

[PART II-SEC . 3 (ii)] 9. Policy regarding employment assistance to PIO /NRIs excluding reservations in Government service .
10. Collection and dissemination of information concerning admission of NRI /PIO students to various educational , technical and cultural institutions in India wherever discretionary quota for NRI /PIO students exists , in consultation with the Ministry of Human Resource Development and the Ministry of Culture .
11. Scholarship to NRI /PIO students for study in India under different schemes in consultation with the Ministry of External Affairs.
12. Development of marketing and communication strategies to ensure strong links between the Overseas Indian community and India .
13. Matters relating to NRI /PIO contributions to the Government and parental organisations in consultation with the Department of Economic Affairs .
14. Guidance to and Cooperation with the State Governments and coordination with them on matters related to Overseas Indians.
15. To be represented in the Indian Council of Cultural Relations .
16. Establishment of institutions to impart vocational and technical training to meet the requirements of skilled manpower abroad with the concurrence of the Ministry of Labour and Employment.
17. External Publicity relating to Overseas Indians ' affairs in consultation with the Ministry of External Affairs and in consonance with foreign policy objectives .
18. New initiatives for interaction by Overseas Indians with India in the fields such as Trade , Culture , Tourism , Media , Youth Affairs , Health , Education , Science and Technology in consultation with concerned Ministries .
Note: The Ministry of Overseas Indian Affairs will be consulted by the concerned Ministries in all matters concerning Overseas Indians handled by them such as PIO Card Scheme , dual citizenship issues , FCRA matters of Non - Governmental Organisations ( NGOs ) of Overseas Indians . Similarly Reserve Bank ofIndia ( RBI ) will consult Ministry of Overseas Indian Affairs while framing policies and schemes governing deposits by overseas Indians. ";
