प्रभारी आ.अ. 203 ( अ ) .- यतः केरल राज्य की विधान सभा के निर्वाचित सदस्यों द्वारा निर्वाचित श्री वी. वी. राघवन का स्थान उकी जाने के कारण उनकी पदावधि जो 1 जुलाई, 2006 सहित उस तारीख तक थी, के अवसान से पूर्व 27 अक्तूबर, 2004 से रिक्त हो गया है; और यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप- निर्वाचन कराना है;
(अ ) केरल राज्य की विधान सभा के निर्वाचित सदस्यों से यह अपेक्षा करता है कि वे 8 जनवरी, 2005 ( शनिवार ) से पूर्व तथा उक्त अधिनियम और तद्धीन बनाए गए नियमों और किए गए आदेशों के उपबन्धों के अनुसार राज्य सभा में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित कर दें;
(आ) उक्त निर्वाचन के संबंध में:-
27 दिसम्बर , 2004 ( सोमवार ) (क) नाम- निर्देशन करने की अन्तिम तारीख
28 दिसम्बर , 2004 ( मंगलवार) (ख) नाम- निर्देशन की संवीक्षा की तारीख .
30 दिसम्बर, 2004 ( बृहस्पतिवार) (ग) अभ्यर्थिताएं वापस लेने की अन्तिम तारीख
6 जनवरी , 2005 ( बृहस्पतिवार ) (घ) वह तारीख, जिसको यदि आवश्यक हुआ तो मतदान होगा
-8 जनवरी , 2005 ( शनिवार ) (ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा
नियत करता है; और
( इ ) 9.00 बजे पूर्वाह्न से 4.00 बजे अपराह्न तक का समय, ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ तो, निर्वाचन के लिए उपर्युक्त विनिर्दिष्ट तारीख को, मतदान होगा ।

NOTIFICATION
New Delhi , the 20th December , 2004
Ο.Ν. 203 (E) . Whereas , the seat of Shri V.V. Raghavan in the Council of States , elected by the elected members ofthe Legislative Assembly of the State of Kerala, has become vacant on 27th October, 2004, by the reason ofhis death, before the expiration of his term of office which was up to and including the 1st July, 2006; and
Whereas , a bye - election is tobe held for the purpose of filling the vacancy so caused;
Now, therefore, in pursuance of Section 147 , Sub- section ( 1 ) of Section 39 and Section 56 of the Representation ofthe People Act , 1951 (43 of 1951 ) , the Election Commission of India hereby-
(A) calls upon the elected members of the Legislative Assembly of the State of Kerala to elect, before 8th January, 2005 ( Saturday ) and in accordance with the provisions of the said Act and of the rules and orders made thereunder, a person for the purpose of filling the said vacancy in the Council of States;
(B) appoints , with respect to the said election:
(i) the 27th December , 2004 (Monday ), as the last date for making nominations ;
(ii) the 28th December, 2004 ( Tuesday ) , as the date for the scrutiny of nominations ;
( iii) the 30th December , 2004 ( Thursday) , as the last date for the withdrawal of candidatures ;
( iv) the 6th January, 2005 (Thursday) , as the date on which a poll shall , if necessary, be taken ; and (v) the 8th January, 2005 (Saturday) , as the date before which the election shall be completed; and (C) fixes the hours from 9:00 A.M. to 4:00 P.M. , as the hours during which the poll shall , if necessary , be taken on the date specified above for the election .

आ.अ. 204( अ).- लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 21 के अनुसरण में और धारा 22 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निर्वाचन आयोग , केरल राज्य सरकार के परामर्श से एतद्वारा तारीख 20 दिसम्बर, 2004 को भारत के राजपत्र में प्रकाशित आयोग की अधिसूचना के अनुसरण में इस राज्य में राज्य सभा के लिए द्विवार्षिक निर्वाचन के संबंध में:-
( i ) नीचे की सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट अधिकारी को रिटर्निंग आफिसर के रूप में पदाभिहित करता है; और (ii ) उक्त सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट अधिकारी को, रिटर्निंग आफिसर की उसके कृत्यों के पालन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है ।

NOTIFICATION
New Delhi , the 20th December, 2004
Ο.Ν. 204(E) . In pursuance of Section 21 , and in exercise of the powers conferred by sub -section ( 1) of Section 22, of the Representation of the People Act, 1951 (43 of 1951 ), the Election Commission of India, in consultation with the Government of the State of Kerala, hereby-
(i ) designates the officer, specified in column (1 ) of the Table below, to be the Returning Officer; and (ii) appoints the officer , specified in column (2) of the said Table, to be the Assistant Returning Officer to assist the Returning Officer in the performance of his functions;
in respect of the bye-election to the Council of States , to be held in that State in pursuance of the Commission's notification, published in the Gazette of India on 20th December , 2004:-
