सा.का.नि. 842 (अ ).- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए रेलवे बोर्ड सचिवालय सेवा नियम, 1969 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. ( 1 ) ये नियम रेलवे बोर्ड सचिवालय सेवा ( संशोधन ) नियम, 2004 कहलाएंगे ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. रेलवे बोर्ड सचिवालय सेवा नियम, 1969 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) , के नियम 2 में

( i ) खंड ( घ) के स्थान पर, निम्नलिखित खण्ड रखा जाएगा , अर्थात्: -

" (घ ) किसी भी काडर के संबंध में, " प्राधिकृत काडर संख्या " से उस काडर के ऐसे कर्त्तव्यपद अभिप्रेत हैं, जिनके प्रति नियमित नियुक्तियां की जा सकेंगी; "

( ii ) खंड ( ञ ) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्: -

" ( ञ ) " स्थायी अधिकारी " से ऐसा व्यक्ति अभिप्रेत है, जिसकी प्रारंभिक सेवा श्रेणी में पुष्टि कर दी गई है । " (iii) खंड ( ट) के स्थान पर निम्नलिखित खंड रखे जाएंगे, अर्थात्: -

(ट) " परिवीक्षाधीन व्यक्ति " से सीधी भर्ती किए जाने वाला ऐसा व्यक्ति अभिप्रेत है , जिसे किसी नियमित रिक्तिपर किसी श्रेणी में परिवीक्षा पर नियुक्त किया गया है ।

( टक ) किसी श्रेणी के संबंध में " नियमित अधिकारी " से ऐसा व्यक्ति अभिप्रेत है, जिसे (1) [PART II-SEC. 3 (i) ] THE GAZETTE OF INDIA: EXTRAORDINARY

या तो सीधी भर्ती अथवा चयन सूची से प्रोन्नति द्वारा नियमित रिक्ति पर नियुक्त किया गया है तथा जिसने नियम 11 के अधीन, यथास्थिति, परिवीक्षा अथवा परीक्षण अवधि, नियुक्ति प्राधिकारी के समाधानप्रद रूप में पूरी कर ली है.

(ट ख) किसी श्रेणी के संबंध में " नियमित रिक्तियों " में वे रिक्तियां सम्मिलित हैं जो- (i) अनिश्चितकाल के लिए उपलब्ध है और

(ii ) प्रतिनियुक्ति या स्थानांतरण या अधिकारी के छुट्टी चले जाने के कारण एक वर्ष या उससे अधिक के लिए उत्पन्न हुई है. "

3. उक्त नियमों के नियम 4 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्ः-

"सेवा की प्राधिकृत काडर संख्या ( 1 ) सेवा की विभिन्न श्रेणियों की प्राधिकृत काडर संख्या निम्नानुसार होगी, अर्थात्ः-

चयन श्रेणी: - उप सचिव या संयुक्त निदेशक

श्रेणी I- अवर सचिव या उप निदेशक

सहायक :

(2) केंद्रीय सरकार रेल मंत्रालय में किसी श्रेणी में समय - समय पर आवश्यक पाई जाने वाली अस्थायी वृद्धि कर सकेगी और किसी श्रेणी में ऐसी अस्थायी वृद्धियां प्रत्येक वर्ष समीक्षाधीन होंगी.

(3) तथापि विभिन्न श्रेणियों की प्राधिकृत काडर संख्या वह होगी, जो केंद्रीय सरकार द्वारा रेल मंत्रालय में समय- समय पर अवधारित की जाए . "

4. उक्तनियमों के, नियम 7 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्ः-

"7. पुष्टीकरण " - सीधी भर्ती किए गए व्यक्ति का पुष्टिकरण सेवा की संबंधित श्रेणी में किया जाएगा, न कि सेवा के किसी विनिर्दिष्ट कर्त्तव्यपद पर. "

5. उक्त नियमों के नियम 8 में-

(i) उप नियम ( 1 ) के स्थान पर निम्नलिखित उप नियम रखा जाएगा, अर्थात्ः-

"(1 ) चयन श्रेणी में रिक्तियां श्रेणी-1 के ऐसे नियमित अधिकारियों की प्रोन्नति द्वारा भरी जाएंगी, जिन्होंने उस श्रेणी में पांच वर्ष से अन्यून अनुमोदित सेवा की है और जिन्हें उप [ भाग II- खण्ड 3 (i) ]

नियम (5) के अधीन चयन श्रेणी के लिए तैयार की गई चयन सूची में सम्मिलित कर लिया गया है . "

(ii) उप नियम (3 ) के स्थान पर निम्नलिखित उप नियम रखा जाएगा, अर्थात्ः-

" (3) श्रेणी-1 में रिक्तियां, ऐसे नियमित अनुभाग अधिकारियों की प्रोन्नति द्वारा भरी जाएंगी, जिन्होंने उस श्रेणी में आठ वर्ष से अन्यून अनुमोदित सेवा की है, और रेलवे बोर्ड सचिवालय आशुलिपिक सेवा श्रेणी- क और ख ( सम्मिलित) श्रेणी के ऐसे नियमित अधिकारियों की जिन्होंने उस श्रेणी में आठ वर्ष से अन्यून की अनुमोदित सेवा की है , तथा जिन्हें उप नियम (5) के उपबंधों के अनुसार सेवा की श्रेणी-1 के लिए तैयार की गई चयन सूची में शामिल कर लिया गया है, प्रोन्नति द्वारा भरी जाएंगी."

स्पष्टीकरण : इस नियम के प्रयोजनों के लिए रेलवे बोर्ड सचिवालय आशुलिपिक सेवा के श्रेणी 'क' के अधिकारियों के मामले में "अनुमोदित सेवा " में यथास्थिति अगस्त, 1969 से पहले रेलवे बोर्ड सचिवालय आशुलिपिक सेवा के श्रेणी I में अनुमोदित सेवा की संपूर्ण अवधि और 1 अगस्त , 1969 के पश्चात् श्रेणी 'ख' में की गई अनुमोदित सेवा की आधी अवधि शामिल होगी. "

(iii) उप नियम (4) का लोप किया जाएगा.

6. उक्तनियमों के नियम 9 में, -

(i) उप नियम (1 ) के स्थान पर निम्नलिखित उप नियम रखा जाएगा, अर्थात्ः

"(1 ) अनुभाग अधिकारी श्रेणी में नियमित रिक्तियां निम्नलिखित आधार पर भरी जाएंगी, अर्थात्: -

(क) अनुभाग अधिकारी श्रेणी में नियमित रिक्तियों की बीस प्रतिशत रिक्तियां आयोग द्वारा इस प्रयोजन के लिए समय- समय पर आयोजित प्रतियोगी परीक्षा के परिणामों के आधार पर सीधी भर्ती द्वारा भरी जाएंगी.

(ख) अस्सी प्रतिशत रिक्तियां अनुभाग अधिकारी श्रेणी के लिए चयन सूची में शमिल किए गए व्यक्तियों की नियुक्ति करके भरी जाएंगी और ऐसी नियुक्तिसिवाय उस स्थिति में जबकि कोई व्यक्ति उसकी बारी आने पर ऐसी नियुक्ति के लिए लेखबद्ध किए जाने वाले कारणों से उपयुक्त न समझा गया हो, चयन सूची में ज्येष्ठता के क्रम में की जाएंगी:

परंतु किसी भर्ती वर्ष में, या तो सीधी भर्ती या अनुभाग अधिकारी श्रेणी के लिए चयन सूची में शामिल व्यक्तियों की नियुक्ति द्वारा रिक्तियों को भरने के लिए पर्याप्त संख्या में अभ्यर्थी उपलब्ध नहीं होंतो, ऐसी रिक्तियां अग्रणीत की जाएंगी और पश्चातवर्ती भर्ती वर्ष में उसी पद्धति से भरी जाने वाली रिक्तियों की संख्या में जोड़ दी जाएंगी.

परंतु यह और कि, ऐसी किन्हीं रिक्तियों को उस भर्ती वर्ष से जिससे रिक्तियां संबंधित हैं, के पश्चात् दो भर्ती वर्षों से अनधिक के लिए अग्रणीत नहीं की जाएंगी तथा उसके पश्चात्, भर्ती की किसी पद्धति की ऐसी रिक्तियां यदि कोई हों, अन्य भर्ती पद्धति में अतिरिक्त रिक्तियों के रूप में अंतरित की जाएंगी.

(ii) उप नियम (2) के परंतुक का लोप किया जाएगा.

(iii) उप नियम (3 ) का लोप किया जाएगा.

(iv) उप नियम (6) के स्थान पर निम्नलिखित उप नियम रखा जाएगा, अर्थात्ः-

"(6) सहायक श्रेणी में रिक्तियां निम्नलिखित आधार पर भरी जाएंगी, अर्थात्ः-

(क) सहायक श्रेणी में नियमित रिक्तियों की पचास प्रतिशत रिक्तियां, कर्मचारी चयन आयोग द्वारा इस प्रयोजन के लिए समय- समय पर आयोजित प्रतियोगी परीक्षा के परिणामों के आधार पर सीधी भर्ती द्वारा भरी जाएंगी;

(ख) नियमित रिक्तियों की पचास प्रतिशत रिक्तियां सहायक श्रेणी के लिए चयन सूची में सम्मिलित व्यक्तियों की नियमित नियुक्ति द्वारा भरी जाएंगी."

(v) उप नियम (6क) के स्थान पर निम्नलिखित उप नियम रखा जाएगा, अर्थात्ः-

"(6क) उप नियम (6) के अधीन ऐसे व्यक्तियों की नियुक्तियां, जिनके नाम चयन सूची में सम्मिलित किए गए हैं, उस चयन सूची में ज्येष्ठता के क्रम में कीजाएंगी.

परंतु यह कि यदि कोई व्यक्ति उसकी बारी आने पर ऐसी नियुक्ति के लिए उपयुक्त नहीं समझा जाता है तो उसके कारणों को लेखबद्ध किया जाएगा.

परंतु यह और भी कि यदि किसी भर्ती वर्ष में सीधी भर्ती द्वारा रिक्तियों [भाग II- खण्ड 3 ( i ) ]

5 की पूर्ति के लिए पर्याप्त संख्या में अभ्यर्थी उपलब्ध नहीं होते हैं तो ऐसी रिक्तियां, सहायक श्रेणी की चयन सूची में सम्मिलित व्यक्तियों की नियुक्ति करके भरी जाएंगी. "

7 . उक्तनियमों के नियम 9- क का लोप किया जाएगा.

8. उक्त नियमों के नियम 10 के स्थान पर, निम्नलिखित नियम रखा जाएगा, अर्थात्-

" 10. नियमित रिक्ति के प्रति अस्थायी नियुक्तियां करने की शक्तिः कोई नियमित रिक्ति, संबद्ध श्रेणी में अस्थायी रिक्तियों की नियुक्ति को शासित करने वाले उपबंधों के अनुसार तब तक अस्थायी रूप से भरी जा सकेगी जब तक कि यह नियतिम नियुक्तियों को शासित करने वाले उपबंधों के अनुसार नहीं भरी जाती.

9. उक्तनियमों के नियम 14 में-

(i) उप नियम (3) के स्थान पर, निम्नलिखित उप नियम रखा जाएगा, अर्थात्ः-

"(3) उप नियम (4) में यथाउपबंधित के सिवाय , नियत दिवस के पश्चात् किसी श्रेणी में नियुक्त व्यक्तियों की ज्येष्ठता निम्नलिखित रीति में अवधारित की जाएगी, अर्थात्:-

(i) चयन श्रेणी और श्रेणी I नियत दिन के पश्चात् श्रेणी में नियुक्त अधिकारियों की पारस्परिक ज्येष्ठता उस क्रम में विनियमित की जाएगी जिसमें श्रेणी की चयन सूची में उनके नामों को सम्मिलित किया गया है .

परंतु यह कि चयन सूची में शमिल कोई ऐसा अधिकारी जो नियुक्ति प्राधिकारी को स्वीकार्य कारणों से उस श्रेणी में नियुक्ति के लिए किसी समय इन्कार करता है तो उस श्रेणी में उसकी नियुक्ति होने पर तत्पश्चात् किसी भी समय उस अधिकारी के ठीक पश्चात रखा जाएगा जो चयन सूची में उस श्रेणी में सबसे अंत में नियुक्त किया गया था.

(ii) अनुभाग अधिकारी श्रेणी और सहायक श्रेणी:-

क. नियमित अधिकारी (क) सीधी भर्ती वाले व्यक्ति , उस प्रतियोगी परीक्षा की योग्यता सूची में, जिसके परिणामों के आधार पर वे भर्ती किए गए हैं , परस्पर क्रमानुसार क्रमबद्ध किए जाएंगे और किसी पूर्ववर्ती परीक्षा के सीधी भर्ती वाले व्यक्ति , पश्चातवर्ती परीक्षा वाले व्यक्तियों से ज्येष्ठ माने जाएंगे.

परंतु यह कि यथास्थिति आयोग अथवा कर्मचारी चयन आयोग , द्वारा आयोजित प्रतियोगी परीक्षा के माध्यम से भर्ती किए गए व्यक्तियों की ज्येष्ठता-

(i) उनके मामलों में जिनमें नियुक्ति प्रस्ताव रद्द करने के पश्चात् पुनः प्रवर्तित कर दिया गया हो, अथवा

(ii) जिनकी प्रारंभ में विधिमान्य नियुक्ति नहीं की गई हैं किंतु उत्तरवर्ती परीक्षा या परीक्षाओं के परिणामों के आधार पर भर्ती किए गए अभ्यर्थियों की नियुक्ति के पश्चात् नियुक्त किए गए हों,

वह होगी, जो कि रेल मंत्रालय में केंद्रीय सरकार द्वारा आयोग के परामर्श से अवधारित की जाए .

(ख) किसी श्रेणी की चयन सूची से, उस श्रेणी में नियमित रूप से नियुक्त किए गए व्यक्तियों को, परस्पर उस क्रम में क्रमबद्ध किया जाएगा जिस क्रम में वे नियुक्त किए गए हैं;

(ग) किसी श्रेणी में सीधी भर्ती वाले व्यक्तियों और उसी श्रेणी के लिए चयन सूची से नियमित रूप से नियुक्त व्यक्तियों की परस्पर ज्येष्ठता , अनुसूची में विनिर्दिष्ट उपबंधों के अनुसार विनियमित होगी,

ख. अस्थायी अधिकारी : श्रेणी की चयन सूची में सम्मिलित व्यक्ति, परस्पर उस क्रम में क्रमबद्ध किए जाएंगे जिसमें वे चयन सूची में सम्मिलित किए गए हैं और वे, उस श्रेणी में अन्य सभी अस्थायी अधिकारियों से ज्येष्ठ होंगे , जो परस्पर उस क्रम में क्रमबद्ध होंगे , जिसमें वे उस श्रेणी में दीर्घकालिक नियुक्ति के लिए अनुमोदित किए गए हैं;

परंतु चयन सूची में सम्मिलित कोई ऐसा अधिकारी , जो नियुक्ति प्राधिकारी को स्वीकार्य कारणों से इस श्रेणी में नियुक्ति किए जाने से किसी समय इन्कार करता है तो उस श्रेणी में उसकी नियुक्ति होने पर तत्पश्चात् किसी भी समय उस अधिकारी के ठीक पश्चात् रखा जाएगा जो चयन सूची में से उस श्रेणी में सबसे अंत में नियुक्त किया गया था. " (ii) उप नियम (4) में, " अधिष्ठायी " शब्द के स्थान पर " नियमित " शब्द रखा जाएगा.

10. उक्त नियमों की अनुसूची में-

(i) विनियम 2 के उप-विनियम (1 ) में-

(क) "प्रत्याशित रिक्तियों" शब्दों के स्थान पर " प्रत्याशित नियमित रिक्तियां" शब्द रखे जाएंगे.

(ख) खंड (क) के परंतुक का लोप किया जाएगा.

(ग) खंड (ग) में, "किसी भी वर्ष में उक्त किसी भी खंड के अंतर्गत पैनल बनाने के लिए यदि पर्याप्त संख्या में अधिकारी उपलब्ध नहीं हो पाते हैं, तो वैकल्पिक खंड के माध्यम से बराबर संख्या में भर्ती बढ़ाते हुए कमी पूरी की जा सकती है" शब्दों कालोप किया जाएगा.

(घ) उप नियम 2 के ठीक पश्चात् आने वाले शीर्षक " ख सहायक श्रेणी" के अधीन "अधिष्ठायी" शब्द के स्थान पर " नियमित " शब्द रखा जाएगा.

(ii) विनियम 3 के उप-विनियम (3) में, -

(क) " अधिष्ठायी रूप में" शब्दों के स्थान पर " नियमित रूप से " शब्द रखे जाएंगे ;

(

ख) "अधिष्ठायी " शब्द के स्थान पर "नियमित " शब्द रखा जाएगा ;

(ग) अंत में निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात्: -

"परंतु यह कि किसी विशिष्ट वर्ष में पूर्ववर्ती वर्षों से अग्रणीत रिक्तियों के प्रति अनुभाग अधिकारी की श्रेणी में नियमित रूप से नियुक्त व्यक्तियों को अंतिम स्लॉट के नीचे रखा जाएगा, चाहे यह सीधी भर्ती वाले व्यक्ति के लिए हो या चयन सूची में शामिल किए गए व्यक्ति के लिए, यह उस वर्ष में सीधी भर्ती वाले व्यक्तिऔर चयन सूची में शामिल किए गए व्यक्तियों के बीच रिक्तियों के चक्रानुक्रम के आधार पर अवधारित किया जाएगा जैसा कि दृष्टांत II में दर्शाया गया है. "

(iii) विनियम 3 के नीचे आने वाले शीर्षक " दृष्टांत " को " दृष्टांत-I" के रूप में पुनः संख्यांकित किया जाएगा;

इस प्रकार पुनःसंख्यांकित दृष्टांत -1 में, -

(iv)

(i) "अनुभाग अधिकारी " से संबंधित पैरा के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: - 8

[PART II-SEC. 3 (1)] "अनुभाग अधिकारी- इस संबंध में जहां नियमित रिक्तियों का 75 प्रतिशत चयन सूची में शामिल किए गए व्यक्तियों की नियुक्ति के लिए और 25 प्रतिशत सीधी भर्ती वाले व्यक्ति के लिए आरक्षित है, प्रत्येक सीधी भर्ती वाले व्यक्ति को चयन सूची में से नियमित रूप से नियुक्त तीन व्यक्तियों से ज्येष्ठता में नीचे रखा जाएगा.

(ii) सहायकों से संबंधित दूसरे पैरा में " अधिष्ठायी " और " अधिष्ठायी रूप से " शब्दों के स्थान पर " नियमित " और " नियमित रूप से " शब्द रखे जाएंगे .

(v) अर्थात्ः इस प्रकार पुनःसख्यांकित दृष्टांत- I के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा,

"वृष्टांत- II

क. यदि वर्ष 1989 में अनुभाग अधिकारी श्रेणी में भरे जाने के लिए दस नियमित रिक्तियां हैं. एक सीधी भर्ती के मुकाबले चार प्रोन्नत व्यक्तियों, के अधिकथित अनुपात के निबंधनों के अनुसार रोस्टर में क्रम संख्या 5 ओर 10 पर सीधी भर्ती के दो स्लॉट होंगे. यह मानते हुए कि सीधी भर्ती के इन दोनों स्लॉटों में से कोई भी नहीं भरा जाता है तो वर्ष 1990 के लिए रिक्तियों की गणना निम्नानुसार की जाएगीः

10 (i) सेवानिवृति आदि के परिणामस्वरूप उपलब्ध नियमित रिक्तियों की परिकल्पित संख्या

(ii) भरी न गई रिक्तियों की संख्या-दोनो सीधी भर्ती : 02

वर्ष 1990 के लिए कुल नियमित रिक्तियां : 12 ख. वर्ष 1990 के लिए रोस्टर निम्नलिखित दो चरणों में तैयार किया जाएगाः

(i) वर्ष 1990 में उत्पन्न होने वाली दस रिक्तियों के संबंध में रोस्टर एक सीधी भर्ती के मुकाबले चार प्रोन्नत व्यक्तियों के अनुपात में रिक्तियों के सामान्य चक्रानुक्रम पर आधारित होगा;

(ii) वर्ष 1989 से अग्रणीत दो सीधी भर्ती की रिक्तियों को उपर्युक्त (i ) द्वारा निर्धारित अंतिम स्लॉट के नीचे सीधी भर्ती के स्लॉटों के रूप में जोड़ा जाएगा.

ग. इसके आगे यह परिकल्पना करते हुए कि पिछले वर्ष की भरी न गई रिक्तियों को शामिल 9

न करते हुए वर्ष 1991 और 1992 में उत्पन्न होने वाली रिक्तियों की संख्या भी 10 है तो वर्ष 1989, 1990, 1991 और 1992 के लिए रोस्टर निम्न प्रकार होगाः

(vi) विनियम 4 में

(क) उपविनियम ( 1) में, " अधिष्ठायी रूप से " शब्दों के स्थान पर " नियमित रूप से" शब्द रखे जाएंगे .

(ख) उप विनियम (3) में, " अधिष्ठायी " शब्द के स्थान पर "नियमित " शब्द रखा जाएगा.

(RailwayBoard) NOTIFICATION

New Delhi , the 21st December , 2004

G.S.R. 842 (E ). In exercise of powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules further to amend the Railway Board Secretariat Service Rules , 1969 , namely: -

1. (1) These rules may be called the Railway Board Secretariat Service (Amendment) Rules, 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2 . In rule 2 of the Railway Board Secretariat Service Rules , 1969 ( herein- after referred to as the said rules) , -

(i ) for clause ( d) , the following clause shall be substituted , namely: - '(d) "authorised cadre strength " in relation to a cadre means , the strength of duty posts in that cadre against which regular appointments may be made; ' ;

(ii) for clause (j ) , the following clause shall be substituted , namely: - '(j ) "permanent officer" means a person who has been confirmed in the entry grade;';

(iii ) for clause ( k) , the following clauses shall be substituted , namely: - '(k) "probationer" means a direct recruit appointed to a grade on probation against a regular vacancy ;

(ka) " regular officer " in relation to any grade, means a person who has been appointed against a regular vacancy either through direct recruitment or through promotion from Select List and who has completed the period of probation or trial , as the case may be , under rule 11 to the satisfaction of the appointing authority;

(kb) " regular vacancies " in relation to any grade, includes vacancies

(i ) available for an indefinite period ; and

(ii ) arising for one year or more out of deputation or transfer or leave of incumbents; ';

3 . For rule 4 of the said rules, the following rule shall be substituted, namely: -

"4. The authorized cadre strength of the service - (1 ) The authorized cadre strength of various grades of the service shall be as follows , namely : -

(2) TheCentral Government in the Ministry of Railways may make temporary additions to a grade as found necessary from time to time and such temporary additions to a grade shall be subject to review every year.

(3) The authorized cadre strength of various grades however shall be such as may be determined from time to time by the Central Government in the Ministry of Railways . " .

4. For rule 7 of the said rules , the following rule shall be substituted, namely:-

"7. Confirmation Confirmation of direct recruits shall be made to the concerned grade of the service and not against any specified duty post.".

5. Inrule 8 of the said rules,

(i ) for sub - rule (1) , the following sub - rule shall be substituted, namely:-

"(1) Vacancies in the Selection Grade shall be filled by promotion of regular officers of Grade I who have rendered not less than five years' approved service in that grade and are included in the Select List for the Selection Grade prepared in accordance with the provisions of sub- rule (5) . " .

(ii) for sub-rule (3) , the following sub -rule shall be substituted, namely:-

"(3) Vacancies in Grade I shall be filled by promotion of regular Section Officers who have rendered not less than eight years ' approved service in that grade and of regular officers of Grade A and B (merged) of the Railway Board Secretariat Stenographers ' Service who have rendered not less than eight years ' approved service in that grade and are included in the Select List for Grade I of the service prepared in accordance with the provisions of sub-rule (5) .

Explanation - For the purposes of this rule , in the case of officers of Grade 'A' of the Railway Board Secretariat Stenographers Service "approved service " shall include the entire period of approved service in Grade I of the Railway Board Secretariat Stenographers' Service rendered prior to the 1st day of August, 1969 and half of the approved service rendered in Grade 'B' after the 1st day of August , 1969, as the case may be . " .

(iii) sub- rule (4) shall be omitted.

6. In rule 9 of the said rules, -

(i) for sub- rule (1 ) , the following sub-rule shall be substituted, namely: -

"(1) Regular vacancies in the Section Officers ' Grade shall be filled on the following basis , namely : -

(a) Twenty percent of the regular vacancies in the Section Officers' Grade shall be filled by direct recruitment on the basis of the results of a competitive examination held by the Commission for this purpose from time to time.

(b) Eighty percent of vacancies shall be filled by appointment of persons included in the Select List for the Section Officers' Grade and such appointment shall be made in the order of seniority in the Select List except when for reasons to be recorded in writing, a person is not considered fit for such appointment on his turn:

Provided that if sufficient number of candidates are not available for filling up of the vacancies in any recruitment year , 3870 G1/04-4 14

[PART II-SEC. 3 (i )] either by direct recruitment or by appointment of persons included in the Select List for Section Officers' Grade, the vacancies shall be carried forward and added to the number of vacancies of the same mode of recruitment to be filled in the subsequent recruitment year:

Provided further that no such vacancies shall be carried forward for more than two recruitment years , beyond the year to which the recruitment relates , where after the vacancies , if any, belonging to one mode of recruitment shall be transferred as additional vacancies for the other mode of recruitment . " .

(ii) the proviso to sub- rule ( 2) shall be omitted;

(iii) sub - rule (3) shallbe omitted;

(iv) for sub - rule ( 6) , the following sub- rule shall be substituted, namely: -

"(6) Vacancies in the Assistants' Grade shall be filled on the following basis , namely : -

(a) Fifty percent of the regular vacancies in the Assistants' Grade shall be filled by direct recruitment on the basis of the results of a competitive examination held by the Staff Selection Commissionfor this purpose from time to time;

(b) Fifty percent of the regular vacancies shall be filled by regular appointment of persons included in the Select List for the Assistants ' Grade .".

(v) for sub- rule (6-a ) , the following sub- rule shall be substituted, namely: -

"(6A) The appointment under sub- rule (6) of the persons whose names have been included in the Select List shall be made in the order of seniority in that Select List:

Provided that where a person is not considered fit for such appointment in his turn , the reasons therefor shall be recorded in writing:

Provided further that if sufficient number of candidates are not available for filling up the vacancies in any recruitment 15

year by direct recruitment , the vacancies shall be filled by appointment of persons included in the Select List for Assistants ' Grade." .

7. Rule9-A of the said rules shall be omitted .

8. For rule 10 of the said rules, the following rule shall be substituted, namely: -

"10. Power to make temporary appointment against regular vacancy: - A regular vacancy may be filled temporarily in accordance with the provisions governing appointment to temporary vacancies in the concerned grade , until it is filled in accordance with the provisions governing regular appointments .".

9. In rule 14 of the said rules, -

(i) for sub -rule (3) , the following sub-rule shall be substituted, namely:

"(3) Saveas otherwise provided in sub-rule (4) , the seniority of persons appointed to any grade after the appointed day shall bedetermined in the following manner namely : -

(I ) Selection Grade and Grade- I : The seniority inter se of officers appointed to the grade after the appointed day shall be regulated by the order in which their names are included in the Select List for the grade :

Provided that an officer included in the Select List who refuses at any time to be appointed to the grade for reasons acceptable to the appointing authority shall , on his appointment to the grade at any time thereafter, be placed immediately after the officer who was last appointed to that grade from the Select List.

(II) Section Officers ' Grade and Assistants' Grade : -

(i) Regular Officers : ( a) direct recruits shall be ranked inter se in the order of merit in which they are placed at the competitive examination on the result of which they are recruited, the recruits of an earlier examination being ranked senior to those of a later examination :

Provided that the seniority of persons recruited through the competitive examination held by the Commission or the Staff Selection Commission , as the case may be, -

(i) in whose case offer of appointment is revived after being cancelled ; or

(ii) who are not initially appointed for valid reasons but are appointed after the appointment of candidates recruited on the basis of results of the subsequent examination or examinations,

shall be such as may be determined by the Central Government in theMinistry of Railways in consultation with the Commission ;

(b) persons appointed regularly to the grade from the Select Listfor the grade shall be ranked inter se according to the order inwhich they are so appointed;

(c) the relative seniority of direct recruits to a grade and persons regularly appointed to the grade from the Select List for the grade shall be regulated in accordance with the provisions specified in the Schedule;

(ii) Temporary Officers : Persons included in the Select List for the grade shall rank inter se in the order in which they are included in the Select List and shall rank senior to all other temporary officers in the grade who shall rank inter se in the order in which they are approved for long term appointment to thegrade:

1 Provided that an officer included in the Select List who refuses at any time to be appointed to the grade for reasons acceptable to the appointing authority shall , on his appointment to the grade at any time thereafter , be placed immediately after the officer who was last appointed to that grade from the Select List." .

(ii) in sub- rule (4) , for the word " substantively " , the word " regularly " shall be substituted.

10. In the Schedule to the said rules -

(i) in regulation 2, in sub- regulation (1 ) , -

(a) for the words " anticipated vacancies ", the words "anticipated regular vacancies" shall be substituted;

(b) the proviso to clause (a) shall be omitted;

(c) in clause (c) , the words " In case adequate number of officers are not available for empanelment under either of the clauses in any year , the shortfall can be made good by increasing the intake in equal number through the alternative clause ", shall be omitted;

(d) under heading "B ASSISTANTS ' GRADE " , occurring immediately below sub - regulation 2, for the word "substantive", the word " regular" shall be substituted;

(ii) in regulation 3, in sub - regulation (3) , -

(a) for the word "substantively " , the word "regularly" shall be substituted;

(b) for the word " substantive " , the word " regular " shall be substituted;

(c) the following proviso shall be inserted, at the end namely: - "Provided that persons appointed regularly in the Section Officers' Grade in a particular year against the vacancies carried forward from previous years shall all be placed below the last slot, whether it may be for a direct recruit or for a person included in the Select List, determined on the basis of the rotation of vacancies between direct recruits and persons included in the Select List , in that year , as illustrated in Illustration - II . ";

(iii) the heading " ILLUSTRATION " occurring below regulation 3 shall be re- numbered as heading " ILLUSTRATION - I " thereof;

[PART II -SEC. 3(i)] (iv) in ILLUSTRATION - I as so re- numbered, -

(a) for the first paragraph relating to Section Officers , the following shall be substituted, namely: -

"Section Officers- In this case where 75 percent of the regular vacancies are reserved for appointment of persons included in the Select List and 25 percent for direct recruitment , each direct recruit shall be ranked in seniority below three persons regularly appointed from the Select List . ";

(b) in the second paragraph relating to Assistants , for the words "substantive " and " substantively ", the words " regular " and "regularly" shall be respectively substituted;

(v) after ILLUSTRATION -I as so re - numbered the following shall be inserted , namely: -

"ILLUSTRATION- II

A. If there are ten regular vacancies to be filled in the Section Officers' Grade in the year 1989, there shall be two slots for direct recruits at position numbers 5 and 10 of the roster in terms of the laid down proportion of four promotees to one direct recruit . If neither of those direct recruits slots is filled, the vacancies for the year 1990 shall be calculated as follows:

(i) Number of regular vacancies arising as a result of retirement etc. - assumed

: 10

(ii) Number of unfilled vacancies both direct recruits

Total regular vacancies for 1990

B. The roster for the year 1990 shall then be prepared in the following two stages :

(i) In respect of the ten vacancies arising in the year 1990, the roster shall be based on the normal rotation of vacancies in the proportion of four promotees to one direct recruit;

(ii) the two direct recruit vacancies carried forward from the year 1989 shall be added as direct recruits slots below the last slot determined as per stage ( i ) above .

C. If the number of vacancies arising in 1991 and 1992 not taking into account the unfilled vacancies of the previous year is also ten, the roster for the year 1989, 1990, 1991 and 1992 would beas follows:
