सा.का.नि. 843( अ ) केन्द्रीय सरकार, पौधा किस्म और कृषक अधिकार संरक्षण नियम, 2001 ( 2001.का 53 ) की धारा 96 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पौधा किस्म और कृषक अधिकार संरक्षण नियम, 2003 को संशोधित करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम पौधा किस्म और कृषक अधिकार संरक्षण ( संशोधन ) नियम , 2004 है । (2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पौधा किस्म और कृषक अधिकार संरक्षण नियम, 2003 के नियम 11 में उप-नियम ( 1 ) के स्थान पर निम्नलिखित उप-नियम रखा जाएगा, अर्थात्: -
" ( 1 ) अध्यक्ष की नियुक्ति केन्द्रीय सरकार द्वारा निम्नलिखित से मिलकर बनने वाली खोज समिति , द्वारा सिफारिश किए गए नामों के पैनल के आधार पर की जाएगी , अर्थात्ः-
( i ) केन्द्रीय सरकार, कृषि मंत्रालय , द्वारा नामनिर्दिष्ट किया जाने
वाला कोई प्रतिष्ठित वैज्ञानिक या कोई विशेषज्ञ जो पौधा किस्म संरक्षण से संबंधित विधि और पौधा किस्म अनुसंधान या पौधा
अध्यक्षः
प्रजनन के संबंध में विशेष जानकारी तथा वृत्तिक अनुभव रखता हो
सदस्यः
(ii ) सचिव, भारत सरकार, कृषि और सहकारिता विभाग
सदस्य;
(iii ) सचिव , भारत सरकार, कृषि अनुसंधान और शिक्षा विभाग
सदस्य। "
( iv ) सचिव, भारत सरकार, जैव प्रौद्योगिकी विभाग

NOTIFICATION
New Delhi , the 30th December, 2004
G.S.R. 843 (E) . In exercise of the powers conferred by Section 96 of the Protection of Plant Varieties and Farmers , Rights Act, 2001 (53 of2001 ) , the Central Government hereby makes the following rules to amend the Protection of Plant Varieties and Farmers ' Rights Rules , 2003 , namely:--
1. Short title and commencement. ( 1 ) These rules may be called the Protection of Plant Varieties and Farmers Rights (Amendment) Rules , 2004.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In rule 11 of the Protection of the Plant Varieties and Farmers ' Rights Rules , 2003 for Sub - rule ( 1 ) , the following sub - rule shall be instituted, namely:-
"( 1 ) The Chairperson shall be appointed by the Central Government on the basis of a panel of names recommended by a Search Committee consisting of the following , namely:-
Chairman;
(i) An eminent scientist or an expert, having special knowledge and Professional experience in respect of the law relating to protection ofplant varieties and plant varietal research or plant breeding, to be nominated by the Central Government in the Ministry of Agriculture
Member;
(ii) Secretary to the Government of India , Department of Agriculture and Cooperation
Member:
(iii) Secretary to the Government of India, Department of Agriculture Research and Education
Member."
(iv) Sccretary to the Government of India, Department of Biotechnology
