प्रतिभूति संविदा ( विनियमन ) अधिनियम , 1956 की धारा 11 ( 3 ) के अधीन उत्तर प्रदेश स्टॉक एक्सचेंज एसोसिएशन लिमिटेड के शासी बोर्ड के अधिक्रमण की कालावधि को बढ़ाने के लिए अधिसूचना
का.आ. 6 (अ).- फा.सं. भाप्रविबो / विधि/ 14296 / 2004 तारीख 05 जुलाई, 2004 की अधिसूचना ("उक्त अधिसूचना " ) द्वारा , उत्तर प्रदेश स्टॉक एक्सचेंज एसोसिएशन लिमिटेड के शासी बोर्ड ( " शासी बोर्ड" ) के अधिक्रमण को भारतीय प्रतिभूति और विनिमय बोर्ड ( " भाप्रविबो " ) द्वारा छह मास की अतिरिक्त कालावधि के लिए बढ़ाया गया था और श्री एम.एन. सभरवाल, आई.पी.एस. ( सेवानिवृत्त) शासी बोर्ड की समस्त शक्तियों और कर्तव्यों का प्रयोग करने और पालन करने के लिए प्रशासक के तौर पर बने रहे । शासी बोर्ड के अधिक्रमण की अवधि ।। जनवरी 2005 को समाप्त होने वाली है ।
मैंने नोट किया है कि प्रशासक ने एक्सचेंज की कार्यप्रणाली में विभिन्न सुधारात्मक उपाय शुरु किये हैं, जिनमें से कुछ पर अविरत अनुवर्ती कार्रवाई अपेक्षित है । आगे , मेरा विचार है कि एक्सचेंज की कार्यप्रणाली को आगे सुचारू बनाने के लिए , नये शासी बोर्ड के निर्वाचन तथा गठन की प्रक्रिया को पूरा करने के लिए अपेक्षित समय , और निगमीकरण (कॉर्पोरटाइजेशन) तथा अपरस्परीकरण (डीम्युचुअलाइजेशन) की प्रक्रिया को पूरा करने के लिए भी , शासी बोर्ड के अधिक्रमण की कालावधि को छह मास की अतिरिक्त कालावधि के लिए बढ़ाया जाना अपेक्षित है ।
पूर्वोक्त को ध्यान में रखते हुए , प्रतिभूति संविदा ( विनियमन) अधिनियम , 1956 की धारा 11 और केंद्रीय सरकार द्वारा जारी तारीख 30 जुलाई 1992 की अधिसूचना सं. एस.ओ .573 के साथ पठित भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम , 1992 की धारा 4(3 ) के अधीन मुझे प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त अधिसूचना में यथा आदिष्ट उत्तर प्रदेश स्टॉक एक्सचेंज एसोसिएशन लिमिटेड के शासी बोर्ड के अधिक्रमण को एतद्वारा 12 जनवरी 2005 से प्रभावी छह मास की अतिरिक्त कालावधि के लिए बढ़ाया जाता है । श्री एम.एन. सभरवाल , आई.पी.एस. (सेवानिवृत्त) प्रशासक के तौर पर बने रहेंगे और शासी बोर्ड की समस्त शक्तियों और कर्तव्यों का प्रयोग और पालन करेंगे , इस प्रकार बढ़ायी गयी कालावधि के दौरान । श्री एम.एन. सभरवाल ऐसे व्यक्तियों की सहायता ले सकेंगे जैसा वे प्रशासक के तौर पर अपने कर्तव्यों के निर्वहन में आवश्यक समझें ।

Notification under Section 11 (3 ) of the Securities Contracts (Regulation ) Act, 1956 for Extending the Period of Supersession of the Governing Board of the Uttar Pradesh Stock Exchange Association Limited
S. O.6 (E) Vide notification F. No. SEBI /LE/ 14296 /2004dated July 05, 2004 (" said notification " ) , the supersession of the Governing Board of the Uttar Pradesh Stock Exchange Association Limited (" Governing Board" ) was extended by the Securities and Exchange Board of India ( " SEBI " ) for a further period of six months and Shri M. N. Sabharwal , IPS ( Retd . ) continued as an Administrator to exercise and perform all the powers and duties of the Governing Board . The term of supersession of the Governing Board is due to expire on January 11 , 2005.
I have noted that the Administrator has initiated various corrective measures in the functioning of the Exchange , some of which require sustained follow up action . Further, I am of the view that in order to further streamline the functioning of the Exchange , time required to complete the process of election and constitution of the new Governing Board and also to complete the process of corporatisation and demutualisation , the period of supersession of the Governing Board is required to be extended for a further period of six months .
In view of the aforesaid , in exercise of the powers conferred upon me under Section 4( 3 ) of Securities and Exchange Board of India Act , 1992 read with Section 11 of the Securities Contracts ( Regulation) Act, 1956 and the Notification no. S.O.573 dated July 30, 1992 issued by Central Government, the supersession of the Governing Board of the Uttar Pradesh Stock Exchange Association Limited as ordered in the said notification is hereby extended for a further period of six months with effect from January 12, 2005 . Shri M N Sabharwal , IPS ( Retd. ) shall continue as the Administrator and shall exercise and perform all the powers and duties of the Governing Board , during the period so extended . Shri M. N. Sabharwal may take the assistance of such persons as he deems necessary in discharge of his duties as Administrator .

जिसका अपना रजिस्ट्रीकृत कार्यालय फॉर्चुन टॉवर , सयाजीगंज , वड़ोदरा - 390 005 में स्थित है द्वारा प्रतिभूति संविदा ( विनियमन) अधिनियम , 1956 की धारा 3 के अधीन किए गए मान्यता के नवीकरण के लिए आवेदन पर विचार करते हुए , और यह समाधान हो जाने पर कि यह व्यापार के हित में होगा और ऐसा करना लोक हित में भी होगा , एतद्वारा , प्रतिभूति संविदा (विनियमन) अधिनियम , 1956 की धारा 4 द्वारा प्रदत्त शक्ति का प्रयोग करते हुए , उक्त एक्सचेंज को मान्यता का नवीकरण उक्त अधिनियम की धारा 4 के अधीन 4 जनवरी 2005 को प्रारम्भ होने वाली और 3 जनवरी 2007 को समाप्त होने वाली दो वर्षों की कालावधि के लिए प्रतिभूतियों में संविदाओं की 3

बाबत इसमें इसके नीचे कथित शर्त अथवा जो इसके पश्चात् विहित या अधिरोपित की जाये के अध्यधीन प्रदान करता है: -
" एक्सचेंज व्यापार प्रारंभ नहीं करेगा जब तक कि निरीक्षण रिपोर्ट में दिये गये और तारीख 24 दिसम्बर 2003 के पत्र सं . डीएमएस/वीएसई/आईएनएसपीआरईपी/ 2003/24366 द्वारा एक्सचेंज को संसूचित सुझावों / संप्रेक्षणों को पूर्णतया कार्यान्वित नहीं कर लिया जाता । "

S. O. 7 (E) .The Securities and Exchange Board of India , having considered the application for renewal of recognition made under section 3 of the Securities Contracts (Regulation ) Act, 1956by the Vadodara Stock Exchange Ltd , having its registered office at Fortune Tower , Sayajigunj , Vadodara - 390 005 , and being satisfied that it would be in the interest of trade and also in the public interest so to do , hereby grants, in exercise of the power conferred by Section 4 of the Securities Contracts ( Regulation ) Act , 1956 , renewal of recognition to the said Exchange under section 4 of the said Act for a period of two years commencing on the 4th day of January 2005 and ending on the 3rd day of January 2007 in respect of contracts in securities subject to the condition stated herein below or as may be prescribed or imposed hereafter: -
"The Exchange shall not commence trading unless the suggestions/observations made in the inspection report and communicated to the Exchange vide letter No. DMS/VSE /INSP REP/2003 /24366 dated December 24, 2003 are implemented" . fully
