का०आ० 20 ( अ ) . विदेश व्यापार नीति, 2004-2009 के पैरा 2.1 के साथ पठित विदेश व्यापार ( विकास और विनियमन ) अधिनियम , 1992 की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार, एतद्वारा , विदेश व्यापार नीति 2004-2009 में निम्नलिखित संशोधन करतीहै :-
1. मौजूदा पैरा 3.8.2 के बाद निम्नलिखित नया पैरा जोड़ा जाएगा:-
" 3.8.2.1 स्कीम के अन्तर्गत निर्यात और आयात मदों के आई टी सी ( एच एस ) वर्गीकरण , 2004-2009 के तहत अध्याय 6, 7, 8, 9 (0901 , 0902 और 0903 के अलावा ) , 20 में शामिल सभी मदों का निर्यात और लघु वन्य उत्पाद ( अलग से अधिसूचित किए जाऐंगे ) का निर्यात पैरा 3.8.2 के अनुसार निर्यात लाभ के योग्य होंगे । तथापि, पूर्वोक्त अध्यायों में आई टी सी ( एच एस ) में 8 अंक स्तर पर आने वाली ' अन्य' मदें पैरा 3.8.2 के तहत किसी लाभ के योग्य नहीं होंगी । इसके अतिरिक्त जो मदें निर्यात और आयात मदों के आई टी सी ( एच एस ) वर्गीकरण में निर्यात नीति की अनुसूची -2 के अन्तर्गत प्रतिबन्धित या निषिद्ध हैं वे भी पैरा 3.8.2 के तहत किसी लाभ के योग्य नहीं होंगी । "
2. मौजूदा पैरा 3.8.3 के बाद निम्नलिखित नया पैरा जोड़ा जाएगा:-
" 3.8.3.1 निम्नलिखित को छोड़कर निर्यात आयात मदों के आई टी सी ( एच एस ) वर्गीकरण के अध्याय 1 से 24 में सूचीबद्ध कृषि उत्पादों का आयात अनुमत होगा ।
(i ) निर्यात और आयात मदों के आई टी सी ( एच एस) वर्गीकरण के अध्याय 7 के तहत 30 प्रतिशत से अधिक के शुल्क के साथ लहसुन, मटर और सभी अन्य सब्जियां ।
( ii ) निर्यात आयात मदों के आई टी सी ( एच एस ) वर्गीकरण के अध्याय 8 के तहत 30 प्रतिशत से अधिक के शुल्क सहित नारियल, एरेका नट, सन्तरे, नींबू, ताजे अंगूर, सेब और नाशपाती और अन्य सभी फल ।
(iii ) निर्यात और आयात मदों के आई टी सी ( एच एस ) वर्गीकरण ( लौंग को छोड़कर ) के अध्याय 9 के तहत 30 प्रतिशत से अधिक के शुल्कसहित सभी मसाले ।
( iv ) निर्यात और आयात मदों के आई टी सी ( एच एस ) वर्गीकरण के अध्याय 9 के अनुसार चाय , काफी और काली मिर्च । 59 GI/2005

v ) निर्यात और आयात मदों के आई टी सी ( एच एस ) वर्गीकरण के अध्याय 12 के तहत सभी तिलहन ।
( इसके अलावा निर्यात और आयात मदों के आई टी सी ( एच एस ) वर्गीकरण के अध्याय 40 के अनुसार इस स्कीम के अधीन प्राकृतिक रबर के आयात की अनुमति नहीं दी जाएगी ।
यथोपरोक्त आयातों की सूची केवल वर्ष 2004-2005 के दौरान किए गए योजना के तहत उत्पादों के निर्यात के लिए है । अध्याय 15 के तहत वर्गीकृत सभी खाद्य तेलों का आयात , स्कीम के तहत केवल एसटीसी और एमएमटीसी के जरिए अनुमत होगा । इसे लोकहित में जारी किया जाता है ।

NOTIFICATION

S.O. 20 (E) . In exercise of powers conferred by Section 5 of the Foreign Trade (Development and Regulation ) Act, 1992 read with paragraph 2.1 of the Foreign Trade Policy, 2004-2009 , the Central Government hereby makes the following amendments in the Foreign Trade Policy, 2004-2009 :
1. After the existing Para 3.8.2, the following new Para shall be added:-
"3.8.2.1 Under the Scheme , export of all items covered by Chapter 6 , 7, 8, 9 (excluding 0901, 0902 and 0903 ) , 20 under the ITC (HS ) Classification of Export and Import items , 2004-2009 and Minor Forest Produce (to be notified separately ) shall qualify for export benefits as per Para 3.8.2. However , items appearing as ' Others ' at the 8 digit level in the ITC (HS) in the aforesaid Chapters shall not be eligible for any benefits under Para 3.8.2 . Inaddition , items which are restricted or prohibited for export under Schedule -2 of the Export Policy in the ITC (HS) Classification of Export and Import items shall also not be eligible for any benefits under Para 3.8.2 . " 2. After the existing Para 3.8.3 , the following new Para shall be added:-
"3.8.3.1 Import of agricultural Products listed in Chapter 1 to 24 of ITC ( HS) Classification of Export and Import items except the following shall be allowed:
(i) Garlic, peas and all other Vegetables with a Duty of more than 30 % under Chapter 7 of ITC (HS ) Classification of Export and Import items .
(ii) Coconut , Areca Nut , Oranges , Lemon, Fresh Grapes , Apple and Pears and all other fruits with a Duty of more than 30 % under Chapter 8 of ITC (HS ) Classification of Export and Import items .
(iii) All spices with a Duty of more than 30 % under Chapter 9 of ITC (HS) Classification of Export and Import items (except Cloves) .
(iv) Tea, Coffee and Pepper as per Chapter 9 of ITC (HS ) Classification ofExport and Import items .
(v) All Oil Seeds under Chapter 12 of ITC (HS ) Classification of Export and Import items.
Further, Natural Rubber as per Chapter 40 of ITC (HS) Classification of Export and Import items shall also not be allowed for import under the Scheme.
The list of imports as above is only for export of the products under the Scheme made during the year 2004-2005 .
MMTC . Import of all edible oils classified under Chapter 15, shall be allowed under the scheme only through STC and This issues in Public interest .
