सं.टीएएमपी/103/2001-सीपीटी. महापत्तन न्यास अधिनियम, 1963 ( 1963 की 38 ) की धारा 49 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, महापत्तन प्रशुल्क प्राधिकरण एतद्वारा , हाल्दिया स्थित कोलकात्ता पत्तन न्यास की भूमि और भवनों की वर्तमान दर-अनुसूची की वैधता को इसके साथ संलग्न आदेशानुसार विस्तार प्रदान करता है ।

यह प्रकरण हाल्दिया स्थित कोलकाता पत्तन न्यास की भूमि और भवनों की प्रचलित किराया- अनुसूची की वैधता को , 31 दिसम्बर, 2005 से आगे विस्तार प्रदान करने से सम्बन्धित है ।.
2. इस प्राधिकरण ने हाल्दिया में भूमि और भवनों के लिए प्रचलित किराया अनुसूची की वैधता, 31 दिसम्बर, 2005 या संशोधित किराया अनुसूची की अधिसूचना की प्रभावी तिथि तक इनमें से जो भी पहले हो , विस्तार प्रदान करते हुए, दिनांक 7 जनवरी, 2005 को एक आदेश पारित किया था ।
3.1 . केओपीटी ने अपने प्रस्ताव दिनांक 16-9-2005 द्वारा हाल्दिया स्थित केओपीटी की भूमि और भवनों की किराया अनुसूची के संशोधन हेतु प्रस्ताव दाखिल किया है ।
3.2. जैसाकि पहले कहा गया है, हाल्दिया की भूमि और भवनों की वर्तमान किराया अनुसूची की वैधता दिनांक 31 दिसम्बर , 2005 को समाप्त होगी, किराया अनुसूची के संशोधन हेतु केओपीटी द्वारा दाखिल किये गये प्रस्ताव को सामान्य परामर्श प्रक्रिया का अनुपालन करते हुए, संसाधित किया जा रहा है और इस प्राधिकरण द्वारा अंतिम रूप से विचार किए जाने के लिए इस प्रकरण के परिपक्व होने में और अधिक समय लगेगा । अतः , हाल्दिया में केओपीटी की भूमि तथा भवनों की वर्तमान किराया अनुसूची की वैधता को, 31 दिसम्बर, 2005 के आगे विस्तार प्रदान करना आवश्यक है ।
4. परिणामस्वरूप तथा समग्र विचार- विमर्श के आधार पर यह प्राधिकरण हाल्दिया स्थित केओपीटी की भूमि तथा भवनों की वर्तमान किराया अनुसूची की वैधता को, 31 दिसम्बर , 2005 के आगे, हाल्दिया स्थित केओपीटी की भूमि और भवनों की किराया अनुसूची के संशोधन हेतु प्रस्ताव पर पारित किए जाने वाले आदेश के कार्यान्वयन की प्रभावी तिथि तक विस्तार प्रदान करता है ।

NOTIFICATION
Mumbai , the 4th January, 2006
No. TAMP/103/2001 - CPT. In exercise of the powers conferred by Section 49 of the Major Port Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports extends the validity of the existing Schedule of rates for land and buildings oftheKolkata Port Trust at Haldia as in the Order appended hereto.

(Passed on this the 27th day of December , 2005 )
This case relates to extension of the validity of the existing Schedule of rent for land and buildings of the Kolkata PortTrust (KOPIT) at Haldia beyond 31 December , 2005 .
2.ThisAuthority had passed an Order on 7 January, 2005 extending the validity of the existing rent schedule for land and buildings at Haldia till 31 December, 2005 or date of effect of notification of the revised Rent Schedule , whichever isearlier.
3.1. The KOPT has filed the proposal for revision ofthe Schedule of rent for land and buildings of KOPT at Haldia vide its proposal dated 16 September , 2005 .
3.2.As stated earlier, the validity of the existing Schedule of Rent for land and buildings at Haldia expire on 31 December, 2005. The proposal filed by KOPT for revision of Schedule of rent is being Processed following the usual consultationprocess and it will take some more time for the case to mature for final consideration by this Authority. It is, therefore , necessary to extend the validity of the existingr rent schedule for land and building of KOPT at Haldia beyond 31December, 2005
4. Inthe result , and based on a collective application of mind, this Authority extends the validity of the existing rent schedule for land and builidings of KOPT at Haldia beyond 31 December, 2005 till the effective date of implementation oftheOrder to be passed on the proposal for revision of rent Schedule of Land and Buildings of KOPT situated at Haldia .
