सा.का.नि. 16( अ).- केंद्रीय सरकार, बाट और माप मानक अधिनियम, 1976 (1976 का 60) की धारा 83 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बाट और माप मानक (पैकेज में रखी वस्तुएं) नियम, 1977 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात :
1. (1) इन नियमों का संक्षिप्त नाम बाट और माप मानक (पैकेज में रखी वस्तुएं) संशोधन नियम , 2005 है ।
(2) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. बाट और माप मानक (पैकेज में रखी वस्तुएं) नियम, 1977 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 2 में खंड (प) के पश्चात् निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात् :-
"(फ) "मूल्य आधारित पैकेज " से ऐसा पैकेज अभिप्रेत है जिसकी खुदरा विक्रय कीमत पूर्वावधारित है और ऐसे पैकेज या उसके लेबल पर उपदर्शित है जैसे कि पांच रुपए या दस रुपए । "
3. उक्त नियमों के नियम 5 में दूसरे परंतुक के पश्चात् निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात् :-
66 " परन्तु यह भी कि काफी, चाय, खाद्य तेलों, वनस्पति घी, बटर ऑयल और प्रसाधन साबुन जिसके अंतर्गत सभी प्रकार के नहाने के साबुन (बटिटयां) भी हैं, की बाबत मूल्य आधारित पैकेजों के लिए , जिनकी खुदरा 137 GI/2005

विक्रय कीमत, यथास्थिति, पांच रुपए या दस रुपए है, तृतीय अनुसूची में विनिर्दिष्ट मात्राएं बाट और माप मानक (पैकेज में रखी वस्तुएं) संशोधन नियम, 2005 के प्रारंभ की तारीख से एक वर्ष की अवधि के लिए लागू नहीं होंगी । "
4. उक्त नियमों के नियम 9 में उपनियम (4) के पश्चात् निम्नलिखित उपनियम अंतःस्थापित किया जाएगा, अर्थात्: -
"(5) मूल्य आधारित पैकेजों के लेबल में " कीमत " और "मात्रा" की विशिष्टियां या तो मुद्रित या हस्तलेख में स्पष्ट अक्षरों में एक ही जैसे अक्षर, आकार और डिजाइन में एक दूसरे से सटी हुई होंगी । "
5. उक्त नियमों के नियम 33 के उपनियम (1 ) में परंतुक के पश्चात निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात् :-
"परन्तु यह और कि पहले परंतुक में अंतर्विष्ट उपबंध केवल ऐसे पैकेजों को ही लागू होंगे जिनमें खाद्य वस्तुएं अंतर्विष्ट हों । "
6. उक्त नियमों के नियम 35 में,
(क) उपनियम (1 ) में, " बीस रुपए" शब्दों के स्थान पर, "पांच सौ रुपए " शब्द रखे जाएंगे ;
(ख) उपनियम (2) और उसके नीचे स्पष्टीकरण के पश्चात् निम्नलिखित उपनियम अंतःस्थापित किए जाएंगे, अर्थात्: -
"(3 ) उपनियम (1 ) के अधीन जारी किए गए रजिस्ट्रीकरण प्रमाणपत्र में कोई परिवर्तन करने के लिए संबद्ध विनिर्माता/पैकर/आयातकर्ता द्वारा निदेशक को एक सौ रुपए की फीस का संदाय किया जाएगा ।
(3क) निदेशक, जो रजिस्ट्रीकरण प्राधिकारी होगा, उपनियम (1 ) के अधीन किए गए आवेदन की प्राप्ति पर, -
(क) यदि आवेदन सभी प्रकार से पूर्ण नहीं है तो वह उसे आवेदक को वापस कर देगा ;
(ख) यदि आवेदन सभी प्रकार से पूर्ण है तो आवेदक को रजिस्टर करेगा और आवेदक को उस आशय का रजिस्ट्रीकरण प्रमाणपत्र अनुदत्त करेगा । " 3

7. उक्त नियमों की तृतीय अनुसूची में, -
(i) काफी से संबंधित क्रम सं. 7 और उसके सामने की प्रविष्टियों के स्थान पर निम्नलिखित क्रम संख्या और प्रविष्टियां रखी जाएंगी, अर्थात्: -
"7. काफी, 25 ग्राम, 50 ग्राम, 100 ग्राम, 200 ग्राम, 250 ग्राम, 500 ग्राम , 1 किलोग्राम और तदनन्तर 1 किलोग्राम के गुणजों में । "
(ii)चाय से संबंधित क्रम सं . 8 और उसके सामने की प्रविष्टियों के स्थान पर निम्नलिखित क्रम संख्या और प्रविष्टियां रखी जाएंगी, अर्थात्: -
"8. चाय 25 ग्राम, 50 ग्राम, 100 ग्राम , 125 ग्राम, 250 ग्राम , 500 ग्राम, 1 किलोग्राम और तदनन्तर 1 किलोग्राम के गुणजों में । "

NOTIFICATION
New Delhi , the 12th January, 2005
G.S.R. 16( E). In exercise of the powers conferred by section 83 of the Standards of Weights and Measures Act , 1976 (60 of 1976) , the Central Government hereby makes the following rules further to amend the Standards of Weights and Measures ( Packaged Commodities ) Rules , 1977 , namely: -
1. (1 ) These rules may be called the Standards of Weights and Measure (Packaged Commodities) Amendment Rules , 2005 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Standards of Weights and Measures ( Packaged Commodities) Rules ,
1977 ( hereinafter referred the said rules ), in rule 2, after clause ( u ) , the following clause shall be inserted , namely : -
"(v) "value based package " means a package the retail sale price of which is predetermined and indicated on such package or on its label as rupees five or rupees ten. " 3. In rule 5 of the said rules , after the second proviso , the following proviso shall be inserted , namely: -
"Provided also that for value based packages in respect of coffee, tea , edible oils , vanaspathi , ghee , butter oil and toilet soap including all kinds of bath soaps (cakes ) retail sale price of which is Rs 5 or Rs 10 , as the case may, be the quantities specified in the Third Schedule shall not apply for a period of one year from the date of commencement of the Standards of Weights and Measures (Packaged Commodities ) Amendment Rules , 2005.".
4. In rule 9 of the said rules , after sub - rule (4) , the following sub - rule shall be inserted , namely: -
"(5) The label of value based packages , shall contain the particulars of " price " and " quantity " either printed or in hand script in bold letters on the label in the same letter , size and design adjacent to each other. " .

5 5. In rule 33 of the said rules , in sub -rule ( 1 ) , in clause ( i ) , after the proviso , the following proviso shall be inserted , namely: -
"Provided further that the provisions contained in the first proviso shall be applicable only for the packages containing food articles .
6. In rule 35 of the said rules , -
(a) in sub -rule ( 1 ) , for the words " rupees twenty " the words , " rupees five hundred" shall be substituted;
(b) after sub rule (2) and the Explanation thereunder , the following sub - rules shall be inserted , namely: -
"(3) For making any alteration in the registration certificate issued under sub rule ( 1 ) , a fee of rupees one hundred shall be paid by the concerned manufacturer or packer or importer to the Director .
(3A) On receipt of the application made under sub - rule ( 1 ) , the Director , who shall be the Registering Authority, shall-
(a) if the application is not complete in all respects , return the same to the applicant;
(b) if the application is complete in all respects , register the applicant and grant a registration certificate to the applicant to that effect .".
7. In the Third Schedule to the said rules-
(i ) for serial number 7 relating to Coffee and the entries against it, the following serial number and entries shall be substituted , namely: -
"7. Coffee. 25g, 50g, 100g, 200g, 250g, 500g, 1kg and thereafter in multiples of 1kg." .
( ii) For serial number 8 relating to Tea and the entries against it, the following serial number and entries shall be substituted , namely: -
" 8. Tea. 25g, 50g, 100g, 125g 250g, 500g, 1kg and thereafter in multiples of 1kg." .
