भारतीय दूरसंचार विनियामक प्राधिकरण

फा. सं. 11-11 /2004- बी एण्ड सीएस. भारतीय दूरसंचार विनियामक प्राधिकरण अधिनियम , 1997 की धारा 11 की उप- धारा 1 ( ख) के साथ पठित धारा 36 के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय दूरसंचार विनियामक प्राधिकरण एतद्वारा निम्नलिखित विनियम बनाता है ।
1. संक्षिप्तनाम, विस्तार तथा प्रारंभ
(i ) यह विनियम अंतः संयोजन करारों का रजिस्टर ( दूसरा संशोधन ) विनियम, 2004 कहा जाएगा, ( 2004 का 14 ) ( यहां इसके बाद इसे विनियम कहा जाएगा ) ।
( ii) यह विनियम सरकारी राजपत्र में इसकी अधिसूचना की तिथि से लागू होगा ।
2. अंतः संयोजन करार विनियम रजिस्टर, 1999 ( प्रमुख विनियम ) से संबंधित निम्नलिखित खण्ड और प्रविष्टियां हटा दी जाएंगी:-
(i) विनियम 2 के अंतर्गत खण्ड ix, x, xi, xii, xiii , xiv.
(ii) विनियम 5( ख ) का प्रावधान
3. प्रमुख विनियम के विनियम 2 के खण्ड ( iv ) के अंतर्गत प्रविष्टि के स्थान पर निम्नलिखित प्रतिस्थापित किया जाए :
" अंतः संयोजन का अर्थ एक ऐसे वाणिज्यिक और तकनीकी व्यवस्था से है जिसके अंतर्गत सेवा प्रदाता अपने उपकरण , नेटवर्क और सेवाओं का संयोजन करते हैं ताकि उनके ग्राहकों का दूसरे सेवा प्रदाताओं के ग्राहकों, सेवाओं और/अथवा नेटवर्क से एक्सेस हो । " 4. प्रमुख विनियमके विनियम 2 के अंतर्गत खण्ड ( xv ) को खण्ड ( ix ) के रूप में पुर्नसंख्यांकित किया जाएगा । 5. इस संशोधन से पहले प्रमुख विनियम के अंतर्गत किए गए कोई कार्य अथवा की गई कोई कार्रवाई को प्रमुख विनियम के अंतर्गत किया गया कार्य अथवा की गई कार्रवाई माना जाएगा और उन्हें वैध माना जाएगा ।

NOTIFICATION
NewDelhi , the 31st December, 2004
F. No. 11-11/2004- B & CS .-- In exercise of the powers conferred upon it under Section 36 read with sub - section 1 (b) of Section 11 of the Telecom Regulatory Authority of India Act, 1997 , the Telecom Regulatory Authority of India hereby makes the following regulation .
1. Short title , extent and commencement
(i) This regulation shall be called " the Register of Interconnect Agreements (Second Amendment) Regulation 2004 " ( 14 of 2004 ) (hereinafter called the regulation).
(ii) This regulation shall come into force from the date of its notification in the Official Gazette.
2. The following clauses and entries relating thereto of the Register of Interconnect Agreement Regulation , 1999 (Principal Regulation ) shall stand deleted:-
(i) Clause ix, x, xi , xii , xiii, xiv under regulation 2.
(ii) Proviso to regulation 5(b) .
3. The entry under clause ( iv) of regulation 2 of the Principal Regulation shall be substituted to read as under: - "Interconnection means the commercial and technical arrangements under which service providers connect their equipment, networks and services to enable their customers to have access to the customers , services and networks of other service providers . "
4. Clause (xv ) under regulation 2 of the Principal Regulation shall be re - numbered as clause (ix).
5. Anything done or any action taken under the Principal Regulation before this amendment shall be valid and deemed to have been done or taken under the Principal Regulation .
