सा.का.नि. 30( अ ).-केन्द्रीय सरकार, सीमाशुल्क टैरिफ अधिनियम, 1975 ( 1975 का 51 ) की धारा १ क के साथ पठित उक्त धारा की उपधारा ( 5 ) के दूसरे परंतुक तथा उपधारा ( 6 ) और सीमाशुल्क टैरिफ ( पाटित वस्तु की पहचान, प्रतिपाटन शुल्क का निर्धारण और संग्रहण की क्षति काअवधारण ) नियम, 1995 के नियम 23 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना सं. 116/2004- सीमाशुल्क, तारीख 24 दिसम्बर , 2004 , [ सा.का. नि. 836 (अ ) , तारीख 24 दिसम्बर, 2004 ] को विखंडित करती है ।

No. 2/2005 -CUSTOMS
G.S.R. 30 (E) . In exercise of the powers conferred by Sub-section ( 1 ) of Section 9A, read with the second proviso to Sub - sections (5) and (6) of that section in the Customs Tariff Act , 1975 (51 of 1975) and rule 23 of the Customs Tariff (Identification, Assessment and Collection of Anti -dumping Duty on Dumped Articles and for Determination of Injury) Rules , 1995, the Central Government hereby rescinds the notification of the Government of India in the Ministry ofFinance (Department of Revenue) , No. 116/2004- Customs , dated the 24th December, 2004, published in the Gazette of India, Extraordinary, Part II , Section 3 , Sub -section ( i ) vide G.S.R. 836 (E) , dated the 24th December, 2004 , except as respects things done or omitted to be done before such rescission .

सा.का.नि. 31 ( अ ).-अभिहित प्राधिकारी ने भारत के राजपत्र, असाधारण, भाग I , खंड 1 , तारीख 29 मार्च, 2004 में प्रकाशित अधिसूचना सं. 15/9/2003- डीजीएडी द्वारा संयुक्त राज्य अमेरिका, चेक गणराज्य, युरोपीय संघ एवं कोरिया आर.पी. से आयातित सोडियम सायनाइड पर अधिसूचना सं. 10/2001- सीमाशुल्क, तारीख 31 जनवरी , 2001 [ सा.का. नि. 47( अ ) , तारीख 31 जनवरी , 2001 ] द्वारा अधिरोपित प्रतिपाटन शुल्क के चालू रहने के मामले में पुनर्विलोकन शुरू कर दिया है और पुनर्विलोकन अंवेषणों के परिणामों के लम्बित रहने तक, 25 जून , 2005 तक प्रतिपाटन शुल्क के विस्तार के लिए अनुरोध किया है;
अतः , अब , केन्द्रीय सरकार, सीमाशुल्क टैरिफ अधिनियम की धारा १ क के साथ पठित उक्त धारा की उपधारा ( 5 ) तथा ( 6 ) और सीमाशुल्क टैरिफ ( पाटित वस्तु की पहचान, प्रतिपाटन शुल्क का निर्धारण और संग्रहण की क्षति का अवधारण ) नियम, 1995 के नियम 23 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना सं. 10/2001-सीमाशुल्क, तारीख 31 जनवरी , 2001 की अधिसूचना में निम्नलिखित संशोधन करती है, अर्थात्: -
उक्त अधिसूचना में, पैरा 3 के पश्चात् निम्नलिखित पैरा अंतःस्थापित किया जाएगा, अर्थात्:-
4. यह अधिसूचना 25 जून, 2005 तक प्रवृत्त रहेगी जिसमें यह तारीख भी सम्मिलित है । " ।

New Delhi , the 19th January , 2005
No. 3/2005 -CUSTOMS
G.S.R. 31 ( E ) . Whereas , the designated authority vide notification No. 15 / 9 /2003 - DGAD , published in Part I, Section 1 of the Gazette of India , Extraordinary, dated the 29th March , 2004 , has initiated sunset review in the matter of continuation of anti -dumping duty on Sodium Cyanide, falling under Chapter 28 of the First Schedule to the Customs Tariff Act, 1975 ( 51 of 1975) , originating in , or exported from the United States of America , Czech Republic , the Europcan Union and Korca RP, imposed vide notification No. 10/2001-Customs , dated the 31st January , 2001 [ G.S.R. 47(E ) , dated the 31st January, 2001 ) and has requested for suitable extension of anti - dumping duty, pending the results of the review investigations;
Now, therefore, in exercise ofthe powers conferred by Sub - section ( 1 ) of Section 9A, read with the second proviso to Sub -sections ( 5 ) and ( 6 ) of that Section of the said Customs Tariff Act and rule 23 of the Customs Tariff ( Identification, Assessment and Collection of Anti- dumping duty on Dumped Articles and for Determination of Injury ) Rules , 1995, the Central Government hereby makes the following amendment in the notification of the Government of India in the Ministry ofFinance (Department of Revenue ) No. 10/2001 - Customs , dated the 31st January, 2001 , namely :-
In the said notification , after Paragraph 3 , the following Paragraph will be inserted , namely: - "4. The anti-dumping duty imposed under this notification shall be effective upto and inclusive of the 25th day of June, 2005." .
