सा.का.नि. 35 (अ ) .- ओषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों का एक प्रारुप, ओषधि और प्रसाधन सामग्री अधिनियम ,1940 (1940 का 23) की धारा 12 और धारा 33 की अपेक्षानुसार, भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय (स्वास्थ्य विभाग ) की अधिसूचना संख्या सा.का.नि.730 (अ) , तारीख 29 अक्तूबर, 2002 द्वारा भारत के राजपत्र, असाधारण, भाग 2 खंड 3 , उपखंड ( 1 ) तारीख 29 अक्तूबर, 2002 में प्रकाशित किया गया था, जिसमें उन सभी व्यक्तियों से जिनके उससे प्रभावित होने की संभावना थी, उस तारीख से, जिसको भारत के राजपत्र की प्रतियां, जिसमें उक्त अधिसूचना प्रकाशित की गई थी, जनता को उपलब्ध करा दी गई थी, पैंतालीस दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव मांगे गए थे ।
और उक्त राजपत्र की प्रतियां 29-10-2002 को जनता को उपलब्ध करा दी गई थीं;
और केन्द्रीय सरकार ने, उक्त प्रारुप नियमों के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर विचार कर लिया है ;
और केन्द्रीय सरकार ने उक्त अधिनियम की धारा 12 और धारा 33 के अधीन यथा अपेक्षित ओषधि तकनीकी सुझाव समिति से परामर्श कर लिया है ;
अतः अब, केन्द्रीय सरकार ओषधि तकनीकी सुझाव बोर्ड से परामर्श करने के पश्चात् उक्त अधिनियम की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , ओषधि और प्रसाधन नियम, 1945 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् -
1. (1) इन नियमों का संक्षिप्त नाम ओषधि और प्रसाधन ( प्रथम संशोधन ) नियम, 2005 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

[PART II -SEC . 3 (1 )] 2. ओषधि और प्रसाधन नियम, 1945 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 24 के उपनियम (2) में, परन्तुक के पश्चात् निम्नलिखित परन्तुक रखा जाएगा, अर्थात् -
परंतु यह और कि धारा 3 के खंड (ख) के उपखंड (iv) के अधीन समय - समय पर अधिसूचित नैदानिक किटों के सिवाय, इन विट्रो नैदानिक किटों के आयात के लिए इन नियमों के अधीन आयात अनुज्ञप्ति के लिए आवेदन के साथ रजिस्ट्रेशन प्रमाण पत्र की अपेक्षा नहीं होगी । "
3. उक्त नियमों के नियम 24 क में,
( क) उपनियम (3) के खंड ( i ) में,
(ख) उपनियम (3) के खंड (ii ) में,
(ग) उपनियम (3) के खंड ( ii) के परंतुक में,
(घ) उपनियम (5) में, और
(ड.) उपनियम (7) में,
यू एस डालर ' शब्दों के पश्चात् निम्नलिखित शब्द रखे जाएंगे , अर्थात् -
. या भारतीय रुपयों में इसके समतुल्य"
4. उक्त नियमों में , अनुसूची ' घ ( 1) ' ' घ (11) में , अंत में , विनिर्माता के हस्ताक्षर शब्दों के पश्चात् निम्नलिखित शब्द जोड़े जाएंगे , अर्थात्
' या उसका प्राधिकृत अभिकर्ता'
5. उक्त नियमों में, प्ररुप 40 और प्ररुप 41 में, पैरा 2 में, ' ( 1) , (2) और (3) अंकों का लोप किया जाएगा !

NOTIFICATION
New Delhi , the 20th January, 2005
G.S.R. 35( E) .- Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 was published , as required by sections 12 and. 33 of the Drugs and Cosmetics Act , 1940 (23 of 1940 ) , in the Gazette of India , extraordinary , Part II , section 3 , sub - section ( i ) , dated the 29th October , 3

2002, under the notification of the Government of India in the Ministry of Health and Family Welfare ( Department of Health ) , number GSR 730 ( E ) , dated the 29th October, 2002 inviting objections and suggestions from ali persons likely to be affected thereby , before the expiry of a period of forty- five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
Andwhereas copies of the said Gazette were made available to the public on 29-10-2002.
And whereas , objections and suggestions received from the public on the said draft rules have been considered by the Central Government ;
And whereas the Central Government has consulted the Drugs Technical Advisory Board as required under sections 12 and 33 of the said Act ;
Now, therefore , in exercise of the powers conferred by sections 12 and 33 of the said Act , the Central Government , after consultation with the Drugs Technical Advisory Board , hereby makes the following rules further to amend the Drugs and Cosmetics Rules , 1945 , namely : -
1. ( 1 ) These rules may be called the Drugs and Cosmetics ( 1st Amendment) Rules, 2005.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In sub - rule (2) of rule 24 of the Drugs and Cosmetics Rules , 1945 ( hereinafter referred to as the said rules ) after the proviso , the following proviso shall be inserted , namely: -
"Provided further that Registration certificate shall not be required to be accompanied with an application for an import licence under the rules for the import of in - vitro diagnostic kits and regents , except for the diagnostic kits notified from time to time under sub- clause ( iv ) of clause (b ) ofsection 3. " .
3. In rule 24 A of the said rules , -
(a) in clause (i ) of sub - rule (3) ,
(b) in clause (ii ) of sub - rule (3) , 4

[PART II-SEC . 3 ( i) ] (c) in provisoto clause ( ii ) of sub - rule (3) ,
(d) in sub - rule (5) , and
(e) in sub - rule (7) ,
after the words "US dollars " , the following words shall be inserted , namely: - "or its equivalent in Indian Rupees" .
4. In the said rules , in Schedules ' D( I )' and ' D( II ) , at the end , after the words " signature of the manufacturer " , the following words shall be added , namely: - "or his authorized agent" ;
5. In the said rules , in Form 40 and in Form 41 , in para 2 , the figures " ( 1 ) , ( 2 ) and (3) " shall be omitted .
