सा.का.नि. 36 (अ).- औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारुप, जिसे केन्द्रीय सरकार ओषधि और प्रसाधन सामग्री अधिनियम , 1940 (1940 का 23) की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, ओषधि तकनीकी सलाहकार बोर्ड से परामर्श के पश्चात् बनाना चाहती है, उक्त धाराओं की अपेक्षानुसार ऐसे सभी व्यक्तियों की, जिनके उससे प्रभावित होने की संभावना है, जानकारी के लिए प्रकाशित किया जाता है और सूचना दी जाती है कि उक्त प्रारुप नियमों पर उस तारीख से, जिसको उस राजपत्र की प्रतियां, जिसमें उक्त अधिसूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि की समाप्ति से पश्चात् विचार किया जाएगा ;
2. किन्हीं ऐसे आक्षेपों या सुझावों पर जो उक्त प्रारुप नियमों की बाबत किसी व्यक्ति से प्राप्त होंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा, जो सचिव (स्वास्थ्य) , स्वास्थ्य और परिवार कल्याण मंत्रालय, भारत सरकार, निर्माण भवन, नई दिल्ली-110011 को भेजे जा सकेंगे ।
प्रारुप नियम
1. इन नियमों का संक्षिप्त नाम ओषधि और प्रसाधन सामग्री ( संशोधन ) नियम, 2005 है ।
2. ओषधि और प्रसाधन सामग्री नियम, 1945 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है) , के नियम 69 के उपनियम (5) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् -
(5) अनुज्ञप्तिधारियों द्वारा अनुसूची ड और ड- III के अधीन यथा प्रवर्गीकृत ओषधियों के प्रत्येक प्रवर्ग की 10 से अधिक मदों के विनिर्माण के लिए या ओषधियों के अतिरिक्त मदों के विनिर्माण के लिए आवेदन यथास्थिति प्ररुप 24 या प्ररुप 24-च में किया जाएगा और उसके साथ ओषधि की प्रत्येक अतिरिक्त मद के लिए तीन सौ रुपए की दर पर अतिरिक्त फीस लगी होगी । ओषधि के प्रत्येक प्रवर्ग की 10 से अधिक मदों 220 GI/2005

के लिए या ओषधियों के अतिरिक्त मदों के विनिर्माण के लिए या विक्रय के लिए और वितरण के लिए या पुनः पैक करने के लिए अनुज्ञप्ति का प्ररुप 24 -ख में आवेदन के साथ अनुसूची ड और अनुसूची ङ- III में प्रवर्गीकृत ओषधियों की प्रत्येक अतिरिक्त मद के लिए 100 रुपए की अतिरिक्त फीस लगी होगी । '
3. उक्त नियमों के नियम 75 के, उपनियम (3) में लार्ज वाल्यूम पेरेंट्रल (अधिक मात्रा में अंतः शिराइन ) और सीरा और वैक्सीन ' शब्द जहां भी आते हैं, के स्थान पर लार्ज वाल्यूम पेरेंट्रल और सीरा और वैक्सीन और पुनर्योगज डी एन ए (आर डी एन ए ) व्युत्पन्न ओषधि ' शब्द रखे जाएंगे ।
4. उक्त नियमों के, नियम 76 में लार्ज वाल्यूम पेरेंट्रल (अधिक मात्रा में अंतः शिराइन) और सीरा और वैक्सीन ' शब्द जहां भी आते हैं, के स्थान पर लार्ज वाल्यूम पेरेंट्रल और सीरा और वैक्सीन और पुनर्योगज डी एन ए (आस्डी एन ए ) व्युत्पन्न ओषधि ' शब्द रखे जाएंगे ।
5. उक्त नियमों के नियम 122 ख में, -
( i ) हाशिया टिप्पण में, अनुसूची ग और ग (1 ) के अधीन वर्गीकृत ओषधि से भिन्न कोई अन्य शब्दों, अक्षरों और अंकों का लोप किया जाएगा ;
(ii ) उपनियम (3) में जो पहले ही अनुमोदित किया गया है ' के पश्चात् और नियम 21 में वर्णित अनुज्ञप्ति प्राधिकारी द्वारा ' शब्दों से पहले आवेदक के नाम में " शब्द अंतःस्थापित किए जाएंगे ।
(iii ) प्रथम परंतुक में अनुज्ञप्ति प्राधिकारी ' शब्दों के स्थान पर ' नियम 21 में अनुज्ञप्ति प्राधिकारी " शब्द और अंक रखे जाएंगे ।
6. अनुसूची क के, उक्त नियमों में -
(i ) प्ररुप 26 ज में, लार्ज वाल्यूम पेरेंट्रल / सीरा और वैक्सीन ' शब्द जहां भी आते हैं, के स्थान पर ' लार्ज वाल्यूम पेरेंट्रल / सीरा और वैक्सीन और पुनर्योगज डी एन ए (आर- डी एन ए ) व्युत्पन्न ओषधि' शब्द , रखे जाएंगे ;
(ii )प्ररुप 27 घ में, ' लार्ज वाल्यूम पेरेंट्रल / सीरा और वैक्सीन ' शब्द जहां भी आते हैं, के स्थान पर ' लार्ज वाल्यूम पेरेंट्रल / सीरा और वैक्सीन और पुनर्योगज डी एन ए (आर- डी एन ए ) व्युत्पन्न ओषधि ' शब्द , रखे जाएंगे ;
(iii ) प्ररुप 28 घ में, ' लार्ज वाल्यूम पेरेंट्रल / सीरा और वैक्सीन ' शब्द जहां भी आते हैं, के स्थान पर लार्ज वाल्यूम पेरेंट्रल / सीरा और वैक्सीन और पुनर्योगज डी एन ए (आसडी एन ए ) व्युत्पन्न ओषधि' शब्द , रखे जाएंगे ;
(iv) प्ररुप 44 में क्रम संख्यांक 2 पर ' ग . नियत खुराक संयुक्ता के लिए अनुमोदन/अनुमति * शीर्ष में मद (1 ) में ' पुनरीक्षण पूर्व जर्नल ' शब्दों के लिए स्थान पर समकक्ष पुनरीक्षित जर्नल' शब्द रखे जाएंगे । 3

7. उक्त नियमों की अनुसूची त में सीरा , टॉक्सिन और टॉक्साइड' शीर्ष के अधीन क्रम संख्यांक 18 के सामने और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात् -

NOTIFICATION
New Delhi , the 20th January, 2005
G.S.R. 36( E) .- The following draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 , which the Central Government proposes to make , after consultation with the Drugs Technical Advisory Board , in exercise of the powers conferred by section 12 and section 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940 ), is hereby published as required by the said sections for the information of all persons likely to be affected thereby , and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of forty- five days from the date on which the copies of the Official Gazette in which this notification is published , are made available to the public.
2. Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the period as specified above will be taken into consideration by the Central Government which may be addressed to the Secretary (Health) , Ministry of Health and Family Welfare , Government of India , Nirman Bhavan , New Delhi -110011 .
DRAFT RULES
1.
Amendment) Rules , 2005 These rules may be called the Drugs and Cosmetics ( THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II-SEC . 3 (i ) ] 2. In the Drugs and Cosmetics Rules , 1945 , ( hereinafter referred to as the said rules) , in rule 69 , for sub rule (5) , the following shallbe substituted , namely: - "(5) Application for manufacture of more than ten items of each category of drugs as categorized under Schedule M and M - III or for manufacture of additional items of drugs by licensees in Form 24 or Form 24F, as the case may be , shall be accompanied by an additional fee at the rate of rupees three hundred for each additional item of drug . Applications in Form 24 B for licence to manufacture for sale and distribution for repacking for more than 10 items of each category or for manufacture of additional items of drugs shall be accompanied by additional fee of rupees one hundred for each additional item of drugs categorized in Schedule M and M- III . "
3. In the said rules , in rule 75 , in sub - rule (3 ) , for the words " Large Volume Parenterals and Sera and Vaccines " , the words " Large Volume Parenterals , Sera and Vaccines and Recombinant DNA ( r - DNA ) derived drugs" , shall be substituted .
4. In the said rules , in rule 76 , for the words , " Large Volume Parenterais, Sera and Vaccines " , the words " Large Volume Parenterals , Sera and Vaccines and Recombinant DNA ( r - DNA) derived drugs " , wherever occurring , shall be substituted.
5. In the said rules , in rule 122 В , -
(i ) in the marginal note , the words , letters and figures "other than the drugs classifiable under Schedule C and C ( 1 ) " shall be omitted;
(ii ) in sub - rule (3 ) , after the words " has already been approved" and before the words " by the Licensing Authority mentioned in rule 21 " , the words " in the name of the applicant" shall be inserted.
(iii ) in first proviso , for the words "Licensing Authority" , the words and figures "Licensing Authority in Rule 21 " shall be substituted.
In the said rules , in Schedule A,

(i ) in Form 26 -H , for the words " Large Volume Parenterals / Sera and Vaccines " , the words , "Large Volume Parenterals / Sera and Vaccines / Recombinant DNA ( r - DNA ) derived drugs " , wherever occurring , shall be substituted;
(ii ) in Form 27 - D , for the words " Large Volume Parenterals / Sera and Vaccines " , the words , " Large Volume Parenterals / Sera and Vaccine/ Recombinant DNA ( r- DNA ) derived drugs " , wherever occurring , shall be substituted;

(iii) in Form 28 -D, for the words "Large Volume Parenterals / Sera and Vaccines " , the words , " Large Volume Parenterals / Sera and Vaccines/ Recombinant DNA ( r- DNA) derived drugs " , shall be substituted;
(iv) in Form 44, at serial number 2 , in the heading " C. Approval / Permission for fixed dose combination : " , in item ( 1 ) , for the words "pre reviewed journals " the words " peer reviewed journals " shall be substituted.
7. In the said rules , in Schedule P, under the heading ' Sera , Toxin and Toxoid' , against serial number 18 and the entries relating thereto , the following entries shall be substituted, namely: -
