सा.का.नि. 39( अ ).- केन्द्र सरकार, महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 132 की उपधारा ( 1 ) के साथ पठित धारा 124 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, चेन्नै पत्तन न्यास के न्यासी मंडल द्वारा बनाए गए और इस अधिसूचना के साथ संलग्न अनुसूची में दर्शित मद्रास पत्तन न्यास ( वेतन व भत्ते आदि ) संशोधन विनियम, 2005 का अनुमोदन करती है ।
2. ये विनियम इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से लागू होंगे ।
अनुसूची
चेन्नै पोर्ट ट्रस्ट
मद्रास पोर्ट ट्रस्ट ( वेतन व भत्ते आदि) ( संशोधन ) विनियम , 2005
महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 28 के तहत प्रदत्त शक्तियों को प्रयोग करते हुए चेन्नै पोट्र ट्रस्ट बोर्ड निम्नलिखित संशोधन विनियम बनाता है :-
1. लघु शीर्ष
येविनियम मद्रास पोर्ट ट्रस्ट ( वेतन व भत्ते आदि ) ( संशोधन ) विनियम, 2005 कहलाए जाएंगे ।
2. ये विनियम कार्यालयीन राजपत्र में प्रकाशित होने की दिनांक से लागू होंगे ।
3. मद्रास पोर्ट ट्रस्ट ( वेतन व भत्ते आदि ) विनियम, 2001 में निम्नलिखित संशोधन किया जाएगा:
(i ) उपरोक्त विनियम को विनियम 13 के तहत विनियम 13 - ए के रूप में निम्नलिखित को शामिल किया जाए ।
" 13- ए अग्रिम/ऋण की वसूली सभी अग्रिम/ऋण की वसूली कर्मचारी के कुल वेतन में से 50 % से ज्यादा न हो । टिप्पणी: अग्रिम/ऋण का अर्थ है कि जो केन्द्र सरकार के सामान्य वित्त नियमों के तहत शामिल है " ;
( ii ) उपरोक्त विनियम का मौजूदा विनियम 22 ( ए ) में पहले पैरा के पहली पंक्ति में, " दो/तीन शब्द " को " दो शब्द" द्वारा प्रतिस्थापित किया जाएगा;

[PART II-SEC. 3(i ) ] ( iii ) उपरोक्त विनियम का विनियम 22 ( बी ) के तहत मौजूदा खण्ड ( xiii ) में
( ए) " दो बच्चों " शब्द को " पहले बच्चे " शब्द से प्रतिस्थापित किया जाएगा;
( बी) संख्या " 4" को " 3 " से प्रतिस्थापित किया जाएगा;
( iv ) उपरोक्त विनियम का विनियम 22 ( बी) के तहत मौजूदा खण्ड ( xvii ) में, पहले पंक्ति में" जिसके " और " जीवित " के बीच " दो " शब्द को " एक " से प्रतिस्थापित किया जाएगा ।

New Delhi , the 20th January, 2005
G.S.R. 39 (F ).- In exercisc of the powers conferred by Sub- section ( 1 ) of Section 124, read with Sub- section ( 1 ) of Section 132 of the Major Port Trusts Act, 1963 ( 38 of 1963 ), the Central Government hereby approves the Madras Port Trust (Pay andAllowances , etc. ) Amendment Regulations, 2005 made by the Board of Trustees of Chennai Port Trust as set out in the Schedule annexed to this Notification.
The said Regulation shall come into force from the date of publication of this Notification in the Official Gazette . SCHEDULE
CHENNAI PORT TRUST
MADRAS PORT TRUST (PAY AND ALLOWANCES, ETC. ) (AMENDMENT) REGULATIONS, 2005 In exercise of the powers conferred under Section 28 of the Major Port Trusts Act, 1963 (38 of 1963 ), the Chennai Port Trust Board hereby makes the following amendments regulations:
1. Short Title : ( 1 ) These Regulations shall be called the Madras Port Trust (Pay and Allowances, etc. ) (Amendment ) Regulations , 2005.
2. These Regulations shall come into force from the date of publication of the regulations in the Official Gazette .
made: 3. In the Madras Port Trust (Pay and Allowances , etc. ) Regulations , 2001 , the following amendments shall be (i) The following shall be included under Regulation 13 of the aforesaid Regulations as Regulation 13 -A:
" 13 -A. " Recovery of the advances /Loans : The recoveries of all advances/loans shall not exceed 50% of the employee's emoluments .
Note: The advances /loans means the advances /loans which are covered under General Financial Rules of the Central Government. "
( ii) In the existing Regulation 22 ( A) of the aforesaid Regulations, the words " two/ three " appearing in between the words " after " and " surviving " in the first sentence of the first para shall be susbstitutedby theword " two " :
( iii) in the existing clause ( xiii ) under Regulation 22(B ) of the aforesaid Regulations-
( a) the words " first two " appearing in between the words " their " and " children " shall be substituted by the word " first" ;
(b) the word " four " appearing at the end after the word "becomes " shall be substituted by the word "threc";
( iv ) in the existing clause ( xvii ) under Regulation 22 (B ) of the aforesaid Regulations, the word " two " appearing inbetween the words " has " and " living " shall be substituted by the word " one " .
