का.आ. 81 ( अ ). केन्द्रीय सरकार, आयकर अधिनियम 1961 ( 1961 का 43) की धारा 35 क ग के स्पष्टीकरण के खण्ड (ख) के साथ पठित उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, आर्थिक एवं सामाजिक कल्याण की अभिवृद्धि के लिए राष्ट्रीय समिति की सिफारिशों पर नीचे दी गई सारणी के कॉलम ( 2) में यथाउल्लिखित संस्थाओं का एतद्द्वारा अनुमोदन करती है तथा उक्त सारणी के कॉलम ( 3 ) में यथाउल्लिखित पात्र परियोजनाओं अथवा स्कीमों और उनकी अनुमानित लागत को विनिर्दिष्ट करती है तथा कथित सारणी के कॉलम (4 ) में ऐसी लागत की अधिकतम राशि को भी विनिर्दिष्ट करती है जिसे उक्त धारा 35 क ग के तहत कटौती के रूप में अनुज्ञात किया जाना है, नामतः

In exercise of the powers conferred by sub- section ( 1 ) read with clause (b) of the Explanation to section 35AC of the Income- tax Act , 1961 (43 of 1961 ) , the Central Government, on the ecommendations of the National Committee for Promotion of Social and Economic Welfare, hereby approves he institutions mentioned in column (2) of the Table below and specifies the eligible projects or schemes and ne estimated cost thereof as mentioned in column (3 ) of the said Table and also specifies in the column (4) of ne said Table, the maximum amount of such cost which may be allowed as deduction under the said section 5AC , namely: - THE GAZETTE OF INDIA : EXTRAORDINARY

का.आ. 82 ( अ ). जबकि आयकर अधिनियम, 1961 (1961 का 43) की घारा 35 क ग के स्पष्टीकरण के खण्ड (ख) के अंतर्गत जारी की गई मारत सरकार, वित्त मंत्रालय ( राजस्व विमाग) की दिनांक 12 अगस्त, 1993 की अधिसूचना सं० सां ० आ० 602 (अ०) द्वारा केन्द्रीय सरकार ने हेल्पेज इंडिया, सी -14 , कुतुब इंस्टीट्यूशनल एरिया , नई दिल्ली-110016 द्वारा वृद्ध लोगों, कुष्ठ रोग और कैंसर रोगियों की चिकित्सीय देखरेख, वृद्ध लोगों के लिए घर के प्रावधान , निराश्रित वृद्ध महिलाओं के पुनर्वास , नेत्र शिविर लगाने की परियोजना अथवा स्कीम को कर निर्धारण वर्ष 1994- 1995 से आरम्भ होने वाले वर्ष से दो वर्षों की अवधि के लिए एक पात्र परियोजना अथवा स्कीम के रूप में क्रम संख्या 12 पर विनिर्दिष्ट किया था और जिसे बाद में कर निर्धारण वर्ष 1996-1997 से आरम्भ होने वाले कर निर्धारण वर्ष से तीन वर्षों की अवधि के लिए एक पात्र परियोजना अथवा स्कीम के रूप में दिनांक 3 मई , 1995 की अधिसूचना सं ० सां० आ 0 405 (अ०) द्वारा और बढ़ा दिया गया था जिसे बाद में कर निर्धारण वर्ष 1999-2000 से आरम्भ होने वाले कर निर्धारण वर्ष से तीन वर्षों की 24 / THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II- SEC . 3 (ii)] अवधि के लिए दिनांक 16 मार्च , 1998 की अधिसूचना सं० सां० आ० 220 (अ० ) द्वारा बढ़ा दिया गया था जिसे बाद में 20 जून, 2001 की अधिसूचना सं० सां० आ० 553 (अ०) द्वारा कर निर्धारण वर्ष 2002-2003 से आरम्भ होने वाले कर निर्धारण वर्ष से तीन वर्षों की अवधि के लिए बढ़ा दिया गया था और जिसकी लागत को 2000.00 लाख रूपए से 4000.00 लाख रूपए तक बढ़ाने के लिए दिनांक 18 अक्तूबर , 2001 की अधिसूचना सं० सां० आ0 1046 (अ० ) द्वारा संशोधित किया गया था;
और जबकि उक्त परियोजना या स्कीम के 11 वर्षों से अधिक समय तक चलने की संभावना है;
और जबकि आर्थिक और सामाजिक कल्याण की अभिवृद्धि के लिए राष्ट्रीय समिति का यह समाधान हो जाने पर कि उक्त परियोजना अथवा स्कीम उपयुक्त रूप से निष्पादित की जा रही है , इस समिति ने आयकर नियमावली , 1962 के नियम 11 ड के उप -नियम (5) के अन्तर्गत उक्त परियोजना अथवा स्कीम की अनुमोदित लागत को 4000.00 लाख रू० से संशोधित करके 6500.00 लाख रूपए विनिर्दिष्ट करने की एक ओर सिफारिश की है;
इसलिए अब केन्द्रीय सरकार एतद्वारा आयकर अधिनियम , 1961 ( 1961 का 43) की धारा 35 क ग के स्पष्टीकरण के खण्ड ( ख) के साथ पठित उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए
( क) एतद्वारा हेल्पेज इंडिया, सी-14 , कुतुब इंस्टीट्यूशनल एरिया , नई दिल्ली-110016 द्वारा वृद्ध लोगों, कुष्ठ रोग और कैंसर रोगियों की चिकित्सीय देखरेख , वृद्ध लोगों के लिए घर के प्रावधान, निराश्रित वृद्ध महिलाओं के पुनर्वास, नेत्र शिविर लगाने की परियोजना या स्कीम को वित्तीय वर्ष 2004-2005 से प्रारंभ होने वाले वर्ष से तीन वर्ष की अवधि के लिए एक पात्र परियोजना अथवा स्कीम के रूप में विनिर्दिष्ट करती है; और
( ख) दिनांक 12 अगस्त, 1993 की अधिसूचना सं० सां ० आ0 602 ( अ०) में आगे निम्नलिखित संशोधन करती है नामतः
उक्त अधिसूचना की सारणी में क्रम सं0 12 के सम्मुख कॉलम (4) में अनुमोदित की गई अधिकतम लागत से संबंधित अक्षर , आंकड़े और शब्द " केवल 4000.00 लाख रूपये " के स्थान 4 " 6500.00 लाख रूपये " प्रतिस्थापित किए जाएंगे । पर अक्षर, आंकड़े और शब्द

NOTIFICATION
New Delhi , the 24th January, 2005
S.O. 82 (E ) . Whereas by notification of the Government of India in the Ministry of Finance (Department of Revenue ) number S.O.602 (E) dated the 12th August , 1993 issued under clause (b) of the Explanation to section 35 AC of the Income- tax Act , 1961 (43 of 1961 ) , the Central Government had specified at serial number 12 , the project or scheme for Medical care to old persons leprosy and cancer patients , provision of home to old persons , rehabilitation of destitute old women , conducting eye camps , by Helpage India, C- 14, Qutub Institutional Area, New Delhi 110016, as an eligible project or scheme for a period of two years beginning with assessment year 1994-1995 which was extended further vide notification number S.O.405 (E) dated the 3rd May 1995 for a period of three years beginning with assessment year 1996-97 which was [ भाग II- खण्ड 3 ( ii) ]

7 extended further vide notification number S.O.220 (E) dated the 16th March , 1998 for period of three years beginning with assessment year 1999-2000 which was extended further vide notification number S.O.553 (E) dated the 20th June , 2001 for period of three years beginning with assessment year 2002-2003 and which was also amended notification number S.O.1046 (E) dated the 18th October, 2001 to enhance the cost from Rs.2000.00 lakhs to Rs.4000.00 lakhs;
And whereas , the said project or scheme is likely to extend beyond eleven years ; And , whereas , the National Committee for the Promotion of Social and Economic Welfare, being satisfied that the said project or scheme is being executed properly , made a further recommendation under sub- rule (5) of rule 11M of the Income-tax Rules, 1962 for specifying the said project or scheme for a further period ofthree years and amending the project cost from Rs.4000.00 lakhs to Rs.6500.00 lakhs;
Now, therefore, the Central Government , in exercise of the powers conferred by sub- section ( 1 ) of, read with clause (b) of the Explanation to, section 35AC of the Income- tax Act , 1961 (43 of 1961 ) , -
(a) hereby specifies the scheme or project for Medical care to old persons , leprosy and cancer patients , provision of home to old persons , rehabilitation of destitute old women, conducting eye camps which is being carried out by Helpage India, C- 14, Qutub Institutional Area, New Delhi - 110016 as aneligible project or scheme for a further period of three years commencing from the financial year 2004-2005; and (b) further amends the said notification number S.O. 602 (E) dated the 12th August , 1993 , to the following effect , namely: - Inthe said notification, in the Table against serial number 12, in column (4) relating to maximum cost for which approved, for the letters, figures and word " Rs.4000.00 lakhs" the letters, figures and word "Rs.6500.00 lakhs " shall be substituted.
