सा.का.नि. 41 ( अ ).-केन्द्रीय मोटर यान नियम , 1989 का और संशोधनं करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप , जिन्हें केन्द्रीय सरकार, मोटरयान अधिनियम, 1988 ( 1988 का 59 ) की धारा 110 की उप- धारा ( 1 ) के खंड ( छ ) , द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बनाना चाहती है, उक्त अधिनियम की धारा 212 की उप- धारा ( 1 ) की अपेक्षानुसार, ऐसे सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर, उस तारीख से, जिसकी भारत के राजपत्र में यथा प्रकाशित इस अधिसूचना की प्रतियां जनता को उपलब्ध करा दी जाती हैं, तीस दिन की अवधि के अवसान के पश्चात् विचार किया जाएगा;
इन प्रारूप नियमों के संबंध में, आक्षेप या सुझाव, यदि कोई हो, संयुक्त सचिव ( परिवहन ) , सड़क परिवहन और राजमार्ग विभाग , परिवहन भवन, नई दिल्ली को भेजे जा सकेंगे;
आक्षेपों या सुझावों पर, जो उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से ऐसी विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त होंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
प्रारूप नियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मोटर यान ( संशोधन ) नियम, 2005 है ।
(2) ये राजपत्र में इनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय मोटरयान नियम , 1989 के नियम, 115क के उपनियम ( 5 ) के अन्त में, टिप्पण 2 में 1 अप्रैल , 2005 " शब्द और अंकों के स्थान पर " 1 अक्तूबर, 2005 " शब्द और अंक रखे जाएंगे ।

NOTIFICATION
New Delhi , the 25th January, 2005
G.S.R. 41 (E ). The following draft of certain rules further to amend the Central Motor Vehicles Rules , 1989 , which the Central Government proposes to make in exercise the powers conferred by clause ( g) of sub - section ( 1 ) of Section 110 ofthe Motor Vehicles Act , 1988 (59 of 1988 ) , is hereby published as required by sub - section ( 1 ) of Section 212 of the said Act for information of all persons likely to be affected thereby ; and notice is hereby given that the said draft rules will be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Gazette of India , are made available to the public;
Objections or suggestions to these draft rules , if any, may be sent to the Joint Secretary (Transport ) , Department ofRoad Transport and Highways , Transport Bhawan, Parliament Street , New Delhi - 110001;
The objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period so specified will be considered by the Central Government .
DRAFT RULES
1. ( 1 ) These rules may be called the Contral Motor Vehicles (.. Amendment) Rules, 2005.
(2) They shall come into force on the date of their final publication in the Official Gazette .
2. In the Note 2 appearing at the end of sub - rule (5) of Rule 115A of the Central Motor Vehicles Rules , 1989 , for the words , letters and figures " Ist April , 2005 " , the words, letters and figures " 1st October, 2005 " shall be substituted.
